Background: On 14th September 2006, the erstwhile Ministry of Environment and Forests,
Government of India (Goi), in exercise of powers conferred to it by Environment Protection Act
(EPA) 1986 and in supersession of the Environment Impact Assessment (EIA) Notification dated 27th
January 1994, notified the EIA Notification 2006 (hereinafter referred to as the Said Notification). The
Said Notification imposes certain restrictions and prohibitions on new Projects or Activities, or on
the expansion and modernization of existing Projects or Activities, based on their potential
environmental impacts, as indicated in the Schedule to the Notification, being undertaken in any
part of India, unless Prior Environmental Clearance (EC) has been obtained from the Central
Government or by the State/Union Territory (UT) Level EIA Authority (SEIAA/UTEIAA)
respectively, duly constituted by the Central Government, in accordance with the procedures
specified in this Said Notification . The Said Notification has been amended thereafter from time to
time and was last amended through Notification# S.O. 2817(E) dated the 13th July 20211.
Further, in view of COVID-19 pandemic and the requirement to expedite Drug Manufacturing,
the Ministry of Environment, Forest and Climate Change (MoEF&CC), through its Notification#
S.O. 1223(E) dated 27th March 20202, amended the Said Notification and notified that all proposals
for Projects or Activities in respect of Active Pharmaceutical Ingredients (API), received up to 30th
September 2020, shall be appraised as Category ‘B2’ projects.
Subsequently, the MoEF&CC, through its Notification# S.O. 3636(E) dated 15th October 20203,
extended the above mentioned period by six (6) months, from 30th September 2020 to 30th March
2021.
Furthermore, in view of the outbreak of the second wave of COVID-19 pandemic, the Central
Government has received requests for further extension of the time period beyond 30th March
2021 and the Central Government deems it necessary to provide another window in view of the
continued requirement of expeditious Drug Manufacturing.
Now, therefore, in view of the above, in exercise of the powers conferred by Sub-section (1) and
Clause (v) of Sub- section (2) of Section 3 of the EPA 1986, the MoEF&CC, GoI, through its
Notification# S.O. 2859(E) dated 16th July 2021, hereby makes the following further amendments
in the Said Notification:

In the Said Notification, against Item 5(f) (relating to “Synthetic Organic Chemicals Industry”), in
Column 5, in the Schedule;
All proposals for Projects or Activities in respect of API, received up to the 30th March 2021,
shall be appraised, as Category ‘B2’ Projects, provided that any subsequent amendment or
expansion or change in product mix, after the 30th March 2021, shall be considered as per
the provisions in force at that time.
All proposals for Projects or Activities in respect of API, received from 16th July 2021 to 31st
December 2021, shall be appraised, as Category ‘B2’ Projects, provided that any subsequent
amendment or expansion or change in product mix, after the 31st December 2021, shall be
considered as per the provisions in force at that time.
