It has been a landmark case, displaying yet another side to the never dilemma of
mercy killing.

This is a story of 60 year old nurse, Ms.Aruna Shanbaug, who is in a persistent


vegetative state past 37yrs in Mumbai’s king Edward memorial hospital. She was
sodomised by hospital sweeper Sohanlal Walimiki who is the monster behind her
plight.

The supreme court said aruna shanbaug should live THOUGH conditional Passive
euthanasia is permissible under certain conditions with the approval of the high
court."
It further said the high court will grant its approval after getting the opinion of three
eminent doctors and hearing the government and the close relatives of the terminally
ill patient.

The plea over euthanasia was moved by journalist and social activist, pinky virani
who has written a book on aruna. However, the supreme court has refused to grant
approval on the grounds that pinky virani the petitioner has no locas stranda in the
case.

Its declared that the staff, doctors and nurses of Mumbai's KEM Hospital, where
Shanbaug is admitted have a greater right over her and only they can decide
whether to opt for passive euthanasia or not.

In its judgement the court says,

It has no indication of aruna shanbaugs views or wishes but it is clear from the
medical reports that she is certainly not brain dead. She expresses her likes or
dislikes with sounds and movements.

Thus, the Supreme Court has rejected a petition for the mercy killing of Aruna
Shanbaug.

Clearly the nurses are very very happy with this decision. They think this is the
victory of nursuing profession and of the years of commitment and care that they
have devoted to aruna that the court has recognized it and taken the decision that
ARUNA SHANBAUG must live.
