33 The first issue is that the Commonwealth of Australia is a creation of the Commonwealth of
34 Australia Constitution Act 1900 (UK) and it limits the Federal Parliament to certain legislatives
35 powers.

1 As such, while the Governor-General may by legislation be empowered to make certain

2 declarations, he does so not as Governor-General upon advice of the Federal Executives but does
3 so within the powers of the legislation. This means that the Governor-General making any
4 DECLARATION of a STATE OF EMERGENCY then such declaration is not the exercise of
5 prerogative powers within the provisions of the constitution as Governor-General but by mere
6 legislative enactment. As often is stated the river cannot have more water than the streams that
7 creates it. Likewise, if the Federal Parliament has absolutely no constitutional powers to in any
8 shape or form override the constitution then the Governor-General exercising powers provided
9 for in legislation cannot do so either. There is no backdoor manner to do so.
10 While it is claimed that the High Court of Australia held that States for health reasons may close
11 borders, etc, reality is that the Framers of the Constitution made very clear:

39 provisions? We can have every faith in the constitution of that tribunal. It is appointed as the arbiter of the
40 Constitution. It is appointed not to be above the Constitution, for no citizen is above it, but under it; but
41 it is appointed for the purpose of saying that those who are the instruments of the Constitution-the
42 Government and the Parliament of the day-shall not become the masters of those whom, as to the
43 Constitution, they are bound to serve. What I mean is this: That if you, after making a Constitution of

45 degrees you may have that Constitution-if not altered in terms-so whittled away in operation that the
46 guarantees of freedom which it gives your people will not be maintained; and so, in the highest sense,
47 the court you are creating here, which is to be the final interpreter of that Constitution, will be such a

4 My understanding of law from a U S Supreme court decision, is that if a judge doesn’t

5 follow the law, his decisions are void and of no legal effect.
6 And he can be sued in his person privately for such violation.

8 “when a state officer (which includes Judges) acts under a state law in a manner
9 violative of the US Constitution, he comes into conflict with the superior authority of

39 claim that the mask issue was because of changes in information, to me indicates he now applies
40 MISINFORMATION and DISINFORMATION, this as in 2005 Dr Fauci co-wrote a book that
41 mask during the 1919 Flu pandemic was the real cause of so many deaths. Yet, in 2020 went on
42 mask do not assist to fight a coronavirus, only then to flip-flop time and time again. That to me is
43 clear “DISINFORMATION” because he knew very well what mask were about and had nothing
44 to do with that there was an alleged virus in 2020.

15 Misinformation is everywhere online, and anyone can be vulnerable to it. On social media, you
16 may have at one point shared an article that you believed to be true at the time, but that you
17 later discovered actually contained falsehoods or outdated information.
18 While both misinformation and disinformation can deceive audiences, the distinction is that
19 disinformation is intentionally, maliciously deceptive. Both forms often involve widespread
20 dissemination, whether or not the person sharing is aware of the inaccuracies.
21 It's important for everyone to know how to spot mis- and disinformation online to avoid
22 spreading falsehoods and to be critical consumers of online news, particularly through social

25 initiatives to tackle it, such as the Google News Initiative, and Poynter's MediaWise Teen Fact-
26 Checking Network.
27 What is misinformation?
28 The term misinformation refers to information that is false or inaccurate, and is often spread
29 widely with others, regardless of an intent to deceive.
30 Business Insider spoke with Brian Southwell, an author, social scientist, professor, and director
31 at RTI International, a nonprofit research institute, about the differences between
32 misinformation and disinformation, as well as how to spot each in the real world.
33 Examples of misinformation
34 There's a conspiracy theory circulating online that claims 5G cellular networks cause cancer, or
35 even COVID-19, despite there being no scientific evidence to support this claim. The main idea
36 behind the false claim is that 5G radio waves are harmful to the brain and cause health issues
37 such as autism and cancer. However, experts have debunked this concern, explaining that 5G
38 radio waves cannot damage the DNA in our cells, nor can they even penetrate past the skin,
39 which acts as a protective barrier. This theory is an example of misinformation because it
40 presents incorrect and out-of-context information as fact.

1 Southwell said he's been seeing a lot of misinformation surrounding the coronavirus pandemic
2 and vaccine. He noted that in early spring when the virus was just beginning to grip the
3 country, the Centers for Disease Control and Prevention did not recommend the use of masks.
4 But just weeks later, the agency reversed its recommendation based on new data citing their
5 effectiveness.
6 "Science offers us an estimate — the best idea based on available evidence now [or] six
7 months from now that might change, and that's okay, that's the way science works," Southwell
8 said. "So if you've got people that are not paying attention to the historical context, and
9 they're going back willingly pointing to something that was a year old and reporting that as
10 new information now, well that combination is misinformation."
11 What is disinformation?
12 While misinformation is false information that is created and spread regardless of an intent to
13 harm or deceive, disinformation is a type of misinformation that is created to be deliberately
14 deceptive. Both forms may be shared widely, regardless of whether or not the sharer knows
15 the information is wrong.
16 "Disinformation is not a 21st century phenomenon," Southwell said. "When you've got a lack
17 of correct information, and an anxious population with a lot at stake, disinformation is going to
18 flourish. When people are anxious and looking for answers, somebody is going to provide
19 those answers and capitalize on it financially or politically."
20 Misinformation can turn into disinformation when it's still shared by individuals or groups who
21 know it's wrong yet intentionally spread it to cast doubt or stir divisiveness.
22 Examples of disinformation
23 One of the most relevant examples of a disinformation campaign is Russia's interference in the
24 2016 presidential election with help from Facebook ads, pages, and private groups. Russian
25 actors targeted specific geographic regions and swing states to spread propaganda against
26 Democratic nominee Hillary Clinton and sow division among Americans.
27 Unsubstantiated rumors, gossip, or claims of grand conspiracy can also count as pieces of
28 disinformation.
29 How to recognize misinformation and disinformation

30 "Regardless of whether it's disinformation or misinformation, it's important to know that it's
31 inaccurate and it means that you should not be believing it, and you should not be relying on
32 that information," Southwell said.
33 According to Southwell, if you come across information with the following characteristics, you
34 should consider it suspicious:
35  If it seems too good to be true
36  If it plays to your own implicit biases
37  If it elicits either extreme positive or negative emotions
38  If it's not properly sourced, or the stats appear out of date
39 The best, baseline way to interrogate a source of information is to check:

2  The organization
3  The date it was published
4  The evidence
5  What other sources say
6 "Always try to figure out where the information is coming from," Southwell said. "Do you know
7 the original source of the information? Is it listed clearly? Can you clearly tell what organization
8 is responsible for this? I think having people slow down and do a quick search to see if you can
9 find other information sources that might verify that information, that goes a long way."

48 to kill people. What appears to me is that Wuhan was exploring how the ordinary flu could be
49 manipulated to be deadly. Then again I read reports about the so called “Spanish flu” of 1919
50 and then research they did concluded you cannot infect another person with the flu, not even if
51 they inject a healthy person with it. If therefore you cannot transmit and neither inject a person
52 with the flu then this would require a system to be set up so that you can cause people to become

3 I went through the TGA pages they publish on the internet some time ago and noted that when a

5 amendment will not require them to seek new approval.
6 Actually, in the USA some about 50 years ago the FDA had approved some “vaccine” but then
7 the pharmaceutical company actually substituted this with a vaccine not at all approved but

12 objections”. Therefore, any person having a purely moral, ethical, or philosophical source of
13 “religious objection” have a valid objection.
14 Neither do I accept that a person making an “religious objection” requires to state his/her
15 religion, and neither which part of his/her religion provides for a “religious objection” as the
16 mere claim itself is sufficient to constitute what is referred to in subsection 245(14) as being a
17 “religious objection”. Therefore, the wording “religious objection” is to be taken as “objection”
18 without the word “religion” having any special meaning in that regard.

43 2. The question of the constitutionality of 6 (j) cannot be avoided by a construction of that provision that is
44 contrary to its intended meaning. Pp. 354-356.
45 3. Section 6 (j) contravenes the Establishment Clause of the First Amendment by exempting those whose
46 conscientious objection claims are founded on a theistic belief while not exempting those whose claims are
47 based on a secular belief. To comport with that clause an exemption must be "neutral" and include those
48 whose belief emanates from a purely moral, ethical, or philosophical source. Pp. 356-361.
49 4. In view of the broad discretion conferred by the Act's severability clause and the longstanding policy of
50 exempting religious conscientious objectors, the Court, rather than nullifying the exemption entirely,
51 should extend its coverage to those like petitioner who have been unconstitutionally excluded from its

7 Refer to the statutes. The laws require that immunization must conflict with the tenets and practices of a
8 recognized or organized religion of which you are an adherent or member. However, the law does not
9 require you to name a religion at all. In fact, disclosing your religion could cause your religious
10 exemption to be challenged.

13 Some schools and daycares attempt to require you to give far more information than required by law.
14 You are not required by law to fill out any form letters from a school or daycare. The law allows you to
15 submit your own letter and the letter only needs to meet the bare requirements of the law. Keep it simple; do
16 not feel you need to describe your religious beliefs here as that also is not required by law.

18 Many times, when a school or day care questions your exemption, they are merely unfamiliar with the
19 law or trying to coerce you to go against your beliefs by deliberately misrepresenting the law. They are
20 betting on the fact that you don't know your rights.

24 As for the usage of “averment”/”avert” often used by the AEC (Australian Electoral Commission
25 and/or ATO this too I successfully challenged on 4 August 2005 where the Court ordered the
26 Commonwealth to file all relevant evidence. As the Appeal orders noted the Commonwealth did
27 not file any evidence. As to underline that “averment” does not apply, regardless the legislation
28 may indicate otherwise. As much every time the AEC and/or the ATO uses “avert” this is to
29 pervert the course of justice!

33 The Defendant submits, that the whole issue about “averment” is that the Australian Electoral
34 Commission, so the Prosecutor (Commonwealth Director of Public Prosecutions), would not have one of iota
35 evidence to prove a Defendant has not voted and hence use the averment rule to avoid being challenged to
36 prove their case. GUILTY UNTIL PROVEN INNOCENT, being the outlawed STAR CHAMBER
37 COURT system. And it is upon this flimsy basis that Courts are causing “CRIMINAL” convictions upon
38 Defendants, even so they may in fact have voted! Therefore it is not the “Rule of Law” being enforced but
39 rather the conclusion of the Australian Electoral Commissioner, yet his own conduct failing to adhere to
40 constitutional and other relevant legal issues seems to be ignored!

44 I may add that in my view the HCA went also overboard to allow 2 convicted criminals, born in
45 New Zealand, to remain in Australia against the Deportation orders even so the Commonwealth
46 has the constitutional powers to legislate as to “influx of criminals” merely because the HCA
47 fancied that they had some Aboriginal heritage. As such, I view, the HCA actually pursues
48 racism as non-Aboriginals are denied the same legal standing. And, then when it comes to the
49 little girl that is an Australian “native” somehow the HCA denies her rights to remain (her
50 parents were I understand Tamil refugees) even so she has the birthright of being an Australian.
51 In my view, what the HCA is doing is to create deliberate racism and other conflict and violate
52 the constitution as it pleases. That is a very serious problem and again the s92 issue underlines

19 advantage of this. What we now have is a form of TERRORISM waged by the Governments
20 and their officials, etc, regardless what our constitution permits. Anyone who is part of
21 TREASON against We, the People must accept that legal accountability may be demanded and
22 the Nuremberg Trials may be an example that soon or later the accountability will be demanded.
23 I on 19 July 2006 stood my ground that “COMPULSORY” part of voting was unconstitutional
24 and succeeded in both appeals unchallenged. Likewise, I view that any coercion by anyone being
25 it directly or indirectly would be falling foul upon the legal principles embedded in the
26 constitution. While Scott Morrison may seek to use a backdoor manner, it in the end can be
27 deemed he is acting in violation of the constitution this as he must not incite others to violate
28 constitutional rights directly or indirectly on his behalf. And, considering the FAKE/HOAX
29 COVID-19 issue.

31 The issue is that the Federal government did organize for a special team to investigate
32 MISINFORMATION and/or DISINFORMATION in the internet and well my writings clearly
33 underlines it is the Federal government and other Australian governments assisted by their
34 officials, etc, which are in the thick in it. Hence, the Australian Federal Police cannot ignore their
35 unconstitutional/unlawful conduct but must act without delay, as to unduly delay it while lives
36 are placed at the peril of those pursuing to harm then the AFP itself may be required to show
37 accountability.
38 Where I despite my self-professed Crummy English nevertheless can comprehensively defeat the
39 commonwealth and other Attorney Generals on what the true meaning and application of the
40 constitution stands for then I view others certainly ought to be able to understand and
41 comprehend what the true meaning and application of the constitution stands for. I expect no less
42 from any member of any Australian police force!
