FOR THE MOVIE – THE RAINMAKER

1.) What is the synopsis of the movie?


Rudy Baylor, a third year law student from Memphis state seeking a job to support his study and
finally employed at Bruiser law firm. Rudy Baylor became interested since he was reading the book
about on civil rights law. Upon studying law he read more about on rules of evidence, jurisprudence and
the discovery. When he got employed at Bruiser law firm together with his partner Deck Schickliff he
learned some tricky things on how lawyers get money from clients to work on papers. Bruiser law firm
handles will and civil ligation or civil cases. What Rudy Baylor actually a job is to meet clients, just like
victims of accidents, a man who beat their wife and make them signed a contract for any recovery or
civil claims. He met clients probably at hospital to sign an agreement that they have partition of at least
1\3 of money recovery. Rudy got worked-on Mrs. Berdie, a estate planning where his client wanted to
settle money or donate, a big amount of money instead to her immediate family which Rudy get a huge
amount on it. Second, Rudy got on the case against an insurance company, the Great Benefit insurance
company which he focused on. Before became a lawyer, Rudy was while at worked he manage to study
and review even weeks before the bar exam and luckily passed the bar. When he got the bar, Mr.
Bruiser arrested for charges that coincidentally make Rudy took the case and substitute as a lawyer for
plaintiff. Black’s family filed a complaint against Great Benefit for denying its claim for expenses on Bone
marrow transplant for Donny Ray Black leukemia that covers in the Great Benefit company policy. Mrs,
Black lettered the company for seven times but the company evidently denied the claim. Leo F.
Drummond, the defense counsel for Great Benefit and Rudy F. Baylor for the plaintiff Blacks family.
When the case is ongoing it’s hard for Rudy as he faces clever enemy. At beginning Rudy experienced
difficulty on finding witness as it presumably resigned and nowhere to find. Among the witness upon
deposition, Jackie Lemancyck , Everett Lufkin and Russell Crocket only one remain possible, Everett
Lufkin, but in favor to the defense because they’ve been downsized or paid. Upon court proceedings,
Rudy Baylor finally found his key witness Jackie Lemancyck which furnished documentary evidence
which deemed inadmissible as a stolen work papers but later admissible due to rulings of case showed
by Rudy Baylor. His key witness, Jackie Lemancyck, testimony stricken- off the record but by documents
furnished by Rudy Baylor he won the case by reading the Great Benefit claims manual Section U, para. 3
and convinced the jury and court by reading the report of Great Benefit own medical committee which
said “since bone marrow transplant have become standard procedure Great Benefit would be
financially justified in investing in bone-marrow clinics”. Which is the best evidence to victory
over rich insurance company. After winning the case Great Benefit filed a bankruptcy that Rudy
can’t get the money but punished them. Mr. Keely the CEO arrested after the guiltiness of
company.
2.) How is it related to your subject in Evidence? In Court Testimony?
Ans: the movie relates in criminal evidence on how to present evidence in court through rules of
evidence or rules of court that make the evidence to be admissible. Just like, work papers, information
or report as a documents presumed to be stolen is inadmissible except lawyer played no part in the
theft. The movie showed hearsay evidence is inadmissible as Leo F. Drummond present it to the
court but only present it as a recollection to witness. In court testimony, there it should witness
under oath before testifying in the court and it showed cross-examination on witnesses where
leading questions allowed. The counsel can object leading questions and repetitious either
sustained or over-ruled.
3.) Why was the statement of Rudy’s key witness, Jackie Lemancyzk, stricken off the record? How did
Rudy convince the court that Great Benefit has been fraudulently denying its clients their claims and
benefits and the malpractices that it has been doing?

Ans: it stricken off the record because as an employee Jackie Lemancyzk promised not to disclosed any
private claims information and report and it is justified upon resignation where she got $10,000. Other
than that, the defense presumed it to be a revenge against the company or to Mr. Lufkin that intent to
ruin the company. That anything furnished by Jackie Lemancyzk either oral testimony is sealed in the
promised not to disclose as employee and accompanied by stolen company work papers. Rudy convince
the court that Great Benefit has been fraudulently denying its clients by his reason with regards to the
ruling of “Club Ruby vs. Carmine De Soto number 585, Southwest Second, page 431” that stolen
documents are, in fact, admissible which convince the judge to admit stolen documents as evidence. In
this regard, Rudy Baylor used the stolen document the “ Complete Great Benefit Claims Manual”
specifically Sec. U para. 3 and another report from “Great Benefit own medical committee”
which specifically line 18 it said “since bone marrow transplant have become standard
procedure Great Benefit would be financially justified in investing in bone-marrow clinics”.
Furthermore, Rudy Baylor ushered to jury that Great Benefit take money from a low-income
family and then keep it by denying legitimate claim.
4.) If you were Rudy, what would you have done after winning the case against Great Benefit but
saddened at the fact that the insurance company cannot pay since it declared bankruptcy?

Ans: if I am Rudy Baylor I file further criminal charges against Great Benefit that its movement is a scam
or fraud as in fact they looted the clients claim 11,462 that has been filed but 9,141 denied. By this
option, bankruptcy can’t save them as it protects only from civil obligation but not actually punishing
them. In criminal charges everybody goes to jail and place undue burden to them. Since I can’t have the
money at least criminal charges they finished.
