ABOUT INSTITUTE OF LAW, NIRMA UNIVERSITY

Institute of Law was set up under the aegis of Nirma University in the year 2007 with a
vision to promote excellence in the field of legal education and to fulfil the ever increasing
demand of quality legal professionals for a growing legal world. In a short span of time
Institute of Law, Nirma University (ILNU) marked its distinct place in the legal education
map of the country. At present ILNU offers B.A., LL.B. (Hons.), B.Com., LL.B. (Hons.) –
five year integrated programmes, one year LL.M. programme in different areas and Doctoral
Programme leading to Ph.D.

Institute of Law follows an approach to legal education wherein learning experience is not
only enlightening but also enriching and inspiring. Institute is committed to exploring
multidisciplinary approaches through its unique curriculum and revolutionizing legal
education through modern pedagogies thereby adapting to the changing world in which law
professionals operate. ILNU focused on developing knowledge, skill and value amongst the
students and they are nourished by the critical learning pedagogy and mentored and
supported by faculty and staff so that they have the best experience possible to be successful
in life.
The Institute today boasts of faculty whose expertise spans across various areas of law and
who have a wide range of teaching and research experience. We attract students from diverse
cultural background and perspectives. This leads to a vibrant multicultural classroom wherein
established theory and new critical questions are put into a dialogue.

Institute of Law has an unmatched array of courses and academic offerings. Students have an
opportunity to pursue a broad curriculum using rich educational resources in a dynamic and
creative learning environment. Curriculum is constantly adapted according to changing legal
and other environmental developments. All our initiatives are a living proof of our
commitment to every student's success in his career.

The Institute shares the Nirma University campus with five other institutions - Institute of
Technology, Institute of Management, Institute of Science, Institute of Pharmacy and
Institute of Architecture. All these Institutes have a distinguished record of achievements.
Students joining the Institute of Law will, therefore have, an opportunity to interact with a
multidisciplinary academic community of the entire Nirma University. The academic
environment generated by the interaction between professionals of various disciplines will
have a stimulating influence, especially in the formative years of young students and help
them to develop an integrated personality and a greater competitive spirit.

ILNU is looking at bringing about a paradigm shift in delivery of legal education in the
country. It aims to add new dimensions in legal education that would incorporate
international standards thereby providing an environment which would enhance freedom and
innovation in the dynamic pursuit of thoughts and civil society engagement to advance the
law of the land. We also look forward to enhancing research inputs in the education module
thereby connecting students and faculty to the larger platform involving other national and
international agencies and playing a pivotal role in framing socially relevant policies in the
legal sector.
ABOUT THE LEGAL AID CELL OF INSTITUTE OF LAW NIRMA UNIVERSITY
The Legal Aid Clinic, ILNU was set up to execute the policy and directions of the National
Legal Services Authority. It aims to provide free legal aid to the poor, the needy and other
members of the weaker sections of the society. It also aims to sensitize the public and create
awareness about their legal rights and duties by carrying out social welfare activities. The
Legal Aid Clinic, ILNU also recognizes that there is a dire need to direct these awareness
activities more specifically towards the illiterate as well as those who are living in remote,
rural and backward areas of the state. Article 39 A of the Constitution states that the State is
responsible for the operation of the legal system. The State should promote justice equally to
all citizens. It should also provide free legal aid by suitable legislation or schemes. This
should be done to ensure that opportunities for seeking justice are not denied to any citizen
because of economic or physical disadvantage. Article 14 and 22 (1) also make it obligatory
for the State to ensure equality before the law and also ensure that a legal system which
promotes justice on the basis of equal opportunity to all is in place. The Legal Aid Clinic,
ILNU strives to ensure that our constitutional pledge is fulfilled in its letter and true spirit;
and equal justice is made available to the poor, the downtrodden and the weaker sections of
the society.

Inauguration
The Institute of Law, Nirma University had inaugurated Permanent Legal Aid Clinic at the
institute on 9 March, 2009 by Justice Sri J.N. Bhatt, pioneer in providing free legal aid and
setting up of legal aid clinic. He expressed great happiness and encouraged the institute to
achieve the objects of Magna Carta i.e. “no one will we sell, to no one we will deny and
delay the rights of justice”.

Purpose
Education is the foundation of knowledge and knowledge is the light which shuns the
darkness of ignorance. Imparting general education of law is necessary for the good
governance of the country and for the purpose of educating the ordinary citizens of the
country. It is necessary to emphasize that the purpose and scope of Legal Education is a must
to prepare students as professionals of law. The mission of the Institute of Law, Nirma
University focuses upon producing not only the good professionals but also good and worthy
citizens of the great country aiding in its overall progress of development. On these lines,
Institute of Law, Nirma University has set up Legal Clinic.
LEGAL CAMP REPORTS
2017-18
LEGAL AWARENESS CAMP AT LILAPUR VILLAGE, 2nd
SEPTEMBER 2017

Legal Aid Committee, Institute of Law, Nirma University organized a Legal Aid Camp at
Lilapur Village on 2nd Sepetmber 2017. In this, awareness was created among the primary
school students regarding the Swacch Bharat Abhiyan. Around 30 students with two faculty
members visited this place. The awareness camp took place at a primary school in Lilapur
village where students of primary school were asked to assemble at one place. After that
members of legal aid committee informed them about Do’s and Don’ts to keep their
surrounding clean and healthy. They also discussed regarding the issue of sanitation, which is
generally faced by the village people.

A skit was presented by the committee members to make students of primary school
understand the importance of cleanliness and sanitation. Village students showed a keen
interest in learning about Swacch Bahrat Abhiyan and also asked several questions regarding
the same. Our team members were able enough to solve all their queries and to motivate them
to keep their surrounding clean and healthy.

The main focus was to make them learn to use dustbin more often instead of throwing
garbage on roads and other premises and to use big dustbins provided by the municipality to
dump the garbage. Also they were told to spread the same among their families as well. This
awareness program lasted almost for 2 hours. At last the committee extended its gratitude to
school authorities for the all the arrangement done by them. Then after this went to
Environmental Sanitation Institute for organizing other camp related to the issue of Domestic
Violence on women.
LEGAL AWARENESS CAMP AT ENVIRONMENTAL SANITATION
INSTITUTE, 2nd SEPTEMBER 2017

Legal Aid Institute of Law, Nirma University conducted an awareness camp at


Environmental Sanitation Institute, Ahmadabad (Safai Vidyalay) which is an NGO that has
been working since 1985 in the areas of training, construction, and supervision of
environmental sanitation campaigns across India with a passion to change the current poor
national and global sanitation situation stems from the Gandhian philosophy of eradication of
untouchability. The NGO conducts innovative short-term classes and programs for students,
teachers, health workers, etc. on local sanitation issues.

Legal Aid Clinic ILNU conducted a camp on the topic “Domestic Violence” for the women
sanitation workers who were taking training then. These sanitation workwomen were taking
training in the field of sanitation and cleanliness. When women work, in pursuing wages,
prestige and power or developing relationships outside the home, they undermine their
partners, resulting in violence. Therefore, it was important to increase awareness and
understanding of Family and Domestic Violence among the trainee ladies. The camp was
conducted in the following manner:

1. Street Play: The students performed a play on the topic of “Domestic Violence”.
Through this they made them aware about the current laws and their rights in that.
Following laws were communicated through the play:
 Protection of Women from Domestic Violence Act, 2005: Women were made
aware that any kind of physical, mental, emotional or economical harassment
is punishable.
 Provisions of FIR: The women were made aware that they can file an FIR
against any kind of violence that they might be facing. The concept of “Zero
FIR” was also introduced to the workers.
 Speedy Trial: They were made aware that the government as well as the
judiciary has proposed various measures such as “Right to Speedy Trial” for
any kind of grave injustice faced by the women.
 Right to maintenance: Women were made aware that in case of divorce on
ground of physical abuse or any other valid ground they have the right to get a
fair maintenance from their husbands.
2. General Discussion: After the play a general discussion took place between the
women and the students. Also the head of the institute joined the discussion and
motivated the women to raise their voice against any injustice being faced by them.
That they must be vigilant towards the various laws prevalent for their benefit. He
also thanked the Legal Aid Clinic ILNU for successfully conducting the camp and
making women aware about their rights.
LEGAL AWARENESS CAMP AT SABARMATI CENTRAL JAIL, 27th
NOVEMBER 2017
The Legal Aid Clinic, ILNU organized a legal awareness camp at Sabarmati Central Jail on
27 November 2017 to depart the information of rights of prisoners giving special reference to
right and procedure to get bail in bailable offences. Members of Legal Aid Committee
organized the awareness camp through two skit plays in the presence of Superintendent of
Jail, Jailors and faculties. The topic for the said skits were:

a. The importance of parole


b. Bail as a matter of right

The camp witnessed participation of 350 prisoners who were benefited with the information
provided through the skits. Many of them have expressed their view by stating that they have
enjoyed the act and method of giving information about their rights, duties, free legal aid and
procedure of getting bail. The camp got huge appreciation from jail authorities apart from
giving commitment to organise such programmes at regular intervals.
JAMIYATPURA LEGAL AWARENESS CAMP ON LABOUR RIGHTS,
4th February 2018

The Legal Aid Clinic ILNU conducted an awareness camp on the topic “Labour Rights” in
the village Jamiyatpura, district Kheda, Gujarat on 4th February 2018. The regional languages
spoken in the village are Hindi and Gujarati, therefore legal aid members speaking both the
languages visited the village. The legal aid camp was attended by around 100-200 villagers
including women and children. A number of activities were conducted by the members as
listed below:

1. Street Play: Students performed a street play on the topic “Labour Rights” with the
theme of knowing rights while working as a laborer in industries. Through the play
villagers were enlightened about Right to Minimum Wage; Right to work for a fixed
hours of time, Maternal Rights, Right against exploitation etc. the villagers keenly
observed the play and could also comprehend the same. Through the play villagers
were also encouraged to come up and tell the clinic about any such problem being
faced by them.
2. Discussion: A discussion on the topic and in general was also conducted by the
members wherein students interacted with them in Gujarati. They were told about the
basic provisions of various laws such as:

 The Minimum Wages Act, 1948


Through this villagers were explained about concepts such as “Fair Wages”
and “minimum number of holidays” etc.

 The Maternity Benefit Act, 1961


Women were told about the concept of “maternity leave”. They were told
about the latest amendment in the law that now the paid leave has been
expended to 26 weeks and can be availed 2 months prior to the expected
delivery and therest can be utilized post child birth. They were also made
aware about the “crèche facility” at any establishment employing more than
50 workers.

 Right Against Exploitation


Villagers were made aware that any employer cannot take work from their
children below the age of 14 and below and that even they cannot be
employed into forced labor which is hazardous to their life.
3. Open Flore: At the end of the camp the discussion was open for any question by the
villagers for any problem that they might be having. Initially the villagers were
reluctant to share their problems however after interaction with the students, they
shared their problems with them. The students motivated them to keeping voicing
their opinion and to raise their voice whenever they see any injustice see happening.
They were also assured that whenever they need any help they can contact the legal
aid Clinic ILNU for help and that the clinic shall also keep visiting the village
regularly.
LEGAL AID CAMP AT JAMIYATPURA, GANDHINAGAR, 15th
MARCH 2018

Legal Aid Clinic, Institute of Law, Nirma University organized a legal literacy camp at
Jamiyatpura Village, Gandhinagar on 15th March 2018. Mr. Sudhir Desai, Paralegal
Volunteer from Gandhinagar District Legal Service Authority delivered the speech on the
topic of “Women Empowerment and Free Legal Aid”. The objective was to deliver the
message that law is for the sufferer and the aggrieved irrespective of the gender. Thus, the
message was delivered in a way that the power or the rights inferred should not be in any way
used for personal gains discarding the soul of natural justice.

The Camp was presided over by the Prof. (Dr.) Purvi Pokhariyal, Dean and Director of
Institute of Law, Nirma University, Jane Schukoske, Advisor of S.M. Sehgal Foundation, Dr.
Tarkesh Molia, Academic Coordinator and was attended by Mr. Raj Mehta, Faculty
Coordinator, Legal Aid Clinic, Dr. A. Md. Samiulla, Faculty Coordinator, NSS Unit, Mr.
Nitesh Chaudhary, Faculty, Institute of Law, Nirma University.
LEGAL FILM MAKING COMPETITION: AN AWARENESS
INITATIVE, 1st MARCH 2018

Legal Aid Clinic, Institute of Law, Nirma University organized National Socio-Legal Film
Making Competition: Chal-Chitra 2018. The idea was to boost awareness and drive activism
with the end goal of advancing social change by a platform to students could showcase
various socio-legal issues through the most effective mode of communication i.e. motion
pictures. The aim of the competition was to subsume various prevalent socio-legal issues
with the objective to create the perennial effect by visual reflection. The competition was
organized in order to spread awareness about legal issues and the problems faced by people.
Social Media helps in connecting with people on a larger. This initiative will help the
students as well as others to learn about socio-legal issues and their solutions. Many colleges
and institutions participated by submitting various narrative and documentary films on global
issues and thus, creating empathy for the oppressed.

LEGAL AID CLINIC-REPORTS
2017-18
CLOTHING DRIVE: HAPPINESS CAMPAIGN, 3rd to 6th OCTOBER
2017

From 3rd to 6th October 2017, Legal Aid Clinic of Institute of Law, Nirma University
organized Clothing Drive in collaboration with Mission Sangharsh. This drive was initiated
with intent to help poor people who do not have access to Clothes. Charity and joy of giving
were the main driving forces of this event, which motivated students to help the poor people
by donating their clothes. In this, three boxes were kept at the gate of Institute of Law from
3rd to 6th October and everyone was asked to donate the clothes according to their will and
capacity.

Students from Legal aid committee went to each and every class to spread information
regarding this event and the same was also informed through emails. And it was surprising to
see such an active participation. Many students contributed to this drive and donated all types
of clothes and blankets also. After collecting the clothes, these were distributed in different
areas of Ahmedabad. T

he main focus was on the people who live on footpaths and slum area. We covered slum
areas on S.G Highway Ahmedabad and many other areas and distributed clothes amongst
them. This drive was launched in a systematic manner as to avoid hustle, all the people were
made stand in a line and clothes were distributed according to their need and size of the
families.
So, this event was a great success and a good example of charity begins at home as many
students on their own donated different types of clothes and all the volunteers worked
selflessly to reach out to the needy ones and distribute clothes among the needy people.

LEGAL TRAINING AT THE DISTRICT AND SESSIONS COURT OF


AHMEDABAD AND GANDHINAGAR, 20th to 25th NOVEMBER, 2017

The Centre for Transparency and Accountability in Governance, National Law University,
Delhi undertook a project titled, "An Empirical Study to Examine the Impact of Legal Aid
Services Provided by the Legal Aid Counsels on the Quality of Legal Aid System in India",
sponsored by ICSSR, for the years 2017-2019. This project is a study in 10 States across
India.

In Gujarat, the Centre planned to visit the District and Sessions Court of Ahmedabad and
Gandhinagar. Since the project was an empirical study, therefore the major task is to collect
the primary data by undertaking a field study by adopting various kinds of methodologies.
The students with the help of Legal Aid Clinic, Nirma University, had the opportunity to
interact with various stakeholders of Free Legal Aid Services (FLAS) at the District Level.

From Institute of Law, Nirma University five students successfully completed the prestigious
internship undertaken under the aegis of The Centre for Transparency and Accountability in
Governance, National Law University, Delhi.

During this, the student were required to travel to two districts in their respective State, visit
District courts there, and meet legal aid counsels, beneficiaries of legal aid services and the
judicial officers, and fill out a set number of questionnaires.
The internship was an enriching experience in terms of understanding the impact of free legal
aid, the quality of legal aid system and different kinds of perceptions around Justice delivery
system at the District level.

JAIL VISITS AT SABARMATI JAIL


Institute of Law, Nirma University established first of its kind, Permanent Legal Aid
Clinic inside the Sabarmati Central Jail (under-trial units), to provide free legal aid and
advice to the inmates of Sabarmati Central Jail, Institute of Law, Nirma University in
collaboration with the Gujarat State Legal Services Authority and Gujarat Prisons established
a Permanent Legal Aid Clinic, ILNU (Sabarmati Central Jail Unit) within the premises of
Sabarmati Central Jail, Ahmedabad on 30 July, 2011. This is First Legal Aid Clinic
established by any educational institution within the premises of a Jail in the State of Gujarat.
Every Tuesday students of the Committee visit Sabarmati jail to address the grievances and
provide necessary support to under- trail prisoners.

At Sabarmati jail the students address the grievances of the prisoners in various ways,
providing information about bail provisions available under Code of Criminal Procedure,
information about Juvenile Justice Act, departing information about rights available to
prisoners specifying the right and procedure to get parole and furlough, methods of availing
benefits of plea bargaining and schemes of government for the family of prisoners are few to
name amongst many. The Clinic also provides information and addresses the queries of
prisoners related to interim bail, appeal, maintenance provisions, family issues, determination
of age, benefits of probation, right to information, right to education, transfer between
prisons, etc. The team, on a regular basis, advises the under trail prisoners on matters related
to murder, rape, kidnapping, theft, robbery, dowry death, attempt to murder, cheating,
prohibition, abetment to suicide, cheating, criminal breach of trust, cruelty by husband and
his relatives, death by negligence, NDPS Act amongst others.

Legal Aid Clinic paves special concern to right of prisoners to be represented therefore the
clinic, provides quality lawyers to represent the prisoners before courts thereby providing
justice to them. Apart from this, the jail authorities are approached for giving the requisite
support in securing the rights of prisoners. The prisoners are advised to write a complaint
letter about their issues so that jail authorities could take effective steps towards remedying
them.
Legal Aid provided during August 2017 to March 2018

During August 2017 to March 2018, the Clinic Centre was visited by the team for 30 days
and attended by 400 under-trial prisoners. The team assisted 68 arrestees in getting free legal
advocates by which their cases have been started, among them 16 prisoners were released on
bail and bond. Total 348 prisoners have been given advice through the counselling sessions.

Achievements of Legal Aid Clinic during August 2017 to March 2018

1. Twenty three prisoners benefited by retrospective effect of JJ Act

ILNU Legal Aid Committee had informed several under trail prisoners about retrospective
effect applicability of the Juvenile Justice (Care and Protection of Children) Act, 2015 in
certain cases as held by Hon’ble Supreme Court in cases of Dayanand v.State of Haryana,
(2009) and Hariram v. State of Rajasthan, (2011). The aftereffect of the advice was that, 23
probably entitled prisoners had claimed their right to be released had claimed their right to be
released due to the applicability of Juvenile Justice Act, 2015.

2. Five under trials benefited by claiming de facto bail

The institute had provided information about Section 436A of The Code of Criminal
Procedure, 1973, inserted by 2006 Amendment. In accordance with the information provided,
the prisoners who were entitled to get benefit of 436A of Cr.P.C had claimed their rights by
filing their petition for de facto bail in appropriate courts.

As the Legal Aid Cell of ILNU believes in welfare of the society as well as the budding

lawyers, a team of 5 members belonging to the Legal Aid Cell of Institute of Law, Nirma
University visits Sabarmati Central Jail, Ahmedabad every Tuesday. The major work
undertaken by the team is to counsel the under trial prison inmates in pursuance of the same
they provide legal aid services to them. The team used to collect data of under trial prison
inmates and try to help them in plethora of ways that will be covered under the solutions part.

SOLUTIONS PROVIDED BY THE LEGAL AID CELL ILNU

Following are the type of solutions provided by the Legal Aid Cell, ILNU.

1. Referring the under trial prison inmates to Gujarat District Legal Services Authority.
2. Providing Legal assistance to the lawyers of Prison inmates.
3. Collecting data of under-trial prison inmates.
4. Counseling the under trial prison inmates pertaining to any query w.r.t. their case etc.
5. Referring the cases of under trial prison inmates to the Permanent Legal Aid Cell
house in the Sabarmati Jail.
6. Helping the under trail prison inmates to avail the services of a lawyer with the help
of DLSA, Ahmadabad.

1. Conducting Legal Awareness camps in the premises of Sabarmati Jail both in Gujarati
as well as Hindi language.

CONCLUSION

1. Maximum no. of under trial prisoners belong to those who might have committed any
crime under the Indian Penal Code, 1860 and stood at 45.21%, followed by POCSO
Act (22.34%), which in turn is followed by NDPS Act, Gujarat Prohibition Act, and
Bombay Prohibition Act, accounting for 7.97% of cases.
2. On an average the team of 5 members of Legal Aid Cell, ILNU counsels around 9
under trial prisoners / visit.
3. On an average the team of 5 members of Legal Aid Cell, ILNU refers around 2 cases
to DLSA / visit.
4. It is evident from point 2nd & point 3rd that out of 9 cases (Average figure) taken up
by the Legal Aid Cell, ILNU only 2 cases (Average) are referred to the DLSA to take
