P reliminary

1. Sho rt ti tle and commen cement : (1) T his Act ma y be cal led
as t he "Iod ize d Salt (Prod uc tio n, Sa le a nd D is tr ib ut io n) Act,
205 5 (199 8) ".

Nepal Gaze tte.

2. Defin itio ns : Un less t he s u bject or t he c onte xt ot herw ise

requ ire s, in t his Act :

(a) "io d ized sa lt" mean s t he iodized salt in gran ular or

pow der form w it h m inimum 96 percent s od iu m c hloride,
wh ite, pa le p in k or ligh t grey in co lour, free fr om visib le
con tam in atio n w ith c lay, grit a nd o ther ext raneo us
adu lterant a nd im purit ies and w it h q ua lit y stan dar d as
fixe d pur s uant t o Sec tio n 1 5.

(b) "permit" means the per m it t o be issued pur s uan t to

Sec t io n 7 fo r the pr oduct ion, import, su pp ly or s ale a nd
d ist ribut ion of t he iodized sa lt.

(c) "Commit tee " means an io dine defic ie nc y dis or der

pre ven tio n com mittee co nst it u ted pu rs ua nt to Sec t ion 1 2.

(d) "pr oduct ion " mean s the ma nu fac tur in g o f io diz ed sa lt by
mix ing io dine w it h iodin e free sa lt.

(e) "pr oducer " means any person or organizat ion having
obta ine d the permit w ho is in vo l ve d in pro duct ion
d ire ct ly or throu gh an a ge nt or co ntr olle d per so n by
a greemen t or un der a greemen t.

(f) “or gan iza tio n” mean s a fir m, compan y or b od y c or por ate
registere d u nder t he pre va il in g law.

( g) “ im por t” mean s a n act of im portat io n o f io dize d sa lt or

iod ine fre e salt in t o Nepal.

(h) “ im por ter” mean s a perso n or or ga nizat ion ha ving

obta ine d permit to import iod ize d s a lt.

( i) “su pp ly” me an s the act o f deli ver y o f iod ized salt t o a

( j) “su pp lier” mean s a perso n or or ga nizat ion ha ving

obta ine d permit to su pp ly iod ize d s a lt.

(k) “sa le and d istr ib u tio n” mea n s pro vis io n o f informat ion
ser vice of io diz ed salt, promot io n, ad ver t iseme nt,
d ist ribut ion of samp le o f iod ize d sa lt and mar ket ing su ch
salt, o n b eha lf of t he pr o duce r.

( l) “dis tr ibut or” mea ns an y pers on en ga ged in th e sale a nd

d ist ribut ion of iod ize d salt by whole sa le or reta il.

(m) “ in s pect or” means a n ins pec tor appo inte d or de s ignat ed
pur s uant t o Sub-sect ion (1) o f Sect ion 18.

(n) "lab el" mea n s a ta g, symb ol, pic tu re or ot her de scr ipt i ve
thin g w ritten, pr inted, lit hogra phed, s ym bo l ized,
emb os sed or inc lude d or otherw ise partic ularized in a
packa ge used to pack iodized sa lt.

(o) “samp le" mean s a small q uant it y o f io dized sa lt p repar ed

for t he tes t or for bu s ine ss pr omotio n.

(p) “pre scr ibe d" or “as pre scr ibe d” mea ns pre scr ib ed or as
pres cr ibe d in t he r ule s framed un der t h is Ac t.

Chap ter-2

Provisions relating to permit

3. Prohibition o n i mp ort, pu rch as e and s al e o f i odine free

sal t : No per so n s ha ll impor t in to Ne pal and p urchase and se ll
iod ine free sa lt w it ho ut obtain in g permis sio n as pre scrib ed
from t he c omm ittee.

4. Permit to be obtai ned to produce, i mpo rt, supply, s ell

and di stribu te io di zed s al t : A pers on or o r ga nizat ion
inte nd ing to pr oduce, import, su pply, sell an d d is tr ib ute io dized
salt has to obta in the permit p urs ua nt t o t his Act.

5. Appli ca tion for permit : A pers o n or or gan iza t ion in te nding

to obtain t he per mit p ur sua nt t o Sect ion 4 has t o mak e an
app l icatio n, accompanied by t he fee s as prescribed, t o the
committee, in the forma t as prescribed.

6. Inqui ry reg arding is sue of p ermi t : Where an app licat ion is

made un der Sect ion 5, t he comm itte e sha ll in quire into the
follow ing matt ers :

(a) Techn ica l a s pect a nd ca pac it y for the pro duct ion, im port,
sup ply, sa le and d ist r ibu tio n o f salt,

(b) Fin anc ia l statu s o f the a pp lica nt,

(c) If iod ine free salt is t o be imp or ted for t he pur pose of

7. Iss ua n ce o f p ermit : If, the co mm ittee c on siders, u po n having

made inquir ies p urs ua nt to Se ct io n 6, that the a pp lica nt is
com peten t t o pr oduce, import, s up ply, sell and d istr ib ute
iod ized salt, t he c ommit tee sha ll issu e the permit t o the
app l icant in the prescribed fo rmat.

8. Period a nd renewal of p ermi t: ( 1) Exce pt where the perm it

is re vo ke d ear lie r p ur sua n t t o Sec tion 11, t he per io d o f the
permit for pr oduc t io n s hall be for a max imum per iod o f Fift een
year s and the per iod of the perm it for im port, su pply, sale a nd
d ist ribut ion sha ll be for a max im um p erio d o f Thre e years.

(2) N o lat er tha n at least s ix mo nt h s pr ior t o t he

exp ira t io n o f t he pe r iod as referre d t o in Sub -sect ion ( 1), an
app l icatio n, ac compa nie d by the fees as pres cribed, ha s to be
made to t he co mm it tee in the pre scr ibe d forma t fo r t he re new al
o f t he permit.

(3) Where a n a pp lic atio n is not ma de for t he re new al of

permit w ith in the time lim it as re ferred to in Su b-sect io n (2),
the permit s ha ll n ot be re newed ; t he permit wh ich so ex pires
sha l l be deeme d t o be i pso fac to ca nce led.

area d urin g t he per io d spec ifie d in t he permit.

cour se o f prod uct ion, imp ort, supp ly, sa le and d ist r ibut io n of
salt shall be as pre scr ibe d.

11. Po wer to rev oke permi t: (1) If a per son or b o dy having

obta ine d pe rm it doe s not follow th e terms re qu ire d t o be
follow ed pu rsuant t o Sec t ion 10 in the co ur se o f produc tion,
imp or t, s upply, sale a nd d is tr ib ut io n of iodized salt, the
committee may gi ve necessar y ord er t o suc h pers on or body to
obser ve s uc h terms, w ith sp ec ificat ion of ce rta in per iod.

(2) If t he pers o n or bod y ha ving obta ine d perm it doe s n ot

carry o ut the or der w ith in t he perio d s pec if ied pur suan t to Sub-
sect io n ( 1), t he comm itte e may re voke t he perm it of such
pers on or bo dy.

(3) Pr ior t o t he re voca tio n of per mit p ur sua nt to Su b-

sect io n (2), the c ommit tee s hall g i ve a rea s onab le opport un ity
to the c o ncer ned perso n or body ha vin g ob tained perm it to

(3) The Ce n tra l Fo od La bor at ory shall ha ve powers to

examine whe th er the io diz ed sa lt pro d uced in or impor ted in to
Nepal conform s t o t he standard s as me ntio ne d in Sub-sect ion
(1).

imp or ted and mar keted pr ior t o t he commencemen t o f this Act,
it s pr oducer or su pp lie r or d istr ibut or shall ge t it exam ine d by
and o bta in certif icat io n o f sta ndard s fr om t he Ce nt ral Fo od
Lab ora to ry no later t han six mo nth s after the da te of
comme ncemen t of th is Act.

(3) The pr od ucer, im por ter or dis tribut or shall, for

pur poses of Sub- sec tions (1) and ( 2), make an a pp l ica tion,
accompan ie d b y a samp le of io d ized salt a nd the requ ired fee,
to the Cen tra l Foo d Labor at or y, in t he pre scr ib ed forma t.

(4) O n receip t of t he samp le acc ompa nie d by t he

app l icatio n pur suan t t o Su b-sect ion ( 3), th e Centra l Fo od

imp or ted int o N ep al pr ior t o t he commenceme n t o f t his Act, its
pro ducer or su p plier or dis tr ibut or sha ll ge t its labe l a ppr o ved
by t he c ommit tee n o la ter t han s ix mo nth s a fter t he date of
comme ncemen t of th is Act.

(3) The prod ucer, su pplier or dis tr ibut or sha ll pre pare t he
labe l o f iod ize d salt in suc h a man ner a s t o gi ve nece ss ary
informat ion about, a nd en co ura ge, t he pro per us es of io dized
salt.

or order frame d or issue d under th is Act, t he M in is try may, on
recomme n datio n o f t he comm ittee, wr ite to t he c o ncer ned bo dy
to s uspen d or can cel the lice nse, perm it or a ut hor iz atio n wh ich
suc h pr oducer, dis trib utor, imp orter, su pp lier, se ller a nd
d ist ribut or ha ve obta ine d fr om the Go ver nmen t o f Ne pa l or a ny
other body.

27. Government to be the Plaintiff: Government of Nepal shall be the

plaintiff the case under this Act.
