General Instructions
1. You have to join the main call of Google Meet at 4:30 pm.
2. Problem will be released to your mail id by 4:45 pm.
3. You will get a preparation time of 15 mins.
4. You will have to join the new Google Meet link for the examination at 5:00 pm.
5. You have to start the negotiation at 5:05 pm.
6. You will have to mandatorily record the negotiation examination as the recordings will be
evaluated.
7. You will have to end the negotiation examination at 5:25 pm and stop the recording.

Negotiation Problem, Side-A


General Information for the party/ies of Side-A of the Negotiation:

You are Role Playing as the lawyer of Ms. Savita, the employee, in the negotiation process.

Ms. Suman employed Ms. Savita as a helper to the type setter in her printing press at a salary
of Rs. 5000/- per month. Unfortunately, within four days of joining, she was asked to operate
the printing machine. While doing so her hand got stuck in the machine. Her index finger was
completely severed. She was rushed to the hospital but her finger could not be stitched back
as it was badly crushed. Suman paid the hospital expenses of Rs. 10000/- and offered to pay
another Rs.100000/- as compensation for the loss of finger.

Savita is engaged and her marriage is fixed to be held in the next two months. And it is of
utmost importance to her that she must have a job at the time of marriage as having some
extra income is very essential for her prospective in-law’s family. She has not told her fiancé
and his family about the loss of finger and the job for the fear that they will break the
engagement. One of the conditions of marriage is that the girl should be working so as to
bring some income to the household. Her marriage prospects may get jeopardised if she does
not have a job at the time of marriage.

Savita will not be able to get any future prospect in type-setting field without her index finger
but she is willing to work in any alternative employment in the press as it is of utmost
importance that she remains employed.
Savita’s job prospects as well as her day-to-day life has been severely affected, she wants a
substantial compensation of about Rs. 10 lakhs but she may settle for Rs.7 lakhs also. Her
first preference is a long-term support mechanism for her living. She is higher secondary pass
and is 25 years of age. She is unmarried and lives with her parents at the moment.

Savita is legally entitled to receive compensation but she does not have the wherewithal of
pursuing a legal case against her employer and she needs a job now so that her marriage is
not affected.
