Office, Haryana are hereby promoted as officiating Clerks in the Pay Band -I of Rs. 5200-
20200+ 1900/-Grade pay plus RsAO/- as Special Pay and such allowances as may be admissible from
time to time subject to the approval of Haryana Staff Selection Commission, Panchkula with
immediate effect. They will be on probation for a period of one year.
2. Their promotion are subject to the following conditions:-
(i) The services of these Clerks will be governed under the Haryana Financial
Commissioner's Office (Group-C) Service Rules, 1998 as amended from time to time.
(ii) They shall have to qualify the State Eligibility Test in Computer Appreciation and
Application (SETC) within probation period of one year extendable by one year,
failing which they will be reverted back. They shall not be entitled to earn any
increment in their pay scale till they qualifies the said test.
3~ It is certified that the above officials would have continued to officiate on the lower
post but for their promotions to the higher post.
4. It is also certified that the post of Clerk carnes higher nature of duties and
responsibilities than the post of Peon.
5. They can exercise the option for pay fixation within three months from the issue of the
promotion orders as per the Finance Department instructions No. 4/3/2003-1 PR(FD), dated
17-1-2011.
6. Their posting orders will be issued separately.

Subject: Relieving of Sh. SushH Kumar, Clerk from the Office of

Financial Commissioner Revenue, Chandigarh to the office of
Deputy Commissioner, Sonipat - regarding.
Whereas initially Sh.Sushil Kumar, Clerk, was appointed as a Clerk in the

office of Financial Commissioner revenue, vide this department Memo No. 669-
Admn.I(5)-2012/709, dated 29-2-2012.
Whereas Sh.Sushil Kumar, Clerk further requested vide his application

dated 15-7-2014 for transfer of his cadre as Clerk in the office of Deputy
Commissioner, Sonipat.
Whereas the Deputy Commissioner, Sonipat was asked to send t~his

consent in this regard vide this department Momo No. 2228-Admn.I(5)-
2014/2267, dated 5-8-2014.
Whereas the Deputy Commissioner, Sonipat has communicated his

consent to appoint him as a Clerk in his office by transfer basis in his category
vide his office Memo No. 1460/EB, dated 12.08.2014 against a vacancy.
Whereas the Appointing Authority i.e Secretary Revenue has no

objection for his appointment by transfer from this office to the office of
Deputy Commissioner, Sonipat.
And Whereas Sh.Sushil Kumar, Clerk has furnished an Affidavit that he

forego his seniority as Clerk in FCR Office and he would not claim the benefit
of seniority on his appointment as clerk in this office as well as the office of
Deputy Commissioner, Sonipat and he would not claim any TA/DA on his fresh
appointment by transfer from office of Financial Commissioner Revenue to
office of Deputy Commissioner, Sonipat.
Now, therefore, in view of the above, the services of Sh. Sushil Kumar
are hereby relieved from the office of Financial Commissioner Revenue to join
in the office of Deputy Commissioner, Sonipat as fresh appointee as Clerk
subject to the following terms 8: conditions:-
(I) That on his appointment by transfer as a Clerk in the office of Deputy

, Commissioner Sonipat, his seniority in the establishment of Deputy
Commissioner, Sonipat will be fixed at the tail end of the cadre of
the Clerks;
(II) That he will not entitled for any TA/DA on account of this
appointment by transfer basis at the new place of posting.
(III) That no enquiry should be pending against the said official under
rule 7 or 8.
(v) That his pay, drawn by him in the place of appointment, would be
protected as per the rules. It is clarified that no employee senior to
him in the office of Deputy Commissioner Sonipat would be entitled
to claim the benefit of stepping-up of his pay in the event of his pay
being higher to any clerk at the place of his new appointment.
His up-to-date Service Book, along with the latest pay certificate will
be sent to the Deputy Commissioner, Sonipat lateron.

2. The Land Acquisition proceedings are undertaken by various
departments of the Government. It has been observed that a large number of Writ
Petitions are filed in the Hon'ble Punjab & Haryana H;Jh Court laying challenge to the
acquisition proceedings. EvJVl further S.L.Ps are preferred before the Hon'ble

Supreme Court, wherein the 'Financial Commisslcner, Revenue & Dlsaster
Management Department, is invariably impleaded as one of the respondents. It is
also an accepted position that replies to such Writ Petitions/S.L.Ps are to be filed by
the concerned land Acquiring Departments in the Courts. The Revenue Department
has lime role in these matters, unless the chailenge is to the State's Policy, V,ilich
have been notified by the Revenue and Disaster Management Department.
3. They are, therefore, requested to ensure that the replies in such Writ
Petitions are also filed on behalf of the Revenue and Disaster Management
Department. This issues with the approval of the Additional Chief Se8retary and
Financial Commissioner to Government Haryana, Revenue aiTel Disaster
