INTRODUCTION

“The man who moves a mountain begins by carrying away small stones.”

- Confucius

The Bureau of Jail Management and Penology (BJMP), was created

pursuant to the provision of the Republic Act No. 6975 or “The DILG Act of

1991”. Its mandated task is the safekeeping and development of all persons

deprived of liberty (PDL) under its jurisdiction. Today, the jail bureau is headed

by JAIL DIRECTOR ALLAN SULLANO IRAL, CESE and is on its top of

transforming its facilities and services through great innovations and best

practices that will change the lives of the persons deprived of liberty. Recently,

the Bureau presented the 4G Management Strategy which is the Guard the Gate,

Guard the Life, Guard the Purse and Guard the Badge. In this relation, Manila

City Jail – Male Dormitory continues to offer its public service to the community

that promotes respect, compassion, empathy and forbearing ways for the

safekeeping and development of Persons Deprived of Liberty (PDL).

MANILA CITY JAIL (MALE DORM) JAIL HISTORY

Manila City Jail was originally named “Carcel y Presidio Correcional”

means Correctional Jail and Military Prison. It was built in 1847 (173 years from

2021) and formally opened on 25 June 1865 by virtue of Spanish Royal Decree.

In 1940, the prisoners’ equipment and facilities were transferred to the

New Bilibid Prison which started construction in 1936. Since then, the old facility

came to be known as the Old Bilibid Prison.

During World War II, the Old Bilibid Prison was used by the Japanese

Kempeitai (Military Police) for holding special prisoners throughout their

occupation of Manila and Luzon; General Vicente Lim was among those

interned.

The remnants of the old facility were used by the City of Manila as its

detention center employing Prison Guards and members of the defunct

Integrated National Police until its transfer to the Bureau of Jail Management and

Penology 1992.

Originally built by the Spaniards in the 19th Century, the MCJ was home

to prisoners of war during the Japanese occupation of Manila during World War

II. Time has ravaged the Manila City Jail. Presently, it is under-staffed,

overcrowded and in disrepair. Today it houses over 2,912 PDL – an overcapacity

rate of 5x on 1.2 hectares – making the MCJ undoubtedly one of the most heavily

congested jail facilities in the country.

JAIL FACILITY SITUATION UPDATE

Manila City Jail – Male Dorm is situated at 851 Oroquieta St, Santa Cruz,

Manila, 1003 Metro Manila, National Capital Region. One of the biggest jail

facilities in the Philippines, it consists of fourteen (14) dormitories for male

offenders, each dormitory has its own toilet and bath facilities. It has been parted

into two sectors: The North and South. The North Sector is resided by different

gangs with dorms eight (8) to fourteen (14) which includes the Sigue Sigue

Sputnik Gang (SSS), Sigue Sigue Commando Gang (SSC), Batang City Jail

Gang (BCJ) and Bahala na Gang (BNG). While in the South Sector is diverse,

they called it Cuerna.

MCJ-MD is a small-based like community, surrounded by houses outside

the premises and near Landmarks around the area, the Dr. Jose Fabella

Memorial Hospital, the PNP Central Market Sta. Cruz Police Station (PS-3),

Isetann Mall, Far Eastern University and the University Belt which is 2 kilometers

away from the jail.

As of 27 February 2021, MCJ-MD is catering a total of Male PDL. The jail

facility is being manned by (8) Jail Officer Rank and (180) Jail Non-Officer Rank,

one hundred eighty-eight (187) of whom are males (147) and of whom are

females, taking a strength of (40) Personnel in total.

Due to the pandemic the personnel were divided into two teams. The PDL

are free to come out of their cells but only to their respective compounds

throughout their detention period. They are only allowed to go outside the jail

facilities during their court hearings, when attending health concerns and when

visiting the death of a family member.

The MCJ is surrounded by houses and informal settlers, these houses are

built higher than the jail’s perimeter fence which make it susceptible to throwing

and passing over of contrabands. Moreover, this kind of fence make it likely for

PDL to escape the facility. Also, due to the number of houses built around the

MCJ-MD, the road became very narrow; consequently, some of their transport

vehicles, particularly the BJMP bus is unable to park inside the facility.

1. Administrative Section

 Personnel of the jail are well informed regarding their upcoming

activities or events which are being announced ahead of time.

 In relation to documents, the office has a good filing system. They

make sure that all documents, memoranda, and other communications

are well-kept.

 The documents are also properly filed in the computer as a back-up

files.

 Duty details of personnel are also updated and properly observed.

 The changing of guards was also concerned of the office.

 In MCJ-MD, the Administrative Section has two (2) sub-units: The

Personnel and Record Management (PRM) Unit and the Human

Resource and Development (HRD) Unit.

Learning

 All files like memorandum, Letter order, Office order, special order and

General order should be organized and kept safe accordingly based on

the filling system.

 It was observed that the staff at the admin office were functioning well

even though they are of lack of personnel due to the skeletal force

being implemented as a guiding protocol to the agencies of the

government.

2. Operations Section

The Operations Section of MCJ-MD has the following units: Escort

Unit, Custodial Unit, Records Unit and Gate Security Unit, which is

composed of Gate Security, Biometrics and Searcher. Each unit

performs their particular tasks willingly and professionally with multi –

tasking staffs.

2.1. Escort Services

One of the most affected jail operations is the escort services,

wherein the going out of the jail unit is limited due to COVID-19

restrictions. The JIP Trainees were not able to observe and witness the

actual escorting since they were lockdown inside the jail facility.

In normal situation, PDLs are escorted to attend to their court

hearings in order to ensure the safety of PDL against any threat

outside. But today, court hearings are conducted virtually, wherein PDL

are no longer required to attend the court hearing instead they will

proceed to the paralegal office for their tele-hearing. This is done via

zoom meeting.

2.2 Custodial Unit

 The Custodial Unit is responsible for the head counting of PDL,

conducted four (4) times a day to ensure all PDL are duly accounted

for. The desk officer updates the actual and present jail population to

NCR and NHQ.

 This unit observes guard mounting.

 There is a bell ring system which indicates different commands based

on the number of rings. Two (2) bell rings means “bawas tao” - PDL

need to get inside the brigade to lessen the crowd outside, three (3)

bell rings means PDL should fall in line for headcount, and five (5) bell

rings means “rancho” or food distribution.

 Aside from the primary and secondary fence, there is a pit or canal that

adds security around the facility.

 The situational report are conducted every one hour to ensure the

alertness of the guard on post while on duty.

Negative Observations

 Due to lack of personnel, some of the tower don’t have guards. But

they are flexible and more attentive on their post.

 Perimeter lights are dim and fences looks old and rusty. But they are

also on alert by extending their roving to the area where there is no

sufficient illumination.

Learning

 As a perimeter guard, it is important to be more active and attentive on

their post. Roving is needed to be more secure to the area.

 For PDL accounting, make sure to account the PDL correctly and surely

to avoid error in accounting.

2.2. Records Unit

 Staff of this unit render service beyond office hours to process the

PDL’s release.

 The inmate Carpetas are found in this unit which are arranged

alphabetically in a self-according to the status of their cases, i.e.

Insular PDL, Active PDL on going trial, Active Sentenced PDL,

Diseased PDL, Released PDL.

 This Unit practices the use of an Index Carpeta which is arranged

alphabetically, for easy access of PDL information. This helps them

monitor and update the scheduled hearing and other personal data.

 They also have E-Carpeta wherein they scan all the documents inside

the carpeta of the PDL. This tool makes the PDL documents

accessible.

Learning

 Based on our observation, we learned that files and documents of the

PDL is very important because it keeps their case r`1ecords and

tracks the progress of their cases. The e-carpeta also is convenient

because documents are saved and preserved in soft copies making it

easy to retrieve all files of the PDL.

2.3. Gate Security Unit

The Manila City Jail-Male Dorm is composed of Gate Security and

Searchers. This is the most vulnerable unit since it is where contrabands

could possibly be concealed in if proper procedure of searching and

seizure of items and materials is not being exercised. Due to the

Pandemic cause by Corona Virus decease, the searching unit is

temporarily shut down and added to Gate Security team.

2.4.a. Gate Security

 It has been observed that the personnel assigned in the gate security

is very vigilant during day and night. They also exercise fairness and

impartiality that even the City Jail Warden and his vehicle are also

subject to searched.

 They are in-charge in the frisking of personnel and checking of vehicles

who are entering and leaving the jail facility when changing of Guards.

 It is a protocol being observed that when the main gate is open, the

secondary gate should be closed and vice versa.

 Upon entering the jail facility, the Gate Security checks and verifies the

cellular phones of the personnel if these are registered in the system

Negative Observation

 Commodities entering the jail facility such as, tube ice (which comes in

bulk), grocery stocks for the supply in the jail cooperative (which comes

in boxes), Mineral Water, LPG etc are not thoroughly checked.

 The padala or pabili of the jail unit is also being exercised where it is

said that this is not included in the BJMP manual and its only a

discretion of the office-in-charge but it has a positive result because the

tax that is being charged to the padala is used as additional fund for

the improvement of the jail facilities.

3. Inmates Welfare and Development Section

The Welfare and Development personnel serves as the coordinator

for the activities and programs being scheduled for self-actualization

and improvement of the PDL while inside the jail facility.

 This unit is also responsible in facilitating and promoting educational

programs like the Alternative Learning System (ALS) which includes

Elementary Educations, High School and Vocational Courses, which

include skills training in being a Barista, Hilot Wellness and skills in

laundry detergent making.

 They already have prepared programs and activities to impose for the

whole month.

 They implement the education, skills, training programs as well as

work programs which can enhance the PDLs’ chances for employment

upon their release and reintegration to the society.

 Daily flag raising ceremonies for the PDL within their respective sector

is being conducted with the presence of a jail personnel.

 They make sure that the PDL attends religious services and encourage

PDL to participate in their daily activities.

3.1 Paralegal Services

 Court Hearing are now conducted by way of online hearings with the

used of gadgets and computers.

 This unit aims to provide legal assistance for speedy disposition of the

cases of the PDL.

 Upon the commitment of PDL, this unit gives legal assistance through

seminars/orientations in criminal procedure.

 Moreover, this unit verifies the status of the case of the PDL by visiting

different courts where the cases were filed.

 This unit is also in-charge of reviewing the case of the PDL which are

neglected or have stayed in long pending case, as well as securing the

court hearing calendar, informing the PDL about the schedule of the

hearing and properly turning it over to the desk officer for the custodial

to be noted.

 Paralegal unit maintains Detainee’s Notebook wherein the information

of the PDL is written and serves as their reference.

3.2 Mess Services

 The Mess Services, or the Food Service Unit as what they call it at

MCJ-MD, observes the proper decorum in the kitchen. The PDL, who

serve as Kitchen Aides, are wearing the prescribed uniform with boots,

apron, mask and hand gloves. In addition, the Food Service Unit made

sure that kitchen aides have health certificates prior to being assigned

in the kitchen to ensure that those who will handle the preparation of

the food has no health issues.

 They also have first aid kit and fire extinguisher in case of emergency.

 This unit uses chopped wood in cooking instead of the liquefied

petroleum gas because it is more practical and cheaper considering

the volume of the food being prepared.

 Moreover, the personnel assigned in this unit conducts survey to

determine if the PDL are satisfied with the food they serve. They have

a standard portion of ration: rice should weigh 300 grams and the

portion of meal depends on what kind of meal they will prepare.

 Cleanliness is maintained in this unit. They made sure that the floor is

always clean and free from any obstructions to avoid accident.

 Their stocks are stored properly i.e. the vegetables are stocked above

the ground to avid contamination, while they observe the “FiFo” system

or the first in, first out in the sacks of rice.

 They have a buffer in the preparation of the food so they can

accommodate the meals of the newly committed PDL.

 Due to the fact that MCJ-MD has more than 3,000 jail population, the

kitchen aides start to cook the breakfast ration at 2200H, the lunch

ration at 0000H and the dinner ration at 0600H.

 Meanwhile, the food distribution for the breakfast ration starts at

0500H, the lunch ration at 1000H, and the dinner ration at 1700H.

Every dorm has their own representative who presents a piece of

paper containing the total number of PDL in their dorm.

3.3 Health Services

 Being one of the biggest jails in the country, MCJ-MD has its own

health facility to attend to PDL’ health issues and needs.

 The Health Service Unit of this jail is responsible for the outside check-

up of PDL who are sick provided there is an issued court order. The

check-up must be done in the nearest government hospital.

 This unit is also responsible in conducting the Drug Dependency

Examination (DDE) of PDL in proper coordination with the government

agencies like Department of Health (DOH) and Manila Treatment and

Rehabilitation Center.

 Whenever there are PDL who need to be admitted in the hospital,

there is one (1) personnel who will serve as the duty nurse and attend

to the needs of the PDL, if there are no relatives present, at the same

time to serve as the security of the PDL.

 During hospitalization, the legitimate family is informed.

4. Jail Intelligence and Investigation Unit

 The Jail Intelligence and Investigation Unit at Manila City Jail –

Male Dorm serves as the mediator that settles conflicts between

PDLs.

 They conduct day-to-day surveillance of PDL and greyhound

operations in their dorms to prevent escape, and to control the

entry of contraband being sneaked inside the jail facility.

 Prepares intelligence and investigation report to prevent untoward

incident in the jail facilities.

 They intended to investigate the remarkable incidents inside and

look for asset who will get information inside the facility.

Learning

 This unit exercise good judgment. They implement counseling

programs which is vital for the resolution of conflicts.

CONCLUSION
This jail facility makes use of inventive and systematic maneuvers in

upgrading their resources and uphold the bureau’s mission by ensuring humane

safekeeping and development of people behind bars. Reformative activities such

as education, sports activities, livelihood programs and counselling through

religious activities facilitates holistic rehabilitation programs which aim to develop

and enhance the intellectual, spiritual, social, psychological and physical well-

being of inmates. The MCJ-MD is heavily congested as of December 19, 2020.

As of today, with the jail population of 2,912 PDL and ideal capacity of 1,147

resulting to an excess of 1,0765 PDL, the jail is becoming crucial for

rehabilitation. It has been more congested since the time when the President

Rodrigo Roa Duterte passed the Republic Act 9165 “Comprehensive Dangerous

Drug Act of 2002” wherein many drug abusers had been committed inside. The

jail is also equipped with services to ensure the PDL’ welfare and development

particularly in health are well exercised.

At present, the MCJ-MD is manned with 179 personnel that are

performing simultaneous from administrative, operation, intelligence and

investigation to health-related purposes. The personnel ratio has been the

common issue to the city, municipal and district jails nationwide. Because of the

shortage of manpower, the Bureau extends its mass hiring nationwide and opens

its door for the promising next candidate to be and effective jail officer and be

part of their committed.

One of the major concerns of the jail is the lack of personnel where they

experience multi-tasking, performing at least two functions at the same time.

That’s why some of the offices in the MCJ-MD rely with the help of the jail aides.

Yes, having them in the office can be an ease in the work load of the

personnel, but not to the extent of depending and relying everything to them.

We also conclude that, having enough budget in every jail facility must

observe. Because this can help maintain the overall security of the facility,

maintenance and in upgrading or changing their equipment especially their

handcuffs.

Over all MCJ-MD represents a jail facility that caters innovation and

despite of the congestion inside, they are still striving for great change in the jail

facility.

RECOMMENDATION

Right now, MCJ – MD is still in need of manpower, so there is a certainly a

need for additional personnel. Because of the continuous mass hiring of the

Bureau, this will somehow lessen the problem of every jail that lacks of

personnel. Anyhow, MCJ – MD is continuously performing its duties and

responsibilities conscientiously despite of inadequate personnel in the facility.

Nowadays, the Philippine jail setting is tremendously facing an arduous impact of

overcrowding / congestion for the most part in urban areas. Consequently, most

jails are struggling on how to solve the congestion problem in jails. The

government may have set the ideal standards for all jails facilities, nonetheless,

in the real circumstance, comparatively are being followed and implemented but

mostly are depending on remedies done by personnel.

One of the most important things to do as a public servant is to have to

wear your uniform with dignity and pride. Thus, every personnel are responsible

to do such, as result jail personnel must comply with the prescribed uniform of

the day set by the National Headquarters of the BJMP.

The MCJ – MD is still doing its best to improve their facilities, but the jail

must have an additional facility to have an effective and efficient custodial

operations, to secure all the perimeter to prevent escapes and to avoid other jail

problems. Also, they should give attention to their perimeter fences, must check

the stability of it and provide an immediate action for the problem.

Use of kitchen tools must be strictly supervised by the jail personnel; they

should properly monitor the use the kitchen tools to prevent to sneak out by the

PDL.

It is a good thing that the MCJ-MD has a food service unit that help in the

daily operation inside the jail. Though they are wearing prescribed proper uniform

there are still some kitchen aide that are not following for the reason that their

boots are not clean and not allowed in vegetable preparation area. It is a rule that

you should always wear a close shoe in preparing food not just for sanitation but

also for the safety of the workers. We recommend that they should have a

separate rubber shoe sole in the vegetable section. They should also provide at

least two to three apron each kitchen aide so they can alternate it every day. In

the bakery we recommend to add additional lightning and improve the ventilation

inside the preparation area. They should have an easy access to a clean water

for their daily operation. They should also practice wearing a proper prescribed

uniform such as apron, mouth guard and hairnet. The old and broken container

must be change and dispose to prevent it from being the nesting place of vermin.

For the information and safety of the kitchen worker they should put signage and

caution around the kitchen and baking area.
