MODULE 4 THE RIGHTS AND PRIVELEGES OF TEACHERS IN THE PHILIPPINES

Learning Outcome:
Discuss the rights and privileges of teachers in the Philippines.

Introduction

After having learned the demands that learners, parents, school officials, the academic community, the larger community
and the state put on teachers, let’s discuss their rights and privileges.

PRETEST. Write YES if you agree and NO if you disagree. Refer to the 1987 Philippine Constitution, Commonwealth Act
No.578and RA 4670, the Magna Carta for Public School Teachers.

The 1987 Philippine Constitution states that the state shall:

3. YES Ensure that teaching will attract and retain its rightful share of the best available talents through adequate
remuneration and other means of job satisfaction and fulfilment.

Commonwealth act No. 578 protects teachers by providing a provision on:

5. YES According due respect and protection for teachers who are considered persons in authority.

Republic Act No. 4670 or the Magna Carta for Public School Teachers states the following rights and privileges of a teacher:

7. YES The right to be free from compulsory assignments not related to their duties defined in their appointment or
employment contracts unless given additional compensation.
8. YES Freedom from involuntary contributions.
9. YES Compensation for employment injuries in accordance with existing laws.
10. YES Establishing, joining, maintaining labor organization of their choice to promote their welfare and defend their
interest.
11. YES Transfer even without their consent from one station to another where there is urgent need.
12. YES Employment in the same locality for those who are married whenever possible.
13. YES A maximum of 4 hours actual teaching per day.
14. YES More than 9 hours of teaching but not exceeding 9 hours.
15. YES An additional compensation of at least twenty percent of his regular remuneration after the teacher has
completed at least 6 hours of actual classroom teaching a day.
16. YES Additional compensation from DepEd when they serve during election.
17. YES Equal remuneration, regardless of qualifications.
18. YES Salary scale of teachers that provide for a gradual progression from a minimum to a maximum salary by means of
regular increments, granted automatically after three years even if efficiency rating of teacher concerned is below
satisfactory.
19. YES The salary scales appropriated by the city, municipal, municipal district or provincial government that are not
lower than those provided for teachers of the National Government.
20. YES Without expecting hardship allowances.
21. YES Special hardship allowances equivalent to at least twenty-five per cent of their monthly salary for those who
qualify.
22. YES Free medical examination even after retirement.
23. YES A study leave for not more than 2 school years after ten years of teaching.
24. YES Enjoy a compensation allowed for one year study leave without any condition.
25. YES A study leave of more than one year provided permitted by the Secretary of Education but without
compensation.
26. YES An indefinite sick leave of absence when the nature of the illness demands a long treatment that will exceed one
year at the least.
27. YES On range salary raise upon retirement for those who have fulfilled the age service requirements of the applicable
retirement laws which shall be the basis of the computation of the lump sum of the retirement pay and the monthly
benefits thereafter.
28. YES Hardship allowance for those who teach in the multi grade classes, mobile teachers and Non-formal Education or
alternative Learning System (ALS) Coordinators.
