DEED OF EXTRAJUDICIAL SETTLEMENT 

KNOW ALL MEN BY THESE PRESENTS:

That the Spouses Antonio B. Cruz. and Mary Palermo-Cruz, both Filipino
citizens and residents of Dinoronan, Municipality of Daraga, Province of Albay, were the
conjugal owners of a parcel of land with improvements, registered as follows:

TRANSFER CERTIFICATE OF TITLE No. T-150298

“A parcel of land (Lot 9552-C of the subdivision survey, Psd-05-026179,

being a potion of Lot 9552-A Cad 56, Albay Cadastre), situated in the Barangay of
Dinoronan, Municipality of Daraga, Province of Albay, Island of Luzon.
Boundedon the NW., along lines 1-2-3 by Road (5.00 meter wide); on the NE.,
along lines 3-4 by Lot 12548 Cad 56 Albay Cadastre; on the SE., along lines 4-5-6
by Lot 9553 Cad 56, Albay Cadastre, along line 6-7 by Lot 12548 Cad-56, Albay
Cadastre; on the SW., along line 7-8 by Lot 12549 Cad 56, Albay Cadastre; on the
NW., along lines 8-9-1; by ?Lot 9552-B Psd-05-026179..xxx.. Containing an area of
NINE THOUSAND (9,000 sq.,m.) SQUARE METERS.

That Antonio B. Cruz died intestate on 27 April 2021, without any known debts;

That the deceased is survived by her spouse Mary Palermo-Cruz, of legal age,
Filipino citizen, and a resident of Dinororan, Daraga, Albay and two (2) legitimate sons :
Anthony P. Cruz and Apollo P. Cruz and two (2) legitimate daughters: Antonia C. Juan
– married to Jose V. Juan and April P. Cruz, all of legal age, Filipino citizens, single,
and residents of Dinororan, Daraga, Albay, save Antonia C. Juan who is not residing at
P4 Bigaa, Legazpi, Albay;

WHEREAS, the parties herein have agreed, as they do hereby agree, to divide
and settle the aforementioned estate between them in the following manner, to wit: 1/5
to Anthony P Cruz; 1/5 to Antonia C Juan; 1/5 to April P Cruz; 1/5 to Apollo P Cruz; 1/5
to Mary Palermo-Cruz;

WHEREAS, Mary Palermo-Cruz do hereby waive and adjudicate her share as

heir equivalent to 1/6 in the above-described property and estate of her late husband,
Antonio B Cruz, and that her own share in the said property as part owner of the
conjugal partnership, in favor of her four (4) children as above-mentioned, so that full
ownership over her said share and participation in the aforementioned property may
now be consolidated in the name of her said four (4) children who will now be the sole
and absolute co-owners of the whole property covered by Transfer Certificate of Title
No. T-150298 of the Registry of Deeds of Albay.
 WHEREAS, the foregoing heirs, having full capacity to contract, hereby
adjudicate unto themselves in equal shares in the real property described above.

IN WITNESS WHEREOF, the parties have hereunto set their hands this 10th day
of June 2021 at Legazpi City, Philippines.
