NOTICE INVITING e-TENDER(NIT) for Sale of Good Earth

1.0 NBCC invites offline sealed tenders for Sale of good earth of construction of Head Quarter Office Building for CBSE
at,Sector-23, Dwarka, New Delhi from eligible contractor/agencies on highest rate basis on behalf of client as per
schedule as under. The estimated Cost of Good Earth is Rs. 23.00 Lacs.

Terms and Conditions

1.0 Tenders should be submitted in two envelopes i.e. Part-I and Part-II. The first envelope (Part-I) should
contain Tender Cost in the form of Demand Draft /Pay order in favour of NBCC India Ltd and EMD in the
form of Demand Draft /Pay order or BG in favour of NBCC India Ltd payable at New Delhi, Valid service
tax registration/ VAT registration/ Sales Tax registration, PAN NO, Acceptance of Tender Conditions
(Annexure-II). Second envelope (Part-II) should contain quoting sheet/Price bid(Annexure-A) as per
prescribed format enclosed. Tenders received without requisite Tender Cost & EMD shall be rejected.
Tender Cost & EMD submitted by the tenderer in any other form will not be accepted. No interest shall be
payable on EMD.

2.0 Tender documents duly completed and signed on each page by authorized signatory, should be
submitted without any mutilation or alteration, failing which tenders are liable for rejection.

3.0 The tenderer/agencies may inspect the site before submitting their tender in their own interest. No claim,
whatsoever on this account shall be entertained after opening of the tender.

4.0 The rate/price shall be quoted strictly as per BOQ format (Annexure-A). Any other format of quoting the
price including putting any condition shall make the bid liable for rejection.

5.0 The tenderer should quote the rate clearly both in words and figure. Rates should also be prefixed by the
words Rs./Rupees respectively and avoid overwriting. All cutting /overwriting if any should be signed by
the tenderer.

6.0 Reserve Price of Good Earth is Rs. 45.00/Cum.

7.0 Proof of royalty submission documents shall be submitted by agency after completion of work (if any).

8.0 Quoted price will be included lifting and loading charges from the site strictly.

9.0 In tender, Quantity of good earth is approximate and may be excess or reduce.

10.0 Measurement of earth will be as per CPWD norms.

11.0 The rate quoted by the tenderer shall be valid for 150 (One Hundred Fifty) days from the date of opening
of the tender.

12.0 Date of Start of work shall be reckoned from the 3rd day from issue of the letter of Award (LOA)/ Letter of
Intent (LOI) by NBCC.

13.0 The successful tenderer will have to deposit 1.10 times the amount of the Quoted price in Indian Rupees
on the basis of accepted price/rate in one installment within 07 (seven) days from the date of issue of
Letter of Award, to NBCC in the shape of DD/PO in favour of NBCC India Ltd. payable at New Delhi. If the
successful tenderer fails to deposit 1.10 times the amount of the quoted price as per Letter of Award (LoA)
of NBCC within 07 days and/or fails to commence the work within 10 days of LoA, the Earnest Money
Deposit of the successful tenderer will be forfeited.

14.0 If the successful tenderer fails to complete the work in all respect within 30 days of LoA, the 1.10 times of
quoted price amount will be forfeited. No claim will been entertained.

15.0 After completion of the work, the unadjusted amount of deposit will be returned to the contractor within 15
days after adjusting the sale voucher.

16.0 In the event of non-compliance of any terms and conditions mentioned herein, the NBCC reserves the right
to cancel the award of work and forfeit the amount deposited towards 1.10 times the quoted price and take
appropriate action without further reference to the agency.

17.0 NBCC reserves the right to reject any or all the tenders in part or full without assigning any reason
whatsoever. NBCC does not bind itself to accept the Highest tender. NBCC reserves the right to award
the work to a single party or split the work amongst two or more parties as deemed necessary without
assigning any reason thereof. The Contractor is bound to accept the part work as offered by NBCC after
split up at the quoted/negotiated rates.

18.0 In the event of dispute, only courts at New Delhi/Delhi will have jurisdiction to decide the matter.

tender for the above work and I/We hereby unconditionally accept the tender
conditions and tender documents in its entirety for the above work.

ii) I/we are eligible to submit the tender for the subject tender and I/We are in
possession of all the documents required.

iii) I/We have viewed and read the terms and conditions of this tender. I/We have

iv) I/we have submitted the mandatory documents such as cost of tender
document, EMD and other documents as per Notice Inviting e-tender AND I/We
agree to pay the cost of tender document, EMD and other documents in physical
form in the form and manner as described in NIT.
v) Should this tender be accepted, I/We agree to abide by and fulfill all terms and
conditions referred to above and as contained in tender documents elsewhere and
in default thereof, to forfeit and pay NBCC, or its successors or its authorized
nominees such sums of money as are stipulated in the notice inviting tenders and
tender documents.

vi) If I/we fail to submit the 1.1 times of quoted amount within 7 days from
issue of Letter of Award or commence the work within 7 days of the date of
issue of Letter of Award, I/we agree that NBCC shall, without prejudice to any
other right or remedy, be at liberty to cancel the Letter of Award and to forfeit the
said earnest money as specified above.
