Rationale

The Constitution and By-laws of an organization is an important document that


governs its purpose and future actions. It contains fundamental operating principles,
established specific rules and detailed procedures that the officers and members of any
organization have to follow. Moreover, this document can be a subject for revisions or
amendments, provided that the officers proposed for a Constitutional amendment to
address new situations and demands brought by the fast-changing time, and to
increase the benefits for the constituents.

Currently, MinSCAT Federation of Student Councils still uses a 2005-approved


Constitution during the MFSC chairmanship of Mr. Adrian Alagao, which was under the
regime of the late College President Dr. Angelito A. Bacudo. Basically, it has been
sixteen (16) years since the time it was last amended; hence, certain
revisions/amendments must take place to correct provisions that seem to be inadequate
or unworkable, to respond to the new needs or changing public demands and to reflect
evolving concepts of rights since MinSCAT is now a University.

For that reason, the Federation is proposing for an In-House MFSC


Constitutional Amendment on June 18-19, 2021 at Mindoro State University –
Bongabong Audio-Visual Room. The participants shall be composed of eleven (11)
officers of MFSC standing as the voting body, and the four (4) local council officers
standing as the witnesses. The other constituents of the Federation will be encouraged
to join and participate via Google Meet as a precautionary measure to minimize the risk
of gathering in light of the COVID-19 pandemic.

Despite the COVID-19 threat, the Federation still wants to pursue the face-to-
face setup to achieve an efficient two-way communication process. In a virtual
environment, several factors might be encountered including the poor internet
connectivity, large consumption of data megabytes and power outages, which might
impede the amendment process. Furthermore, deliberations are done easier in person,
so are the suggestions and additional commentaries on the amendment process.

Objectives

Generally, the said activity aims to amend the 2005-approved Constitution and
By-laws of the MinSCAT Federation of Student Councils.

Specifically, it aims to:

a. discuss all the sections and articles that comprised the MFSC Constitution
and By-Laws systematically;
b. determine particular clauses that are obsolete to the current demands and
situations;
c. provide corrections to the provisions that are inadequate and unworkable;
d. provide more sections to protect the rights and welfare of the students;
e. unify the structure of the officers among the three campuses; and
f. modify the name MinSCAT Federation of Student Council and its logo.

Methodology

1. The school service of MinSU Bongabong Campus will fetch the participants
from MinSU Main Campus in Alcate, Victoria and from MinSU Calapan City
Campus in Masipit, Calapan City from 8:00AM onward. Expected arrival time
will be around 11:00AM.
2. Fifteen participants are expected to arrive with their parent’s consent,
student’s waiver and barangay health certificate to be presented upon
entering the campus.
3. 11:00AM to 1:00PM serves as the breaktime at the CSC Office of Bongabong
Campus.
4. The session will start sharply at 1:00PM onwards. All participants are
expected to proceed to Audio-Visual Room. At this phase. deliberations and
possible debates with regards to the MFSC Constitution and By-Laws are
expected.
5. During the amendment, other local council officers are encouraged to give
suggestions or commentaries via Google Meet.
6. After the amendment session, ratification will follow. The voting body will be
the eleven (11) MFSC officers while the four (4) local council officers will
serve as the witnesses.

Expected Outputs

The realization of the activity would result to the following:

1. Amended MFSC Constitution and By-Laws.


2. Updated articles and sections of Constitution and By-Laws.
3. Unified structure of officers for the local council of each campus.
4. Modified name and emblem of the Federation organization.

Constitution and By-Laws Amendment

GUIDELINES

1. In-House MFSC CBL Amendment will be conducted on June 18-19, 2021 at


Mindoro State University – Bongabong Campus, Audio-Visual Room.

2. The expected number of participants is fifteen (15): five (5) from each campus.

3. Parent’s consent, student’s waiver and barangay health certificate shall be


presented upon entering the campus.

4. As stated on ARTICLE XVI AMENDMENTS, SECTION 2: “The MFSC may, by


the vote of two-third (2/3) of the officers shall call a convention to decide on the
proposed amendments.” In that case, the eleven (11) MFSC officers shall
function as the voting body, while the four (4) local council officers shall serve as
the witnesses as agreed upon by the body.

5. Other constituents are encouraged to join the amendment virtually via Google
Meet and give suggestions or commentaries.

6. In case an MFSC officer cannot attend the said in-house amendment, he/she
shall join via Google Meet and participate on the voting procedures. However, it
must be noted that his right to vote is only unique to him.

7. Phones are not allowed during the amendment unless needed in case of
emergency.

8. As stated on Article XVI AMENDMENTS, SECTION 3: “Any proposed


amendments or revision of the constitution shall be submitted to the student
body for ratification not less than three weeks after the submission and approval
of such amendment or revision.” The proposed amendment shall be presented to
the studentry and shall be decided by plebiscite via Google Form.

9. As stated on Article XVI AMENDMENTS, SECTION 4: “Approved amendments


shall be forwarded to the school administration for final approval.”

10. As stated on Article XVIII EFFECTIVITY: “This Constitution and By-Laws shall
take effect after it has been submitted to the College President for final approval
in the Board Meeting.”
