The Sangguniang Panlungsod of the City of Cebu, on motion of Member Label,
seconded by Member Jakosalem,
RESOLVED, to approve the following ordinance’
ORDINANCE NO. 2442
‘AN ORDINANCE ENACTING THE CODE OF ETHICS OF CEBU CITY EMPLOYEES
WHEREAS, a public office is designed for the effective end efficient delivery of
services to the public at large attuned to the well-enshrined principle that “Public Office
ig a Public Trust’;
WHEREAS, provision on the Accountability of Public Office of the 1987
Philippine Constitution, Republic Act 6743, otherwise known as the “Code of Conduct
and Ethical Standards for Public Officials and Employees” stipulates the parameters of
the norms of conduct, prescribed acts and functions, as well as duties and obligations of
government employees, to wit:
“It is the policy of the State to promote a high standard of ethics in public
service. Publis officals and employees shall at all times be accountable to the people

loyalty, act with patriotism and justice, lead modest lives, and uphold public interest over
personal interest.”
WHEREAS, Section 458 (1) of the Local Government Code of 1991, empowers
the Sangguniang Panlungsod of the City of Cebu, as a legislative body, to enact
measures designed to effectuate an efficient and effective city government.
NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, BY THE
SANGGUNIANG PANLUNGSOD OF CEBU CITY, BY VIRTUE OF THE POWERS
VESTED IN IT BY LAW IN SESSION ASSEMBLED THAT:
SECTION 1. Policy. In pursuance to the fundamental policy of the government
concerning the conduct and discipline of all public employees as enshrined in Republic
Act 6713 and other pertinent Civil Service Laws, the City Government of Cebu hereby
enacts this Ordinance, which shall contain the following rules and regulations for the
guidance of as well as compliance by all employees of the same.
SECTION 2. Title. This Ordinance shall be known as the CODE OF ETHICS OF
CEBU CITY EMPLOYEES.
SECTION 3. Definition of Terms. As utilized in this Ordinance, the following
words and phrases shall have the meaning indicated unless denoted otherwise in the
text.
Cebu City - refers to the City Government of Cebu.
Employees - refers to employees, permanent or temporary, substitute or co-
terminus, contractual or casual, provisional or probationary, whether in the
career of non-career service, who are compensated for their services being
rendered to the City Government of Cebu.
Emergency Cases - refers to unenticipated situations such as
conflagration, typhoon, earthquake, sickness, giving birth, death or any other
similar accidents involving either the employee personally or immediate
members of his\her family including his\her lawful spouse, children as well 2s
parents.
The Premises - refers to all landholdings end buildings including public
school buildings, public parks and playgrounds, puericulture centers, barangay
halls, police precincts, and all other properties owned or rented by Cebu City
including the working area occupied by employees assigned in the field and
‘motor vehicles.
Profane Language - refers to words, phrases, or signs uttered or done with

Narcolics - refer to prohibited drugs such as, but not limited to opium,
shabu, marijuana, cocaine, alpha and eucaine, Indian hemp as well as
other illegal substances, which have been medically-proven to produce a
condition of insensibilit
SECTION 4. Absenteeism and Tardiness
‘or melancholy duliness of mind on the user.
4.1.2, All employees shall be required to perform their duties regularly
and punctually. They shall avoid being absent or tardy in reporting
for work.
4.1.0. Any employee may ask for written permission for his/her immediate
supervisor before taking a vacation. Except in emergency cases,
the permission shall be secured at least three (3) days before the
intended period of the vacation.
4.4.0. Any employee who is absent from work because of compelling
reason(s) other than emergency cases as defined herein, shall
inform in writing his\her supervisor within twenty-four (24) hours
from the first date of absence, except in cases when this is not
possible, in which case he shall, at the earliest possible time,
inform his\her supervisor of the said absence and the reason
therefore, and also the reason for his/her failure to comply with the
seid 24-hour notice.
4.1.4. Unauthorized or unexcused absence from work for a single day
shall be considered as a simple case of absence.
‘the unauthorized or unexcused absence from work exceeds the
allowable 2.5 days monthly leave credit under the Leave Law for at
least three (3) months in a semester or at least three (3)
consecutive months during the year, the same shall be considered
as excessive absences.
4.1.2. When the unauthorized and unexcused absences from work shall
exceed five (5) consecutive working days, the same shall be
considered as abandonment of work.
4.4.8. The employee's Department Head shall decide, upon the
recommendation of the Division Head and\or immediate supervisor,
40 excuse or not fo excuse the unauthorized absence from work.
Excused absences shall be charged against the employee's leave
credits, if any; otherwise, the same shall be considered as

All employees shall be required to follow the official time set for
histher shift in reporting for as well as leaving from work. Any
employee who shall arrive at his\her work station on regular
working day later than the official time for his\har shift shall be
considered tardy for that same day unless helshe can produce a
valid reason(s) of histher tardiness.
Any employee shall be considered as excessively tardy if helshe
incurs unexcused tardiness for five (5) times or an accumulated
tardiness of one and one-half hours, whichever comes first, within
any 30 day poriod.
Neglect of Duty
All employees shall be required to perform with diligence their
duties and any other work assigned to them and shall strive to
meet the work standards set by Cebu City.
The following shall be considered as acts constituting neglect of
duty:
5.1.b(i) Acts of negligence or carelessness committed during
working time or on the premises resulting in personal
injury or damage to property belonging to Cebu City or to
third parties, or otherwise causing expenses to be
incurred by Cebu City
5.1.b(ii]_ Leaving work assignment or work area without permission
from his\her supervisor. Established practices such as
coffee breaks, lunch periods and other similar activities
are excluded from this rule.
5.1.b(ii) Loafing, loitering, sleeping or engaging in unauthorized
visiting during working time
5.1.b(iv) Willful non-compliance of official orders and\or failure to
verform reqularly assigned duties or specific instructions
related to his\her duty.
5.1.b(v) Knowingly furnishing false, misleading or grossly
inaccurate data or information to persons duly authorized
to receive the same, arising out of the emplayee’s neglect
or failure to discharge his\her duty to make proper
research, investigation or verification, which act causes

5.1-b(vi) Losing or misplacing local government records which
causes prejudice to Cebu City.
5.1.b(vii) Failure to wear prescribed uniform by employees who are
required to wear them,
§.1.b(viii) Failure to inform Personnel Department within thirty (30)
days of any change in civil status, home address, and
names of dependents.
SECTION 6. Conduct and Behavior
6.1.a, All employees shall be required to conduct themselves in a
manner consistent with decorum and good discipline.
6.1.0. The following acts shall constitute violation of this section:
6.b{i) Engaging another employee or other employees in a fight,
oF prodding or goading another employee or employees
10. fight over matters related to work within the premises
or during office hours.
6.d(i) Assauiting, challenging to a fight or threatening with
bodily harm another employee or employees over
matters related to work.
6.b(ii) During office hours or within the premises, engaging in
horseplay, of using abusive, threatening 2s well as
profane language.
6.bliv) Sowing intrigues against another employee which tends
to cast dishonor, discredit or contempt upon the latter.
6.b(v)_ Theft of property belonging to another person, committed
during office hours or on the premises, or on Cebu City
property reaardless of time and place.
6.b(vi) Planting evidence against another employee for the
purpose of unduly imputing a crime or the commission of
an offense under this Ordinance against the latter, or to
evade responsibility for the commission of an offense
covered by the same.

6.b(vii) intentionally causing personal injury to another employee
andlor any person during office hours or within the
premises,
6.b(ix) Attempting to bring explosives, firearms or deadly
weapons into the premisas without due authority
6.b(x) Possession by an employee of explosives, firearms, or
other similar weapons during working time or on the
premises, unless otherwise authorized in writing by Cebu
City or if tho same io a member of a law enforoement
agency authorized to carry firearms while on duty.
€.b(xi) Discharging firearms or explosives during working time or
within the premises.
6.d(xii) Engaging in ali forms of usurious lending activities,
gambling, lotteries, and other similar acts during office
hours or on the premises.
6.0(xili) Soliciting money or other material objects for any
purpose not sanctioned by Cebu City, or vending
anything during office hours or on the premises.
6.b(xiv) Writing, carving, etching, painting or posting writings or
drawings, or other similar vandalistic acts which tend to
deface Cebu City property.
€.b(xv) Acts of utter discourtesy to the transacting public.
6.b(xvi) Drinking of alcoholic beverages during office hours or on
the premises except on officially sanctioned functions
of Cebu City,
B.b(avi).2. Unfitness to work as a result of excassive
drinking of alcoholic beverages somewhere:

6.b(xvi).b. Allowing oneself to be relieved by another
known to be under the influence of liquor or
narcotic drug.
6.b(xvii) Possessing, using or causing to be brought or used,
narcotic drugs into premises, except when the same

6.b(avii) Prodding, inducing, or coercing another employee to
perform an act constituting a violation of this Ordinance
or allowing oneself to be persuaded, induced or
influenced to commit such offense
6.b(xix) Falsely representing oneself to be an officer, agent, or
representative of Cebu City or any of its departments or
agencies.
6.b(xx} Performing any act pertaining to any person in authority
in Cobu City or any departmont thoroof, under protonco
of official positions, without officially being entitled to
do so.
6.b(xxi) Using a fictitious name for the purpose of concealing an
offense or evading responsibly therefor.
6.b(xii) Insulting as well as threatening with bodily harm or using
influence or showing willful disrespect on the honor of a
supervisor or any official of Cebu City
6.b(xxii) Assaulting a supervisor or any official of Cebu City,
6.b(xxiv) Smoking inside a ‘No Smoking Building” or offices
‘except on designated areas.
6.d(x«v) Deliberately holding back, slowing down, impeding or
limiting work output of oneself.
6.b(xxvi) Borrowing money from subordinates or acting as loan
guarantors to the latter.
SECTION 7. Dishonesty
The following acts shall constitute violation of this section:

7.4.4. Knowingly giving false or misleading information in applying for
employment; or, if already employed, giving false or misleading
information to seek or to qualify for any preferences or benefit of
Cebu City.
T.1.e. Falsifying time cards or any other timekeeping records or drawing
salary allowances by virtue of falsified time cards, vouchers,
receipts and the like.
TA Soliciting or receiving monoy, gift, chara, porcentage or bonefite
from other persons, either personally or through the mediation of
another, to perform an act prejudicial to Cebu City.
7.1.9. Knowingly issuing a check against insufficient funds end cashing
the same with’ any of the cashiers, tellers or employees of Cebu
City,
T.1.h, All other acts of dishonesty which cause or tend to cause
prejudice to Cebu City
SECTION 8, |nsubordination
The following act shall constitute violation of this section:
&1.a, Adamantly refusing, to accept work, shift, assignment or specific
instruction given by a superior authority without any valid reason
SECTION 9. Confidentiality of Work and Information
The following acts shall constitute violation of this section:
8.4.4. Infidelity in the custody of Cebu City documents.
9.1.b. Revealing, releasing or divulging confidential
individuals other than authorized persons without proper
authority.
‘Authorized Persons” shall be those who by virtue of their
position must know of confidential matters such as the main

SECTION 10. Conflict of Interest
‘The following act shall constitute violation of this section:
10.1.a. Having any participation or involvement, direct or indirect, in any
transaction involving any person, corporation or any business
enterprise with which Cebu City, directly or indirectly, has
business relationship, where such participation or involvement
is of a nature detrimental to Cebu City.
SECTION 11. Use of Cebu City Property
The following acts shall constitute violation of this section:
14.1.a, Operating without previous authority, or tinkering with, Cebu
City motor vehicles, computer units, police radio system or
other equipments, the operation or use of which requires
specialized skills or training, to which the employee has not
been specifically assigned.
14.1.b. Improper use and care of Cebu City property including facilities
such as comfort rooms and others of similar nature.
SECTION 12, Neglect of Duty of Supervisors
The following acts shail constitute violation of this section:
12.1.4, Negligence of the supervisor to disseminate to employees under
his\her supervision the Cebu City Government policies, work
tules, work procedures and the like.
12.1.b. Negligence of the supervisor who has knowledge of any violation
of this Ordinance and other Cebu City work rules to take steps
to prevent and/or report the same.
SECTION 13. Multiple Violations
181.2. The penalties for successive violations of the seme work rule ere
progressively more severe than the penalty for a ‘first violafon,
However, the definition of ‘cumulative’ violation is subject to a
2-month limitation pesiod, Any repeat violation occurring after

If at the time of the commission of the latest offense, the
employee shall also have previously violated at least two (2)
other separate rules covered in this Ordinance or of other
promulgated Cebu City ordinance, all committed within the 12-
‘month period, the latest offense shall be punishable by the next
higher step or degree of penalty orescribed for the said
offense,
Where the fourth violation of the same provision or rule is
punichablo by a ponalty lose than diemiccal, tho fifth and
‘subsequent violations, if committed within any 12-month period,
shall be meted out a more drastic penalty including that of
dismissal,
Any other act, conduct or behavior not included in the list of
offenses under this Ordinance, which is considered prejudicial
to the interest of Cobu City shall also be punishable, the
penalty to be imposed depending upon the gravity of the
offense

‘1b. The supervisor shall be held liable and shall suffer, at least, the same
penally to be imposed upon the offender.
SECTION 45. Enforcement
‘The City Attorney's Office together with the Personnel Transaction Office, as well
as the Department Heads of Cebu City are hereby empowered to enforce this
Ordinance.
Provided that due process is observed, the application of penalties provided in
this Ordinance shall be imposed on erring employees by the City Attorney's Office
subject to review and approval of the City Mayor.
All penalties imposed including “Reprimand” shall be in writing. Copies thereof
shall be furnished to the Personnel Transaction Office, as well as the City Attorney's
Office. Any and all suspensions shall be imposed "Without Pay’.
The provision on due process of the Civil Service Act of 1959 as amended by PD.
807 and other Civil Service Laws relating to employee discipline shall supplement this
Ordinance. Nothing in this Ordinance shall prevent the City Attorney's Office and/or the
Department Heads of Cebu City from enforcing instead the relevant and pertinent
provisions in different Civil Service Laws, such as Rule XIV (Discipline) of the Omnibus
Rules Implementing Book V of Executive Order No. 292 (Administrative Code of 1987),
which may have provided for a more stiffer penalty or stricter standards than that
provided in this Ordinance,
SECTION 16. Saving Clause. Should any part or parts of this Ordinance be
declared invalid or unconstitutional, the other parts not so declared shall remain in force
and effect.
SECTION 17. Repealing Clause. Any other Ordinance or parts thereof
inconsistent herewith are hereby repealed or modified accordingly.
SECTION 18. Ffiectivity. This Ordinance shall take effect after four (4)
consecutive weeks of posting in all offices and departments of the City Government and
at the public posting places of the Sangguniang Panlungsod.
