NOTICE OF APPEAL

COMES NOW, Accused, through the undersigned counsel and unto this Honorable Court, most
respectfully states that:

1. On February 9, 2021, accused through the undersigned counsel received a copy of the
Notice of Decision together with a copy of the Decision issued by this Honorable on February 5, 2021.
The dispositive portion of which states that:

“WHEREFORE, finding the accused PO3 DAKILA GUILTY beyond reasonable doubt of the crime
of HOMICIDE, he is sentenced to an indeterminate penalty of eight (8) years of prison mayor, as the
minimum, to twelve (12) years and one (1) day of reclusion temporal, as the maximum.

In addition, the accused is ordered to pay the heirs of the late JOSHUA BAllen JOSHUA the
sums of:
1. Fifty Thousand Pesos (Php50,000.00) as civil indemnity;
2. Fifty Thousand Pesos (Php50,000.00) for moral damages;
3. One Hundred Eighty Nine Thousand One Hundred Fifty Pesos (Php189,150.00), as
actual damages; and
4. Three Million Two Hundred Forty Thousand Pesos (Php2,240,000.00), for loss of
earnings.

The above monetary awards shall all bear interest at Six Percent (6%) per annum reckoned the
finality of this decision until full satisfaction there on.

2. Accused has fifteen (15) days from February 9, 2021 or until February 24, 2021 within which to
file his Notice of Appeal;

WHEREFORE, premises considered, it is most respectfully prayed of this Honorable Court that its
Decision promulgated on February 5, 2021 be reversed and set aside and a new one be issued
DISMISSING THE COMPLAINT FILED AGAINST THE ACCUSED.

Petitioners further prays for such other reliefs and remedies proper under the premises.
