Notification
Dated the 26th December, 1961
No. G.S.R. 10 Const./Art 309/61 – In exercise of the powers conferred by the proviso to
Article 309 of the Constitution of India, the Governor of Punjab is pleased to make the following rules
regularizing the promotion of Stenographers and Steno-Typist, in the Civil services of the State to higher
posts on clerical and namely :-

1. (i) These rules may be called the Punjab Civil Services Short title extent and
(Promotion of Stenographers and Steno-Typist) Rules commencement.
1961.
(ii) They shall apply to all Stenographer and Steno Typist of all the Department of the State
excepting those of the Punjab Civil Secretariat the Punjab Legislative Council Secretariat
and the Punjab High Court.
(iii) They shall come into force at once.
2. Stenographers and Steno-Typist shall be eligible for promotion to Eligibility for
the post of Assistant, Head Assistant, Deputy Superintendent or promotion
Superintendent as the case may be in accordance will the
provisions herein after appearing.
3. (I) In Offices where the scale of pay of Stenographers is identical Promotion of

(i) qualify in the departmental test prescribed for the post of
Assistant ; and

(a) no Stenographer shall be allowed to take the test unless he has
put in one year’s services Stenographer.
(b) Noting in this sub-rule shall be deemed to require the
Stenographers, who stand exempted from passing the test by virtue
of instructions already issued by the Government from time to
time, to pass the Assistant test prescribed in this sub-rule.
(c) no Stenographer will be put to work as an Assistant for the
required period of two years, unless he has qualified in the test.
Explanation 1. The period during which a Stenographer has, before the date of issue of these rules,
performed the duties of an Assistant whether in addition to his own duties or otherwise
will be taken into consideration in computing the period of his training as Assistant.
Explanation 2. Where there is no available vacancy of the post of Assistant for imparting training to the
Stenographer he shall be given at least one third of the work of some Assistant in addition
to his own duties. The Assistant who is thus relieved of some of his work will in turn help
the Stenographer in his routine duties.
(2) The seniority of the Stenographer, who successfully complete the period of
two years training specified in sub-rule (1) vis-à-vis Assistant, shall be determine by the dated of their
continuous appointment against the post of stenographer or Assistant, as the case may be, and if the dates of
their appointment be the same, the one drawing higher pay shall be senior to the other and if the rates of pay
drawn by them also the same, the order shall be senior to the younger;

4. (1) In duties where the scale of pay of Stenographer is promotion of


lower than that of assistants, the Stenographer shall be stenographer where
eligible alongwith Clerks for promotion to the post of their scale pay is lower
Assistant, after they were qualified in the departmental test that the post of
prescribed for the post of Assistant. On their appointment Assistant.
as Assistants they shall like other Assistants, be eligible,
for promotion to higher posts on the clerical side on the
basis of their seniority in the Assistant Cadre.
(2) The inter-se-seniority of such Stenographers vis-à-vis Clerks shall be determined by
the dates of their continuous appointment against the post Stenographer or Clerk, as the
case may be and if the dates of their appointment be the same the order shall by senior to
the younger.
5. (1) The Junior Scale Stenographers and Steno-Typist shall, Promotion of Junior
alongwith Clerks, be eligible for promotion to the post Scale Stenographer
Assistant after they have qualified in the test prescribed for and Steno-typist.

they shall like other Assistants be eligible for promotion to
higher posts on the clerical side on the basis of their
seniority in the Assistant cadre.
(2) The inter-se-seniority of such Junior Scale Stenographer and Steno-Typist vis-à-vis
clerks shall be determined by the dates of their continuous appointment against the post
of Junior Scale-Stenographer or Steno-Typist or Clerk as the case may be and if the
dated of their appointment be the same, the older shall be senior to the younger.
6. (1) In offices where there is no post of Assistant the Promotion of
Stenographer shall alongwith Clerks, be eligible for Stenographers in
promotion to higher post on the clerical side. offices where there is
no post of Assistant.

Provided that if the Clerks before being eligible for promotion to high posts are required
to qualify in may departmental, the Stenographers will also be required to qualify that
test before becoming eligible for promotion.
(2) The inter-se-seniority of Stenographers vis-à-vis clerks shall be determined by the
dates of their continuous appointments as Stenographer or Clerks as the case may be and
if the dates of their appointment be the same the older shall be senior to the younger.

7. Except for the purpose of promotion to higher posts on Seniority in respective


clerical side the inter-se-seniority determined under sub- cadre not to be
rule (2) of rule, 4 sub rule (2) of rule 5 and sub rule (2) of disturbed
rule 6, will not affect the seniority of persons in their
respective cadres.
8. The provisions of those rules shall have effect not Overriding effect.
withstanding anything to the contrary contained in any
rules for the time being in force regulating the recruitment
and conditions of service of persons appointment to public
services and posts, in connation with the affairs of the
State.

SUB ORDINATE OFFICES) RULES, 1980.

PART-I GENERAL

1. SHORT TITLE AND COMMENCEMENT :- These rules may be called


the Haryana Public Works Department Buildings and Roads Branch (State
Service Group-C Ministerial Establishment of Subordinate Offices) Rules
1980 :-
(2) They shall come into force at once.

2. DEFINITIONS:- In the rules, unless the context otherwise requires;


(a) “Board” means the Subordinate Services Selection Board
Haryana;
(b) “Engineer-in-Chief” means the Engineer-in-Chief, Haryana,
Public Works Department, Buildings and Roads Branch;

(c) “Circle” means the area or charge under the control of a


Superintending Engineer ;
(d) “Department” means the Buildings and Roads Branch of the
Public Works Department of the Haryana Government ;
(e) “Direct recruitment” means on appointment made otherwise
than by promotion from within the State Service or by transfer
of an official already in the service of the Government of India
or any State Government ;
(f) “Government” means the Haryana Government in the
Administrative Department ;
(g) Service” means Haryana Public Works Department Buildings
and Roads Branch (State Service Group-C Ministerial
Establishment of Subordinate Offices).
(h) “Recognized University” means ;
(i) Any University incorporated by law in India ; or
(ii) In the case of degree, diploma in certificate obtained
as a result of an examination held before the 15th
August, 1947, the Punjab, Sind or Dacca University; or
(iii) Any other university which is declared by the Govt.
to be a recognised university for the purposes of these
Rules.
(i) “Subordinate Offices” means the offices under the control of
Superintending Engineer ;
(j) “Superintending Engineer” means an officer incharge of an
area known as a Circle;
(k) “Unit” means a Circle or a group of Circles as may be notified
by the Chief Engineer from time to time.

3. NUBER AND CHARACTER OF POSTS:- The service shall comprise of


the post shown in Appendix “A” to these Rules:
Provided that nothing in these rules shall affect the inherent right of
Government to Duke addition to, or reduction in the number of such posts or to create
new posts with different designations and scales of pay, either permanent or
temporarily.
4. NATIONALLY, DOMICILE AND CHARACTER OF CANDIDATES
APPOINTED TO THE SEVICE; (1) No person shall be appointed to the
service, unless he is :-
(a) a citizen of India ; or
(b) a subject of Nepal ; or
(c) a subject of Bhutan ; or
(d) a Tibetan refugee who came over to India before the Ist January, 1962,
with the intention of permanently settling in India ; or
(e) a person of Indian origin who has migrated from Pakistan, Burma, Sri
Lanka, East African countries of Kenya, Uganda and United Republic of
Tanzania (formerly Tanganyika and Zanzibar) Zambia, Malawi, Zaire and
Ethiopia with the intention of permanently settling in India ;
Provided that a person belonging to categories (b), (c), (d) and (c) shall be a person in
whose favour a certificate of eligibility has been issued by the Government.

(2) A person in whose case a certificate of eligibility is necessary may be


admitted to be examination or interview conducted by the Board or any other
recruiting authority, but the offer of appointment may be given only after the
necessary eligibility certificate has been issued to him by the Government.
(3) No person shall be appointed to the service by direct recruitment, unless he
produces a certificate of character from the principal/academic offer of the university,
college, school or institution last attended, if any, and similar certificates from two
other responsible persons not being his relatives who are well acquainted with him in
his private life and are unconnected with his university, college, school or institution.
5. AGE; No person shall be appointed to the Service by direct appointment who
is less than 17 years and more than 30 years of age on or before the 1st day of August
next preceding the last date of submission of applications to the Board.
Provided that:-
(a) in the case of persons belonging to the Scheduled Castes,
Scheduled Tribes, Backward Classes and Ex-servicemen, the
upper age limit shall be such as may be fixed by Government
from time to time;
(b) in the case of candidates possessing the requisite qualifications
and who are already in the service of the State Government, the
upper age limit shall be relaxed as per Government instructions
issued from time to time.
6. APPOINTING AUTHORITY:- Appointment to the post in the Service
shall be made by the :-
(a) Engineer-in-Chief in respect of Circle Superintendent and Head
Clerk/Head Assistant: and
(b) The Superintending Engineer in respect of Stenographer,
Accounts Clerk/Assistant, Sub-Divisional Clerk, Clerk and
Steno-Typist.
7. QUALIFICATIONS:- No person shall be appointed to the Service unless he
is in possession of qualification and experience specified in column of
Appendix ‘B’ to these rules in the case of direct appointment and those
specified in column 4 of the aforesaid Appendix in the case of appointment by
promotion or transfer.
8. DISQUALIFICATION:- No person, –
a) who has entered into or contracted a marriage with a person
having a spouse living ; or
b) who having a spouse living has entered into or contracted a
marriage with any person, shall be eligible for appointment to any post
in the service ;
Provided that the Government may, if satisfied that such marriage is
permissible under the personal law applicable to such person and the other
party to the marriage and there are other grounds for so doing, exempt any
person from the operation of this rule.
9. METHOD OF RECRUITMENT :- (1) Recruitment to the Service shall be
made in the manner indicated below;-
(a) In the case of Circle Superintendent;-
(i) by promotion from amongst the Head Clerks/Head Assistant-

(ii) by transfer of an official working on a similar post either in the


service of the Government of India or of a State Government;
(b) In the case of Head Clerks/Head Assistants;-
(i) by promotion from amongst Accountants Clerks/Assistants or
Stenographers ; or
(ii) by transfer of an official working on a similar post either in the
service of the Government of India or of a State Government;
(c) In the case of Stenographers;-
(i) by promotion from amongst the Steno- typists ; or
(ii) by transfer of an official working on a similar post either in the
service of the Government of India or of a State Government;
(d) In the case of Accounts Clerks/Assistants ;-
(i) by promotion from amongst the Sub- Divisional Clerks or Steno-
typist ; or
(ii) by transfer of an official working on a similar post either in the
service of the Government of India or of a State Government;
(e) In the case of Sub Divisional Clerks ;-
(i) by promotion from amongst the Clerks; or
(ii) by transfer of an official working on a similar post either in the
service of the Government of India or of a State Government;
(f) In the case of Steno-typists ;-
(i) by direct appointment 75%
(ii) by promotion from amongst the Clerks who qualify the departmental
test in type and shorthand ; or 25% by transfer of an official working
on a similar post either in the service of the Government of India or
of a State Government;
(g) In the case of Clerks ;-
(i) by direct appointment 80%
(ii) by promotion from amongst Peons, Chowkidars, Ferro-Khalasi,
Malis, Sweeper, Gestoners Operators, Mates, Beldars, Mistry,
Supervisors, Fiters, Carpenters, Telephone Attendants, Drivers,
Operators, Helpers, Cleaners, Attendants, Fireman, Gangman,
Jamadars, Wiremen, Electricians, Electric Mistries, Work Munshies,
Assistant, Laboratory Attendants, Bhisties, Mazdoors, Khalasis,
Khansamas, Boatmen, Gauge Reader, Lab. Assistants and
Horticulture Supervisor and Chairman ; or 20% by transfer of an
official working on a similar post either in the service of the
Government of India or of a State Government;
(2) The promotion of Stenographer to the post of Head Clerks/Head Assistant and
Steno-typist to the post of Accountants Clerks/Assistant shall be governed by the Punjab Civil
Services (Promotion of Stenographer and Steno-typist) Rules, 1961.
(3) All promotions, whether from one grade to another or from one class of service to
another class of service, shall be made on the basis of seniority-cum fitness.
10. PROBATION;- (1) Persons appointed to any post in the Service shall remain on
probation for a period of two years, if appointed by direct recruitment and one year, if
appointed otherwise:
Provided that –
a) period, after such appointment, spent on deputation on
a corresponding or a higher post shall count towards
the period of probation;

(b) any period of work in equivalent or higher rank, prior to appointment to the
Service, may, in the case of an appointment by transfer, at the discretion of the
appointing authority, be allowed to count towards the period of probation fixed under
this rule; and (c) any period of officiating appointment in the service shall be
reckoned as period spent on probation, but no person who has so officiated shall on
the completion of the prescribed period of probation, be entitled to be confirmed,
unless he is appointed against a permanent vacancy.
(2) If, in the opinion of the appointing authority the work or conduct of a person
during the period of probation is not satisfactory, it may,–
(a) if such person is appointed by direct recruitment, dispense with his
services; and
(b) if such person is appointed otherwise than by direct recruitment, –
(i) revert him to his former post; or
(ii) deal with him in such other manner as the terms and conditions
of the previous appointment permit.
(3) On the completion of the period of probation of a person, the appointing authority
may: -
(a) if his work or conduct has, in its opinion, been satisfactory,-
(i) Confirm such person from the date of his appointment, if appointed
against a permanent vacancy; or
(ii) Confirm such person from the date from which a permanent vacancy
occurs, if appointed against a temporary vacancy; or
(iii) Declare that he has completed his probation satisfactory, if there is
no permanent vacancy.
(b) if his work or conduct has in its opinion, been not satisfactory, -
(i) dispense with his Service, if appointed by direct recruitment, if
appointed otherwise, revert him to his former post or deal with him in
such other manner as the terms and conditions of his previous
appointment permit; or
(ii) extend his period of probation and thereafter pass such order, as it
could have passed on the expiry of the first period of probation:
Provided that the total period of probation, including extension, if any, shall not exceed
three years.

11. SENIORITY OF MEMBERS OF THE SERVICE;- Seniority, interse of the


members of the Service (both civil as well as Electrical and Mechanical) shall be determined
by the length of continuous regular service on any post in the Service:-

Provided that where there are different cadres in the Service, the seniority shall be
determined separately for each cadre:
Note:- The Service will consist of two cadres; One Civil and the other Electrical-
cum-Mechanical. The seniority of Civil cadre will be separate than that of Electrical-
cum-Mechanical cadre whose seniority will be combined ;

Provided further that in the case of member appointed by direct recruitment, the
order or merit determined by the Board, shall not be disturbed in fixing the seniority:

Provided further that in case of two or more members appointed on the same date,
their seniority shall be determined as follows ,--
(a) a member appointed by direct recruitment shall be senior to a member appointed by
promotion or transfer;
(b) a member appointed by promotion shall be senior to a member appointed by
transfer;
(c) in the case of members appointed by promotion or by transfer, seniority shall be
determined according to the seniority of such members in the appointments from
which they were promoted or transferred; and
(d) in the case of members appointed by transfer from different cadres, their seniority
shall be determined according to pay, preference being given to a member, who was
drawing a higher rate of pay in his previous appointment, and if the rates of pay
drawn are also the same, then by the length of their service in the appointments and
if the length of such service is also the same, older member shall be senior to the
younger member.

(2) The seniority in the cadres of Circle Superintendent and Head Assistant/Head Clerk will be
provincial and it will be maintained by the Chief Engineer.
(3) The seniority in the cadres of Accounts Clerk/Assistant, Stenographer, Sub-Divisional
Clerk, Steno typist and Clerk will be on Unit basis and it will be maintained by the superintending
Engineer incharge of the Unit :

Provided that if any official whose seniority is maintained at the Unit level is transferred
from the Unit to the other, on administrative reasons of otherwise, his seniority in his parent Unit
will remain intact.

12. LIABILITY TO SERVICE;- A member of the Service shall be liable to serve under the
State Government at any place, whether within or outside the State of Haryana, on being ordered
so to do by the appointing authority.

A member of the Service may also be deputed to service as under:-

(i) A company, association of body of individuals whether incorporated or not, which is


wholly or substantially owned or controlled by the State Government, Municipal
Corporation or local authority within the State of Haryana; or
(ii) The Central Government or a company, association or body individuals, whether
incorporated or not, which is wholly or substantially owned or controlled by the
Central Government; or
(iii) Another State Government, an international organization, an autonomous body not
controlled by the Government or a private body:

Provided that no member of the Service shall be deputed to Central or any other
Government or any organization or body referred in the clause (ii) and (iii) except with his
consent.
13. LEAVE PENSION AND OTHER MATTERS:- In respect of pay, leave, pension and all
other matters, not expressly provided for in these rules, the members of the Service shall be
governed by such rules and regulation as may have been, or may hereafter be adopted or made by
the competent authority under the Constitution of India or under any law for the time being in
force made by the State Legislature.

14. DISCIPLINE, PENALTIES AND APPEALS :- (1) In matters relating to


discipline, penalties and appeals, members of the Service shall be governed by the

Punjab Civil Services (Punishment and Appeal) Rules, 1952, as amended from time to time:

Provided that the nature of penalties which may imposed, the authority empowered to
impose such penalties and appellate authority shall, subject to the provisions of any law or rules
made under article 309 of the Constitution of India, be such as are specified in Appendix C to
these rules.

(2) The authority competent to pass an order under clause (c) and (d) of sub rule
(1) of rule 10 of the said rules, and appellate authority shall also be as specified in Appendix D to
these rules.

15. VACCINATION:- Every member of the Service shall get himself


vaccinated and re-vaccinated if and when the Government so directs by a special or general
order.

16. OATH OF ALLEGIANCE: - Every member of the Service, unless he has


already done so, shall be required to take the oath of allegiance to India and to the Constitution of
India as by law established.

17. POWER OF RELAXATION:- Where the Government is of the opinion


that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing,
relax any of the provisions of these rules with respect to any class or category of persons.

18. SPECIAL PROVISIONS:- Notwithstanding anything contained in these


rules, the appointing authority may impose special terms and conditions in the order of
appointment if it is deemed expedient to do so.

19. RESERVATIONS:- Nothing contained in these rules shall affect


reservations and other concessions required to be provided for Scheduled Castes, other and
Backward Classes, in accordance with the orders issued by the State Government in this regard
from time to time, under clause (4) of article 16 of the Constitution.

20. REPEAL AND SAVINGS:- The Punjab Public Works Subordinate


Service (Building and Roads Branch Rules, 1934, published with Punjab Government
notification NO. 1455-E, dated the 30th October, 1934, are hereby repealed.

Provided that any order made or action taken under the rules, so repeated shall
be deemed to have been made or taken under the corresponding provisions of these
rules.

are exemptedfrom taking the StateEligibility Test in Computer
AppreciationandApplications(SETC):_
(i) M. Tech.tB.Tech. (Compurers), M.C.A.,B.C.A.orDiploma
i.n Computersfrom the recognizedinstitutions e.g.
Polytechnics;
(ii) BasicComputerLitency Certificate from anyrecognized
