I have your email of the 26 th April 2021, sent at 21h51, in which you refer to a 33
minute telephone discussion with Diane Burns that afternoon.
You are aware of the fact that there is to be a hearing before the Tribunal in July
2021 to reconsider the debarment order imposed on Ms Burns. I have advised Ms
Burns – as I advised Mr Cilliers – that pending the hearing before the Tribunal this
matter is sub judice.
Ms Burns did not receive the letter to which you refer and in which you seek answers
to a series of questions. She told you this when you telephoned her as well as telling
you that this matter is sub judice.
I am aware of the questions that you have posed and I am satisfied that the
questions raised by you in your letter create a definite potential of prejudice to my
client in the forthcoming Tribunal hearing. As a reporter you are or should be well
aware of the fact that if there is any risk of prejudice to a trial or similar hearing, that
justifies a limitation being placed even upon press freedom.
I call upon you to respect my client’s rights and privileges in this regard.
