Introduction
1 The abandonment of seafarers remains a serious issue. Taking into account that there
were still a considerable number of unresolved cases on the IMO/ILO joint database of
abandonment of seafarers, the Legal Committee, at its previous sessions, decided to keep this
subject matter under consideration.
2 The accuracy of the abandoned seafarer database is critical in order to support

interested parties to help resolve incidents of abandonment, as well as to release information
to the public, including entities involved in providing financial security for cases of
abandonment, as required by the 2014 amendments to the Maritime Labour Convention
(MLC), 2006.

Acceptance of the 2014 Amendments to MLC, 2006
4 As of 22 April 2021, MLC, 2006 had been ratified by 97 States, representing over 91%
of global shipping tonnage. The 2014 amendments to MLC require that an expeditious and
effective financial security system be put in place to ensure that shipowners provide
compensation to seafarers and their families in the event of abandonment, death or long-term
disability due to an occupational injury, illness or hazard.
5 The 2014 amendments entered into force on 18 January 2017. States which ratified
MLC, 2006 after the International Labour Conference adopted the 2014 amendments, but
before those amendments entered into force, have been requested to submit to ILO their
declaration of acceptance of the amendments. The list of States which have ratified MLC, 2006
and the list of States which have accepted the 2014 amendments to the Code of MLC, 2006
(as well as States for which ILO is awaiting declaration of acceptance of the amendments) are
available at www.ilo.org/mlc
Incidents of abandonment of seafarers
6 All incidents recorded on the IMO/ILO joint database are presented in the annex to
this document. The first section of the annex, with a header in green, shows resolved cases
that were reported in 2020 and during the first quarter of 2021. The next section, marked with
a yellow header, shows disputed cases that were reported in the same period. The section
next with a header in red, displays unresolved cases reported in 2020 and the first quarter
of 2021. The sections that follow display all disputed, inactive (orange header), resolved and
unresolved cases originating before 1 January 2020.
7 On 1 April 2021, there were 509 abandonment incidents listed in the database since
it was established in 2004, concerning 6,933 seafarers. Of those incidents, 244 cases were
resolved, 121 cases were disputed, and 50 cases were inactive. There were still 94 unresolved
cases. From 2011 to 2016, the number of cases per year ranged from 12 to 19. In 2017, 2018
and 2019, the cases reported increased drastically. In 2017, there were 55 cases reported, 14
of which were resolved that year and 8 were resolved in 2018. In 2018, the total number of
reported cases was 44 and of these, 16 cases had been resolved. In 2019, the total number
of reported cases was 40 and of these, 6 cases had so far been resolved.
8 From 1 January 2020 to 1 April 2021 a total number of 111 new cases have been
reported, 85 cases in 2020 and 26 cases in the first quarter of 2021. As of today, of this spike
of 111 new cases, only 43 have been resolved. Approximately 18 of the cases that were
reported since 1 January 2020 were related to consequences of the COVID-19 pandemic,
further exacerbating the crew change situation of seafarers.
9 Of the cases reported in 2020 and the first quarter of 2021, three involved flag States
which had not ratified MLC, 2006. States which have not yet ratified MLC, 2006 are strongly
encouraged to do so as soon as possible.
10 Following the entry into force on 18 January 2017 of the 2014 amendments to
MLC, 2006 concerning financial security in cases of abandonment, 248 abandonment cases
have been reported to the joint IMO/ILO database.1 Within the period between 18 January 2017
and 1 April 2021, there were 20 reported cases of abandonment where the flag State was a party
to MLC, 2006 but had not yet sent to ILO their declaration of acceptance of the 2014
amendments Of these 20 cases, almost half (9) are still disputed or unresolved.2

11 The Committee, at its 105th session, requested the IMO Secretariat to consult with
ILO to include information related to insurance, or lack thereof, in the database for each new
case (LEG 105/14, paragraph 4.20). Accordingly, this information has been added to the
database, as well as to the summary information annexed to this document. The last column
of the table in the annex contains a specific reference in those instances where claims have
been addressed to specific abandonment insurers for the cases reported after the entry into
force on 18 January 2017 of the 2014 amendments to MLC, 2006.
Examples of involvement of the IMO and ILO Secretariats:
12 The cases described below are taken from the database. They represent a sampling
of cases that necessitated the substantial involvement of the IMO and ILO Secretariats in order
to be resolved. The case descriptions reflect the information as recorded in the database
on 22 April 2021. Other data may be found in the database itself as well as in the annex to this
document. The Secretariat will provide any updates during LEG 108.
MV Ula, IMO Number 8102414

(unresolved)
13 In July 2019, the abandonment of the crew of 20 seafarers from India (17),
Bangladesh (1), Georgia (1) and Turkey (1) of the MV Ula, IMO Number 8102414, registered
in Palau, which initially started in Asaluyeh, Iran (Islamic Republic of), was reported by ITF
to the joint IMO/ILO database. Soon thereafter, the ship was moved to the port of Shuaiba,
Kuwait. The ship is owned by Aswan Trading Company of Qatar. The company has
consistently claimed that it had no money to pay for the repatriation of seafarers, wages for the
crew, or for a replacement crew. Several arrest warrants have been issued against the
chairman of the company, and at least two other abandonment cases involve ships owned by
the company.
14 Palau deregistered the vessel in March 2020 but did not strike it from their register.
In April 2020, IMO became aware that four crew members, including the chief officer, had been
locked in their cabins and only allowed out for one hour per day, and received substandard
rations. Through the summer and autumn of 2020, IMO met weekly with representatives from
Kuwait, Palau and Qatar, Turkey and Panama, to attempt to resolve the case. The case was
greatly complicated by COVID-19 travel restrictions, a dispute regarding the shipʹs cargo,
which prevented the ship from being seized by Kuwait and sold at auction, which would have
allowed for payment of wages and repatriation of the crew, and the inability of Qatar to force
any action by the owner, due to his fugitive status.
15 In September 2020, at the request of Kuwait, the vessel was declared stateless in
order to assist Kuwait with potential judicial action. The decision for Palau to deregister the
vessel and declare it stateless was made after detailed consideration by all countries and
United Nations agencies concerned. It was seen as a way of helping to facilitate the issues
regarding the status of the vessel and the cargo. In this case, declaring the vessel stateless
allowed Kuwait to exercise its full jurisdiction on the vessel. The crew that was imprisoned and
others were allowed to leave the ship and return home in October 2020. ITF provided legal
assistance to those crew members to file liens so that they could recover their wages.
However, some crew members, including the master, refused to depart, stating they would not
leave until their wages were paid. Attempts to find a buyer for the ship have also been
unsuccessful.
16 By the end of March 2021, the Marine Transport Department of Kuwait informed IMO
that the cargo had been judicially seized and discharging began. Potential judicial forfeiture of
the ship is also being considered which, if appropriate liens are filed, will allow the crew's wages
to be paid.

PTOLEMEOS (IMO Number 9104081) and ARYBBAS (IMO Number 9119983)

18 In November 2019, the Ministry of Maritime Affairs and Insular Policy of Greece
reported that the PTOLEMEOS (IMO number 9104081) and ARYBBAS
(IMO number 9119983), both registered in Liberia, had been abandoned
since 15 September 2019 in Djibouti anchorage.
19 As of 7 November 2019, 12 seafarers were repatriated from Djibouti by the West of

England P & I Club, while some remaining seafarers were repatriated on or
about 24 November 2019. However, on 27 January 2020, the Permanent Mission of Greece
to the Office of the United Nations in Geneva informed ILO that several Greek seafarers had
been retained on board.
20 On 5 February 2020, ILO addressed an urgent intervention to the Government of

Djibouti. On 20 February 2020 the Djibouti government informed ILO that they had launched
a mission of enquiry which confirmed that the two ships had been arrested by way of the
issuance of 23 confiscation/arrest orders. Flag registry was withdrawn. Shortly thereafter, the
Greek government reported that two Greek crew members had been repatriated.
21 On 28 July 2020, the Government of Liberia also requested assistance, humanitarian

consideration and immediate repatriation of several seafarers on board both vessels.
22 On 30 July 2020, the International Group of Protection and Indemnity Associations

(P & I Clubs) advised that there were 9 Filipino crew members on board the ARYBBAS and 10
crew members on the PTOLEMEOS. The manning agency were paying the remaining crew
on board. The P & I Club overall disbursements on these abandonments to that time were:
ARYBBAS $957,662.00; and PTOLEMEOS $1,725.929.75. This included payment of four
months wages for the 24 original crew members, and ongoing cost of food, catering, bunkers,
medical expenses, etc. The Club made two applications to arrest the vessels and lodged an
appeal. These were disallowed by the Djibouti Courts. Seven other parties with claims on the
vessel also had their applications to arrest the ship disallowed.
23 On 22 August 2020, the IMO Seafarer Crisis Action Team intervened to ensure that
a very ill crew member from on board the PTOLEMEOS was safely disembarked, then
transferred to the airport where the crew member boarded the aircraft safely and was then
repatriated.
24 On 2 October 2020, upon the request of ITF and ICS, ILO and IMO sent a joint letter
of urgent intervention to the Minister of Labour and the Minister of Transport of Djibouti. Nine
crew members (Philippines) had already been on board the vessel ARYBBAS for a year, and
one crew member (Romania) had been on board the PTOLEMEOS for more than 14 months.
In addition, eight crew members (Sri Lanka) who were dispatched to replace the crew of the
PTOLEMEOS, had also been on board for more than 10 months. At least two of the crew
members on board the aforementioned ships were experiencing health problems.
25 As a follow-up to the Joint ILO/IMO letter of intervention, ILO convened, during the
month of October 2020, a total of six operational meetings concerning the long-standing
abandonment situation of the seafarers on board the vessels. These meetings benefitted from
a growing presence of partly high-level representatives from the States of seafarer origin
(Philippines, Romania and Sri Lanka), the flag State Liberia, all crewing agencies involved plus
IMO, ITF and ICS.

26 On 23 November 2020, ILO and IMO were informed by the West of England
P & I Club that the Chief Officer, and the only remaining member of the abandoned crew to be
detained on board the PTOLEMEOS eventually arrived home in Romania. It appeared that the
abandonment cases concerning the PTOLEMEOS and ARYBBAS were resolved only by
virtue of the sale of both ships to a new owner.
KENAN METE, IMO Number 870193

27 On 27 October 2020, ITF reported to the IMO/ILO joint database on abandonment of

seafarers that from August 2019 onwards the KENAN METE, IMO number 8701935,
flag: Panama, was abandoned in Adabiya, Egypt having on board 25 seafarers from India (11),
Turkey (6), Ukraine (5), Georgia (1), Syria (1), and Russian Federation (1) who suffered as a
result of a lack of provisions and had not been paid for many months (some since June 2019)
while they were insured by Hanseatic Underwriters.
28 Panama, as the flag State, set the minimum safe manning requirement at zero
seafarers during the months of December 2020 and January 2021. However, owing to a local
court order, the master of the KENAN METE, was required to stay on board the ship as a
guardian, in order to safeguard the financial claims of the port for unpaid harbour dues.
29 Eventually, on 11 February 2021, the master was allowed to leave the ship for a hotel
but under severe restrictions. The planned auction of the ship that was scheduled
for 28 April 2021 was postponed for the second time, and the ship has not been sold.
AMAN, IMO Number 9215517: Mr. Mohammed Aisha

30 In February 2021, ITF reported that after almost four years on board, Mr. Mohammed
Aisha from the Syrian Arab Republic was the only person on board the AMAN, IMO
number 9215517, flag: Bahrain, and was left alone with no light, food, water or electricity.
The seafarer had to swim in order to reach the shore and buy his basic necessities, while he
was appointed as legal guardian of the ship by the local court, but the ship had not been sold
for almost four years, during which time he was obliged to stay on board.
31 The AMAN was abandoned in Adabiya Suez Anchorage, Egypt

on 17 November 2017. The owner is also the owner of the Jerna S, Avonmoor and Sanad
which are all cases reported on the Joint IMO/ILO Database on Abandonment of Seafarers.
The owner had not paid any wages to the crew of the AMAN since they were abandoned.
The vessel was arrested by the crew to secure the money owned to them, but the Indian
seafarers had gone home after their families paid for air tickets, as did the master and the
second engineer.
32 Eventually, on 22 April 2021, after almost four years, Mr. Aishaʹs ordeal came to an
end. This may seem an extraordinary case, but it shows the severe circumstances in which
many abandoned seafarers still find themselves today and that it is necessary to continue
providing assistance and giving the abandoned seafarers a helping hand.
