EXTRA JUDICIAL SETTLEMENT OF ESTATE WITH SALE

KNOW ALL MEN BY THESE PRESENT

This EXTRA JUDICIAL SETTLEMENT WITH SALE made and entered into
in Roxas City, Capiz, Philippines by and between:
HEIRS of ALVARO JAPSAY, namely: JOSEFINA A. JAPSAY, of legal
age, widow, Filipino, and a resident of Barangay Malocloc Norte, Ivisan,
Capiz; MIGUEL JAPSAY, married to Nancy D. Japsay, both of legal age,
Filipino Citizens and a resident of Costa Verde Village, Barangay Cagay,
Roxas City, Capiz, Philippines; and; LAGRIMAS J. ALMODIENTE, married
to Joselito Almodiente, both of legal age, Filipino Citizens and residents of
Rizal St., Roxas City, Capiz, Philippines and hereafter called the HEIRS-
VENDORS;
-WITNESSETH-
That the parties herein are the only compulsory and legitimate
surviving heirs of the deceased ALVARO JAPSAY, who died intestate and
without known debts on October 30, 2006, in Roxas Memorial Provincial
Hospital, Roxas City, Capiz, Philippines, respectively;
That the deceased at the time of his death, left real property known as
Lot No. 3667, and covered by Transfer Certificate of Title No. T-
11695 located at Municipality of Dao, Province of Capiz with an area
of TWENTY-ONE THOUSAND SIX HUNDRED EIGHTY-EIGHT (21,688)
sq. m. more or less;
That no personal properties are involved in the extrajudicial settlement
with a sale;
That the surviving heirs herein being of legal and with full capacity to
contract, hereby by these presents agreed to adjudicate, as they hereby
adjudicate to themselves the aforementioned parcel of land in pro indivision
shares which shall be form part of their exclusive property pursuant to
Section 1 (1), Rule 74 of the Rules of Court of the Philippines, subject to the
liabilities imposed by Section 4 of the same Rule; Und Art. 111 of the Family
Code;
FURTHER, for and in consideration of the sum of FIVE HUNDRED
THOUSAND PESOS (500,000.00), Philippine Currency, the receipt of which is
hereby acknowledged, WE, JOSEFINA A. JAPSAY, MIGUEL JAPSAY, and
LAGRIMAS J. ALMODIENTE with the full civil capacity, by these presents hereby
SELLS, CEDES, TRANSFERS and CONVEYS the above-described property
and all the improvements standing thereon, in favor of DARWIN D.
MARTINEZ, of legal age, Filipino, single, and a resident of Mission Hills,
Milibili, Roxas City, Capiz, Philippines, by way of Absolute Sale, his heirs,
successors and assigns, in a manner absolute and irrevocable free from any
liens and encumbrances.
