MINUTES OF THE 28th REGULAR SESSION OF THE SANGGUNIANG PANLUNGSOD OF THE CITY
OF TAGUM, PROVINCE OF DAVAO DEL NORTE HELD AT THE SP SESSION HALL ON JANUARY
27, 2020.

EXPLANATORY NOTE

The National Government through the Department of Social Welfare and Development (DSWD),
in response to the Millennium Development Goals has been implementing the Pantawid Pamilyang
Pilipino Program (4Ps), a poverty reduction and social development strategy that provides conditional
cash grants to extremely poor households to improve their health, nutrition and education particularly of
children aged 0-18 years old;
The Pantawid Pamilya National Advisory Committee (NAC) is an inter-agency and highest policy-
making body that provides policy directions and guidance on matters pertinent to Pantawid Pamilyang
Pilipino Program implementation. The Grievance Redress System (GRS) of the Pantawid Pamilya
program has been receiving complaints on cash card pawning and making use of Pantawid documents
as loan collateral. The National Advisory Committee (NAC) has formulated NAC 20 series of 2014 to
address the said complaints and does not authorize the grantee to pawn or use Pantawid documents as
loan collateral or to any transaction or undertaking whatsoever.
As reported in the barangay court and validated issues confirmed this cash card pawning of
beneficiaries either to, private individuals, groups or local business establishments.
Pawning defeats the serious intention of the government to fight and break the inter-generational
cycle of poverty; the DSWD through the National Advisory Committee (NAC) Resolution No. 20 series of
2014 has laid down the procedural guidelines in handling cash card pawning misdemeanors and their
sanctions based on the context, merit, and gravity of the case.
To discourage and eliminate the recorded incidence and avoid the same occurrences in the
future, this ordinance is deemed necessary.

AN ORDINANCE REGULATING FINANCIAL INSTITUTIONS, LENDING COMPANIES, INDIVIDUALS


FROM ACCEPTING 4P’s CASH CARDS AND OTHER 4P’s DOCUMENTS AS LOAN COLLATERAL IN
TAGUM CITY
Be it ordained by the Sangguniang Panlungsod of the City of Tagum in Session Assembled:
SECTION 1. Short Title. This ordinance shall be known as “4Ps No Pawning Ordinance” of the City of
Tagum.
SECTION 2. Declaration of Policy. The City Government of Tagum commits to improve the socio-
economic status of 4P’s beneficiaries so they may enjoy a better life. Money grants can alleviate some
conditions of poverty however, these grants should also leverage changes in the behavior and mind-set
of beneficiaries.
The Local Government of Tagum hereby reiterates the dual objectives of 4Ps Program as
1) Social Assistance whereby those extremely poor families are given monetary support for their
immediate needs; and
2) Social Development whereby 4Ps is set to break the intergenerational poverty cycle by
investing in human capital and affording health support and education of children 18 years
and below.
SECTION 3. Definition of Terms. The following terms shall mean as they are used in this ordinance as
follows:
1. 4Ps – also known as Pantawid Pamilyang Pilipino Program, is the national poverty reduction
strategy and a human capital investment program that provides conditional cash transfer with support
services to partner qualified household-beneficiaries who are compliant to the set conditions of the
program. In partnership with concerned national government agencies, local government units and other
stakeholders, the Program seeks to improve the health, nutrition, education and socio-economic aspect of
their lives.
2. 4Ps Documents- the cash card of Pantawid Pamilya beneficiary, Identification Card (ID) or
Kasabutan.
3. Business Establishment – this includes any store, supermarket, cooperative, lending institution,
bank, among others.
4. Case Management- a process used by the DSWD to enable the household-beneficiaries to
improve their functioning by dealing with their difficulties specifically in complying with the terms of the
program.
5. Cash Card – is an electronic payment card where cash grants of the Pantawid beneficiaries is
downloaded.
6. Cash Grants- monetary assistance released to the Pantawid Pamilya beneficiaries offered by
Philippine Government on condition that they comply with sthe monthly obligation set by the program.
7. CCAC - City Convergence Advisory Committee.
8. Collateral - any security put up by a borrower to ensure that the debt will be paid, in this
Ordinance refers to the Pantawid Pamilya Cash Card.

9. Community Facilitator/ MCCT - refers to Modified Conditional Cash Transfer Program targeting
families in the pockets of poverty, those in the streets and in difficult situations who are in need of social
protection, mainstreaming them into the regular 4Ps program.
10. Counseling- is a process used by a Social Worker to assist Pantawid Pamilya beneficiaries to
solve their problem and help them improve their attitudes and behavior.
11. Grantee– refers to the most responsible adult member of the qualified household-beneficiary
authorized to receive the conditional cash transfer.
12. Grievance Redness System-of the Department of Social Welfare and Development (DSWD)
which addresses and resolves issues and concerns related to the implementation of the Program.
13. Individual lenders - refers to private individuals who grant loans to clients.
14. Kasabutan – is a document stating the conditions of the program. Duly signed by the beneficiary
as proof that he/she commits to follow the conditions as stated.
15. NAC or National Advisory Committee- is an inter-agency and highest policy-making body that
provides directions and guidance on matters pertinent to Pantawid Pamilyang Pilipino Program
implementation.
16. NAC 20 or National Advisory Committee 20- is the procedural guidelines on misdemeanor
cases with amendments to the approved policy on misbehavior of beneficiaries as stipulated in NAC
resolution 10.
17. Pantawid Pamilya ID- is the identification card issued by DSWD as proof that a person is a
Pantawid Pamilya beneficiary.
18. Pawning of Cash Card - the cash card of the Pantawid beneficiary is given to financial
institution, lending company, usurers or individuals as security for money borrowed or credit on
items/goods.
SECTION 4. Prohibited Acts.
a) It shall be unlawful for any person, firm or entity engaged in the business of extending cash loans to
do any of the following:
1. Accepting 4Ps Cash Card or any 4Ps documents as collateral or security for cash loan or
any form of indebtedness;
2. Collecting service fee or any other form of collection attributed to cash card pawning;
3. Collecting interest payment from 4Ps beneficiary for loans guaranteed by cash card or any
4Ps documents.
b) It shall be unlawful for a 4Ps beneficiary, pursuant to Section 3.1 of NAC Resolution No. 20 Series of
2014, to commit any of the following:

4.1 Pawning the 4Ps cash card;


4.2 Using 4Ps documents such as ID, Kasabutan and such others as loan collateral

SECTION 5. Penal Sanctions. Any lender and 4Ps beneficiary subjected to Case Management
Process whose details of violation have been established and duly proven by the City Social Welfare and
Development Office (CSWDO) and Community Facilitator shall be meted the following penalties as
follows:

a) In violation to any of the provisions in Section 4-4.A hereof the following penalties shall be
sanctioned to the violator as follows:
1.1 Individual Lenders:
First Offense – Two Thousand Pesos (Php 2,000.00) per loan grant;
Second Offense – Three Thousand Pesos (Php 3,000.00) per loan grant;
Third Offense – Five Thousand Pesos (Php 5,000.00) per loan grant;
SUCCEEDING OFFENSES | one (1) year imprisonment and revocation or non-renewal
of license to operate.
1.2 Lending Companies and Financial Institutions
First Offense –Two Thousand Pesos (Php 2,000.00) per loan grant;
Second Offense – Three Thousand Pesos (Php 3,000.00) per loan grant;
Third Offense – Five Thousand Pesos (Php 5,000.00) per loan grant;
SUCCEEDING OFFENSES | one (1) year imprisonment and revocation or non-renewal
of license to operate.
b) In violation to Section 4-4.B hereof, the 4Ps/MCCT household beneficiary shall be referred to the
City Social Welfare and Development Officer (CSWDO) and be dealt with in accordance with
Section 3.2.1 of NAC Resolution No. 20 Series of 2014, which provides for sanctions on
misdemeanor grievances to wit;
a. First Offense - Counselling by the City Link with a written warning from the head of the
Provincial Operations Office and blocking of Cash Card account;
b. Second Offense – Counselling by the Social Welfare Officer III and a written warning from the
Regional Director while the grant of the erring household shall be suspended / not released for
one (1) payment or for a period of two (2) months.
c. Third Offense – Delisting of the erring household under the Grievance Redress System (GRS)
Fraud duly approved by the Regional Director and tagging to be facilitated by the Regional
Grievance Officers. Said delisting is non-appealable.

SECTION 6. City Convergence Advisory Committee - Shall be created to spearhead and ensure the
implementation of this ordinance, to wit:
 Chairperson : City Mayor
 Vice Chairperson : City Councilor/Chairperson-Committee on Gender Equality and
Development, Children and Family Welfare and Social Services
Members:
 Social Welfare and Development Officer
 City Legal Officer
 DILG
 Health Officer
 DepEd
 PNP

 ABC President
Section 6.1- Functions. The City Convergence Advisory Committee (CCAC) shall have the
following functions:
6.1.1 Receive and file cases of non-compliance to 4Ps conditionalities.
6.1.2 Provide clarifications and resolutions to any form of complaint and problems received
from the beneficiaries/grantees.
6.1.3 Entertain and provide clarification to queries and misunderstanding on decisions
made in cases filed at the City level.
6.1.4 Oversee and facilitate the proper implementation of the programs in the City level;
6.1.5 Ensure availability of logistics to facilitate the programs and activities for the
beneficiaries;
6.1.6 Provide necessary technical assistance and relevant information/data for program
implementation;
6.1.7 Coordinate in the implementation/operationalization of sectoral activities at the City
level to better execute program objectives and functions;
6.1.8 Coordinate with various concerned government agencies at the barangay level,
sectoral representatives, non-government organizations present at the local level to
ensure implementation of the Pantawid Pamilyang Pilipino Program;
6.1.9 Prepare monthly reports with issues and concerns and submit it at the Provincial
Advisory Committee and concern agencies.
6.1.10 Refer and file unsolved cases at the regional level in cases of suspension.
Section 6.2- Roles and Responsibilities of Stakeholders
a. Local Government Unit
1. Serve as member of the City Convergence Advisory Committee.
2. Make sure that the supply of schools, teachers and education materials are available
at target barangays.
3. Make sure that health centers, midwives and health education materials are
available at target barangays.
4. Monitor program operation particularly on compliance of conditions among
beneficiaries.
5. Oversee and monitor the overall implementation of the program in the City.
b. City Social Welfare Office
1. Serve as member of the City Convergence Advisory Committee.
2. Provide needed social services and interventions to grantees.
3. Provide logistical support in the conduct of activity at the barangay level.
4. Provide technical assistance and monitoring in the implementation of programs.
5. Assign/Designate a permanent staff to form part of the City Convergence Advisory
Committee.
6. Act as resource person in Family Development Sessions (FDS).
c. City Health Services Office

1. Serve as a member of the City Convergence Advisory Committee.
2. Ensure availability of supply and manpower to help grantees meet the conditions on
health.
3. Assist in monitoring and verification of compliance by grantees.
4. Monitor the compliance of beneficiaries.
5. Ensure that the Compliance Verification Forms will be accomplished and submitted to
the City Link.
6. Attend City Convergence Advisory Committee meetings.
7. Assign/Designate a permanent staff to form part of the City Convergence Advisory
Committee.
8. Act as a resource person in the Family Development Sessions (FDS).
d. Department of Education
1. Serve as a member of the City Convergence Advisory Committee.
2. Make sure that supply of schools, teachers and education materials are available at
target barangays.
3. Assist in monitoring and verification of compliance by grantees.
4. Monitor the compliance of beneficiaries.
5. Ensure that the Compliance Verification Forms will be accomplished and submitted to

Committee.
e. Barangay
1. Help facilitate the Pantawid Pamilya program activities.
2. Assist in the conduct of Community assembly and Organization of groups.
3. Assist in the conduct of verification and follow-up of compliance to program
conditions.
4. Monitor 4Ps household head beneficiaries in cases such as child labor, drug abuse,
gambling, violence and non-compliance to conditions.
5. Assist in the development of alternative solutions relative to operational problems
encountered in the barangay.
6. Reiterate importance of awareness that release of cash grants is dependent on
compliance to conditions.
7. Act as permanent liaison between the program and the grantees.
Section 6.3. Meeting and Quorum. The City Convergence Advisory Committee shall meet
quarterly and as often as necessary. A majority of the members shall constitute a
quorum. In the absence of the Chairman, the Vice Chairman shall preside. In the absence
of the Chairman and Vice Chairman, any member present shall preside for such meeting
only.
Section 6.4. Roles and Functions of Community Facilitator

2. Check if the household is a registered Pantawid Pamilya beneficiary or Non-Pantawid
Pamilya beneficiary.
3. Visit the area for validation.
4. Submit report to Grievance Officer for further review of the complaints.
5. Conduct case conference to involve beneficiary and provide counselling.
6. Refer the case to City Convergence Advisory Committee.
SECTION 7. Enforcement Procedures
Section 7.1 - Any report from the field regarding violations of this Ordinance shall be duly verified
and confirmed by the assigned Community Facilitator of the Program;
Section 7.2 -Upon verification and confirmation, a formal written report shall be submitted to the City
Convergence Advisory Committee (CCAC) for appropriate action.
Section 7.3 - The CCAC shall convene and create a validation team to verify the formal reports from
the field with facts and evidence;
Section 7.4 - The validating team shall make a report with corresponding recommendation/s which
shall be submitted to the CCAC for appropriate action.

SECTION 8. Disposition of Fines. All fines collected in the enforcement of this Ordinance shall be
deposited to the LGU/s Trust Fund and such shall be utilized for the programs and activities of the 4PS
subject to the usual auditing and accounting rules and procedures.

SECTION 9. Separability Clause. If any portion of this Act is declared as unconstitutional or invalid, the
remaining portions not affected thereby shall continue to have force and effect.

SECTION 10. Repealing Clause. This ordinance is hereby amended and modified. All other laws, orders,
issuances, rules and regulations which are inconsistent with this ordinance are hereby repealed or
modified accordingly.

SECTION 11. Effectivity. — This Ordinance shall take effect Thirty (30) days after its publication in the
Official Gazette or in any newspaper of general circulation.

CARRIED AND APPROVED.
