The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):
COUNT I
Charge: Accomplice After the Fact to Felony Murder
Minnesota Statute: 609.495.3, with reference to:  609.19.2(1)

Charge Description: That Robert Thomas West (DOB:5/12/1980), in Cook County, Minnesota, did
intentionally aid another person whom the actor knew or had reason to know has committed felony
murder in violation of Minn. Stat. § 609.19, subd. 2(1), by destroying or concealing evidence of that crime,
providing false or misleading information about that crime, receiving the proceeds of that crime, or
otherwise obstructing the investigation or prosecution of that crime.

STATEMENT OF PROBABLE CAUSE 7/16/2021

 
The Complainant states that the following facts establish probable cause:
 
Your compainant is Agent Chad Layon of the Minnesota Bureau of Criminal Apprehension ("BCA")

On July 13, 2021, Agent Wright of the BCA was contacted by the Douglas County Wisconsin Sheriff's
Office related to a person reported missing from Minnesota in June, 2021: R.A.B. (hereinafter "Subject 1").
Douglas County learned that Subject 1 was likely murdered and dismembered on June 20, and his body
later placed in 5 gallon buckets in Lake Superior outside of Grand Portage, Cook County, Minnesota. An
adult witness (hereinafter "Subject 3") who had information about Subject 1 agreed to speak with the BCA. 

Subject 3 was acquainted with two adult males, Jacob Colt Johnson (DOB: 2/13/1986) and Robert
Thomas West (DOB: 5/12/1980) (hereinafter "Defendant"), and met up with them on June 20, 2021, at
Defendant's home. Johnson appeared nervous about something he was carrying in his car being
discovered, but Subject 3 did not then know why.  When Subject 3 asked about the car, Johnson said,
"please don't make me tell you what I have on me."  Subject 3 later saw bullet holes in the passenger seat
of Johnson's vehicle.  Sometime after that, Johnson asked Subject 3 to deliver a bag with a gun in it to
Defendant. On June 22, Defendant asked Subject 3 if Subject 3 knew anybody with a boat because he
wanted to go fishing.  Subject 3 identified an acquaintance in Grand Portage, hereinafter known as
"Subject 2" who was a commercial fisherman and owned a boat.

Defendant and Subject 3 caravanned in separate vehicles to Grand Portage, Minnesota, Defendant driving
his extended cab pick-up truck. They stopped at a camping area about 15 minutes prior to Grand Portage,
at which point Subject 3 asked Defendant whether he was paranoid. Defendant answered, "ya with a dead
body in the back." After Defendant and Subject 3 met with Subject 2 in Grand portage around 11:30 p.m.
on June 22, Defendant told Subject 2 he had some of his grandmother's valuables that he wanted to dump
in the lake.  

On June 23, Subject 3 overheard a conversation about "3 buckets," then Defendant told her that Subject
1's body was "chopped up" in a camper, that Johnson had shot Subject 1, and that "it was in self-defense." 

When Subject 3 and Defendant arrived back in Duluth on June 23, Defendant told Subject 3 there was a
bloody fingerprint on a lid and Subject 3 saw a green lid big enough to fit over a 5 gallon bucket in the back
of Defendant's truck. Defendant attempted to burn the lid with a torch. A residential door that Subject 3 had
seen propped up over objects in the back of Defendant’s truck the day before now lay flat. Subject 3 told
agents that Defendant and Johnson owned a storage shed together and that Subject 4 had implied that
there was a gun in the shed. 

On July 15, 2021, BCA Agent Layon met with Subject 2, who told the agent about being contacted by
Subject 3 for help disposing some personal belongings that had belonged to family of an acquaintance.
Subject 2 met with a male (who he later identified as Defendant by use of a photo line up) who asked him
to boat him into Lake Superior. Subject 2 observed Defendant drop two 5-gallon buckets and one large
tote, which he said contained the body of a dog, into the water. Subject 2 corroborated the approximate
date and time of night that Defendant and Subject 3 met with Subject 2, Subject 2 identified Defendant's
truck as an extended cab pickup truck, and Subject 2 said he had observed a door in the back of
Defendant's truck covering everything in the bed. Subject 2 believed the buckets had green or black lids
and noted they were likely heavy because Defendant strained while lifting them, one at a time. 

With the assistance of the St. Louis County Sheriff's Office and with Subject 2's help in locating the area

where Defendant dumped containers, BCA agents recovered one tote and one 5 gallon bucket from the 7/16/2021
floor of Lake Superior. These items were transported to the Anoka County Medical Examiner's Office for
examination. Within the tote was discovered a male human torso with legs, arms, and head removed. In the
pocket of a pair of pants located in the tote was a casino players card belonging to Subject 1.  Agents
observed what appeared to be a bullet wound in the torso.

On July 16, 2021, Defendant, while held in custody in Douglas County, Wisconsin, on unrelated charges,
requested to speak with law enforcement. After waiving Miranda, Defendant confessed to coming up with
the plan for disposal of Subject 1's body and assisting in the effort to dismember him. Defendant
corroborated a number of details from Subject 3's and Subject 2's statements. Defendant remains in the
custody of Douglas County, Wisconsin, on unrelated charges. A warrant for Defendant's arrest is
requested.

From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).

SUMMONS
THEREFORE YOU, THE DEFENDANT, ARE SUMMONED to appear as directed in the Notice of Hearing before the
above-named court to answer this complaint.
IF YOU FAIL TO APPEAR in response to this SUMMONS, a WARRANT FOR YOUR ARREST shall be issued.
