Ladies and Gentlemen:

This is to humbly appeal to the Honorable CommissionProcessors to grant our new company registration
with the name:
“FIXON ENGINEERING INC.”

The said company name is coined after FIXON INC., the leading manufacturer of corrugated steel plates
which has been duly registered in the Republic of Korea since 1994. Fixon Corrugated Steel Plates
passed the rigid technical evaluation from the Bureau of Research and Standards and eventually been
accepted and approved by the Department of Public Works and Highways as it’s new item in May, 2018,
in line with the agency’s efforts to upgrade construction technology through innovative technologies.

In its desire to better serve the Filipino community, Fixon Inc. wishes to establish a company in the
Philippines under the name FIXON ENGINEERING INC.

Attached are registration documents of Fixon Inc. and DPWH Department Order for Corrugated Steel
Plate, for your reference.

Upon initial registration, the application for the proposed name “FIXON ENGINEERING INC.” has been
denied for the following reasons:

1. Failure due to close or similar name/s found:

 N FIX PHILS. INC.
 FIX N TRADE CO.
 FIX N IT DESIGN SOLUTIONS COMPANY

2. Temporary Reserved Company name

 Fix n Clean Housekeeping Services

3. Exclusive Company Type Name

 Engineering.

With all due respect, we are humbly appealing the denial of our application and/or registration based on
the above-mentioned grounds. The purpose of a trade name is to distinguish one enterprise from
others, quite independently of the goods or services that the enterprise markets or renders. What the
law seeks to prevent is to cause confusion to the public when the registration of trade names is identical
with or confusingly similar to a prior registered trade name. To be valid, the application for a trade name
must, among others, have its own “distinctiveness” as compared to previously registered trade names.

FIXON ENGINEERING INC. shall be (insert nature and line of business).

FIX N IT DESIGN SOLUTIONS COMPANY (insert nature and line of business)

From the foregoing, it could be clearly distinguished that FIXON engineering has a completely different,
distinct, and separate line of business in comparison with the other subject companies. The denial based
on similarity of name arose from the words “FIX” and “N” which are present among all the subject trade
names. However, it does not necessarily mean that because the word “FIX” and “N” appears on the
subject trade names that the application for “FIXON ENGINEERING INC.” should be automatically
denied. Moreover, the basis of its denial solely on the ground that the sounds produced are similar to
the names of the previously registered trade names is misplaced. Factors such as the type of business
and services to be rendered by the company should also be considered in the application as this would
indicate its distinctiveness of its enterprise.

Further, The said company name is coined after FIXON INC., the leading manufacturer of corrugated
steel plates which has been duly registered in the Republic of Korea since 1994. Fixon Corrugated Steel

As to the denial of the word “ENGINEERING”, the company does not intend to claim exclusivity over said
name as it is a generic term.

In conclusion, the registration of “FIXON ENGINEERING INC.” will not cause confusion, mistake, or
deception to the general public. Thus, in the interest of substantial justice, we are humbly requesting
that the name “FIXON ENGINEERING INC.” be approved by your Honorable Commission based on the
discussions mentioned above.
