AN ORDINANCE ENACTING THE OFFICIAL TRANSFER AND FORMAL

DECLARATION OF THE SEAT OF LOCAL GOVERNMENT UNIT OF SINILOAN,


PROVINCE OF LAGUNA, PHILIPPINES TO THE NEWLY CONSTRUCTED 2-
STOREY MULTI-PURPOSE HALL BUILDING LOCATED AT G. REDOR ST. BRGY.
M. PANDEÑO, SINILOAN, LAGUNA TO BE KNOWN AS THE NEW MUNICIPAL
HALL OF SINILOAN, LAGUNA.

WHEREAS, it is stated in SECTION 447, item (a), of the Local Government Code of
1991 that the Sangguniang Bayan, as the legislative body of the municipality, shall enact
ordinances, approve resolutions and appropriate funds for the general welfare of the municipality
and its inhabitants pursuant to Section 16 of this Code and in the proper exercise of the corporate
powers of the municipality as provided for under Section 22 of this Code;

WHEREAS, pursuant to SECTION 447, item (a) (i) of the Local Government Code of
1991, the Sangguniang Bayan shall approve ordinances and pass resolutions necessary for an
efficient and effective municipal government;

WHEREAS, SECTION 11 of the Local Government Code of 1991 provides that:

(a) The law or ordinance creating or merging local government units shall specify the
seat of government from where governmental and corporate services shall be delivered.
In selecting said site, factors relating to geographical centrality, accessibility,
availability of transportation and communication facilities, drainage and sanitation,
development and economic progress, and other relevant considerations shall be taken
into account.”

(b) When conditions and developments in the local government unit concerned have
significantly changed subsequent to the establishment of the seat of government, its
sanggunian may, after public hearing and by a vote of two-thirds (2/3) of all its
members, transfer the same to a site better suited to its needs. Provided, however, That
no such transfer shall be made outside the territorial boundaries of the local government
unit concerned.

(c) Local government offices and facilities shall not be transferred, relocated, or
converted to other uses unless public hearings are first conducted for the purpose and
the concurrence of the majority of all the members of the sanggunian concerned is
obtained.

WHEREAS, the Municipality has conducted series of governmental and public


consultations wherein other arrangements such as assessing the site location of which is best
suited to the present need and anticipated future development and progress; acquiring lot
donations adjacent to the intended new local government site; corresponding bidding for Multi-
Purpose Hall construction; obtainability of appropriate Program of Works; procurement and
appropriation of funds; and other applicable feasibility study, were formulated, implemented and
agreed upon;

WHEREAS, the Municipality implemented the construction of a 2-storey Multi-


Purpose Hall Building in G. Redor St. Brgy. M. Pandeño, Siniloan, Laguna purposely to
accommodate the offices and facilities of the local government unit and with its completion the
building is now occupied and is serving its purpose as the new municipal hall building;
WHEREAS, the Sangguniang Bayan, in compliance to the requirements implied by
Section 11 of the Local Government Code of 1991, has conducted series of ‘Public Hearings’
together with the municipal department heads, barangay officials, set of representative from
different local sectors, and other NGO’s and PO’s, to obtain their opinion, position and
commentary regarding the transfer of the seat of municipal local government to the newly
constructed Multi-Purpose Hall Building at G. Redor St. Brgy. M. Pandeño, Siniloan, Laguna;

WHEREAS, for all legal intents, the new seat government will be known officially as
the Municipal Hall of the Municipality of Siniloan, Province of Laguna, Philippines;

NOW THEREFORE, on motion of all members of the Sangguniang Bayan present in


the session duly assembled, it was

RESOLVED, as it is hereby resolved, to enact an Ordinance as follows:

ORDINANCE NO. ___, S. 2020

SECTION 1. TITLE. This Ordinance shall be known as: “The New Municipal Hall
Ordinance of Siniloan, Laguna”;

SECTION 2. STATEMENT OF PURPOSE. This ordinance aims to declare the new


official location of seat government of the Municipality of Siniloan, Laguna;

SECTION 3. TRANSFER OF SEAT GOVERNMENT. That the seat of local


government unit of Siniloan, Laguna, currently established in the Municipal Hall Building
located at Brgy. Bagumbarangay, Siniloan, Laguna, is hereby officially transferred to the new
Multi-Purpose Hall Building constructed at G. Redor St. Brgy. M. Pandeño, Siniloan, Laguna;

SECTION 4. DECLARATION OF THE NEW MUNICIPAL HALL. It is hereby


declared that the new seat of local government unit of Siniloan, Laguna be known as the
“Municipal Hall of Siniloan, Laguna” be officially established and instituted in the new 2-
Storey Multi-Purpose Hall situated at G. Redor St. Brgy. M. Pandeño, Siniloan, Laguna upon
effectivity of this ordinance;

SECTION 5. SEPARABILITY CLAUSE. If for any reason, any section of the


provision of this ordinance shall be held to be unconstitutional or invalid by any court of
competent jurisdiction, such judgment shall not affect or impair the other provisions thereof
which shall continue to be in force and effect;

SECTION 6. REPEALING CLAUSE. All ordinances, rules and regulations, or parts


thereof, in conflict with, or inconsistent with the provisions of this ordinance are hereby repealed
or modified accordingly;
SECTION 7. EFFECTIVITY. This Ordinance shall take in full effect upon complete
compliance to Section 11 of the Local Government Code of 1991 and upon approval of the
Sangguniang Bayan of Siniloan, Laguna.
