SUIT FOR RENDITION OF ACCOUNTS

EX-PARTE JUDGMENT

I intend to decide the above captioned suit through this

ex-parte judgment.

2. The averments of the plaint are that plaintiff obtained

the loan of Rs.51,500/- and handed over her gold ornaments as

guarantee to the Micro Finance Bank Limited

Hafizabad/defendants. When she approached the bank to return

the loan and to receive back her gold ornaments, the bank deferred

the clearance of the loan of the plaintiff on different pretexts and

have declined to return her gold ornaments. Hence this suit for

rendition of accounts.

3. On the other hand, defendants were summoned

through notices as well as substituted service. No one appeared on

behalf of defendant No. 1 & 4. Hence, they were proceeded against

ex-parte. Whereas on 07.09.2018 plaintiff withdraw the suit against

the defendant No. 2 and 3 and plaintiffs were directed to produce

their ex-parte evidence.

4. In their ex-parte evidence, Najma Shahzadi (plaintiff)

herself appeared as PW.1. In documentary evidence, Copy of Loan

Schedule as Mark-A and copy of notice to Micro Finance Bank as

Mark-B were submitted and closed the evidence.

5. Arguments heard and record perused.

6. Perusal of file reveals that Najma Shahzadi appeared

into witness box as PW.1 and she deposed in her evidence that she

obtained the loan of Rs.51,500/- and handed over her gold

ornaments as guarantee to the Micro Finance Bank Limited

Hafizabad/defendants. When she approached the bank to return

the loan and demanded back her gold ornaments, the bank paid no

heed to her contention.

7. Perusal of copy of loan schedule as Mark-A reveals that

plaintiff Najma Shahzadi obtained the loan of Rs.51,500/- and

handed over her gold ornaments as grantee to the Micro Finance

Bank Limited Hafizabad. Furthermore, there is nothing available

against the plaintiff to rebut her claim; hence, this court has no

option except to believe the version of the plaintiff.

8. In view of what have been discussed above, suit of the


plaintiff is hereby ex-parte decreed as prayed for. No order as to
cost. Decree sheet be prepared accordingly. File be consigned to
record room after its due completion and compilation.
