Part 3: Prioritise 3 actions with justification for the selection
Suggested word counts
Moral, general legal and financial arguments for all actions: 300 to 350 words
For EACH action:
Specific legal arguments: 100 to 150 words
Likelihood AND severity: 75 to 150 words
How effective the action is likely to be in controlling the risk: 100 to 150 words

Moral, general legal and financial arguments for ALL actions

Moral, general legal and financial arguments M/S Vijay Nirman Company pvt.ltd is one of the leading construction company in India. My
organisation has successfully completed many prestigious project with in given time with
zero Lost time injuries (LTI) IN MANY PROJECTS. My organisation shows commitment
towards the employee’s safety and health.my organisation strictly follows the moral duties
to protect all the workers. The workers from M/S Vijay Nirman Company are from different
places has came form different states in India to earn money by doing works. It was the
organisation basic responsibilities not to put the workers in risk and get them into risk of
falling illness. Injuries for the workers will impact the health and lives of the workers and
there families and friends and environment. Long term injuries(LTI) will also have major
impact on workers mental health.
As per my prioritizing the accident and ill health have a great financial impact upon the
organisation . so the organisation should follow possible enforcement actions which may
involves such as stopping of all the work in the site , or necessary improvements that
needs to be done in a particular set period of time by the notices related to the activities by
the regulator commissions.
Financial argument’s impacts could be also shown in the organisation are:
● Injured workers (compensation, medical treatment, replacement of new worker, lost
time work, sick leaves, wages, pensions etc.)
● Legal fines or cost associated with law enforcement actions.

Learner number:00551016 Learner name: BURIDI KIRAN KUMAR Page 13 of 19

● Replacement or repair of the equipment’s that has been damaged are need to be
brought.
● The organisation has more problem with Delay of project , activation of the penalty
clauses, loss of trust among the clients and thus loosing is business.

The poor health and safety standards also triggers enforcement actions because in the
legal standards which the M/S Vijay Nirman Company has the obligation to comply with
such as the ILO Convention C155, THE OCCUPATIONAL SAFETY AND HEALTH
CONVENTION, 1981 and recommendation R164 has the obligation upon the employer to
make the work place as far as reasonably practicable from the equipment’s, machines,
process are safe to use. The ILO’S COP safety and health in the usage of machinery;
section 8.5 requires that all the lifting equipment’s and machinery should be maintained,
tested and inspected at appropriate intervals. Failure to do this things could have serious
repercussions, including the workers compensation claims. The organisation should also
find the civil claims from workers made ill by these work activities could be made. Failure of
thee could loss the reputation of the organisation.

Justification for action 1

Action There are more issues surrounding and carrying out at work at height . in construction site
more accidents are due to work at height. So 3 rd party certification should be done for all
the scaffolders and trained riggers (hazard category work at height)

Specific legal arguments As per the INTERNATIONAL LABOUR ORGANIZATION SAFETY AND HEALTH IN
CONSTRUCTION CONVENTION , 1988(No 167) Article 14”. According to building and
other construction workers Act Rules 42(6,7) state that whenever workers at a building
or other construction work are exposed to the hazards of falling from height, need to be
provided with adequate equipment or mean for saving them and if there is a possibility of
falling any materials, or building worker at a construction site relating to a building or other

Learner number:00551016 Learner name: BURIDI KIRAN KUMAR Page 14 of 19

constructions work, adequate and suitable safety nets shall be provided by employers in
accordance with the national standards.

Consideration of likelihood AND severity Likelihood is that workers will get injuries for falling from height without any proper PPE for
persons and without any proper tie for tool lanyards as the scaffolding is above 7meters,
which is very high and the scaffolders are constantly moving up and down to one side to
other side. So the chance of falling is very high as they are using tools like hammers
So that severity of getting injuries is high workers fall or material fall
from the height may cause serious damage to persons because the height is 7meters . if
the scaffold may collapse it may leads to death.
How effective the action is likely to be in
controlling the risk. This should include: • For complying with above laws includes the moral , legal, and financial reasons as it
● the intended impact of the action; is a legal required on the organization to safe workplace, safe work equipment, PPE,
● justification for the timescale that you safe system of work. The 3rd party certification to the scaffolder’s , and also in the
indicated in your risk assessment; event of any accident the organization may face direct on indirect cost which may be
and very high. So, in order to avoid the legal action and financial issues the organization
● whether you think the action will fully has to comply with the above mentioned laws and requirements.
control the risk. • So I have given the management a time period of 2months for getting the 3rd party
certified trained people for work at height activities as it is highly required activity to
continue the project for further without any interruption.

Justification for action 2

Action Purchasing of local ventilation system for chipping and carpentry operation including for
local ventilation system (hazard category hazardous substance)

Learner number:00551016 Learner name: BURIDI KIRAN KUMAR Page 15 of 19

Specific legal arguments According to the INTERNATIONAL LABOUR ORGANIZATIONS (ILO) convention C155
and recommendation R164 employees need to make sure that process are responsible
and safe.
Where workers are exposed to the hazardous silica dust and wooden sauce dust
powder and the employees should be required do limit exposure to such silica and wooden
dust so as to protect the health of workers chemicals at workplace measures should be
taken by employees to protect workers against hazards arising from the use of chemicals
at work. The ILO code of practise recording and notification of health and occupational
accidents and diseases requires employees to report causes of occupational asthmas and
lungs disorders to health and safety regulation of the country.
Consideration of likelihood AND severity Chipping and carpentry works both has more chance of workers becoming ill-healing silica
dust and wooden sauce dust, so the likelihood of getting effected to the silica dust is very
high. Workers in the silica dust area and people outside the area are also getting exposed
to the dangerous waste and dust which will have both short-term effects(burning eyes,
watering headaches, throat pain, dermatitis and respiratory system effects. Regular face
mask or respiratory mask cannot suffice the risk.
When considering the severity I would like to set them into 4 different categories.
a) Minimal : No injury or damage occurred.
b) Minor : Injury requiring first aid or slightly damage causes to plant equipment’s/
buildings.
c) Major : Injury require hospital admission / stay and /or signification damage to
plant / equipment/buildings.
d) Catastrophic : Death or irreplaceable damage to plant / equipment’s / buildings.

The severity is likely to be minor to major for workers carrying out the activities or those
who are nearby passers or nearby working . for members of passers . it is likely to be
minimal as they will rarely pass by the area and will not directly get in contact with the
activity area where the work is going on.

Learner number:00551016 Learner name: BURIDI KIRAN KUMAR Page 16 of 19

How effective the action is likely to be in
controlling the risk. This should include: • The actions which will be taken have a high impact on the majority of the workforce
and reducing the amount of dust in the working area and encloser will stop further
● the intended impact of the action;
spread .
● justification for the timescale that you
indicated in your risk assessment; • so I have given a time period of 3months for the management for the exhaust
and ventilation system installation due to its immediate need. I would hope that this will
● whether you think the action will fully be useful for the workers and employees from reducing the impact of its longer
control the risk. concentration on the skin or any body parts intact.

Justification for action 3

Action Proper earthing and tripping should be carried out for the electrical generators and
equipment’s (hazard category electrical hazard)
Specific legal arguments The International ILO Legislation of C-155 Occupational Health and Safety
convention 1981 and Electricity at work regulations 1989 (EAWR), National
legislation where workers get contact with electricity the main electric power supply for the
entire construction site is located near a container area there is no signage of danger and
unprotected and no casing can led to electrocution, burns and secondary effects like fire
may catch to combustible material near to it this may cause serious damage to workers. so
employees should protect there workers against hazards arising from the electricity.
Consideration of likelihood AND severity The likelihood is that the workers may get contact with the electricity with out any proper
electrical ling and earthing of the material . this is due to the electrical DG generator is
mostly used for the entire electricity for the site . The DG generator is the main source of
electricity for the site so it is continuously used. While operating the workers get contact
directly with the electricity .
So the severity of electric shock may cause high damage to person like burns, even death
and secondary death such as fall height by being victim thrown off due to electrocution and
fall into ground may cause head injury or serious fracture.
How effective the action is likely to be in
controlling the risk. This should include: ● This action will have a major impact on the workforce , if any electrical accident may
occur it may results huge compensation claims , production and financial losses
● the intended impact of the action;
prosecution notices and fines , manpower replacement, reputation loss for the

Learner number:00551016 Learner name: BURIDI KIRAN KUMAR Page 17 of 19

● justification for the timescale that you company, lost time due to accident investigation and subsequent remedial actions of

Part 4: Review, communicate and check
Suggested word counts for each section:
● Planned review date or period and reasoning for this: 50 - 100 words
● How the risk assessment findings will be communicated and who needs to know the information: 100 - 150 words
● Follow up on the risk assessment: 100 - 150 words.

Planned review date/period with reasoning As per the M/S Vijay Nirman Company’s health and safety policy document. I identified that
the review of the risk assessment must be in every 12months period. which will be on
October 2021, so therefore I set the review of risk assessment date to be no later than 29
October 2021. However, I will inform the management to make sure that it will be reviewed
early before the above-mentioned date as there will be some significant changes in.
a) The total number of workers coming and going out of the project and also there wil
be some shift changes to some of the workers from night shift to day shift.
b) There should be a strict law enforcement rules to be adopted due to the covid-19
situations.
c) Purchasing of new machinery and equipment’s for the related work.
d) Changes in the site regulations and rules as the project is moulding from construction to pre-
commissioning stage.
How the risk assessment findings will be As per my finding and risk assessment final stage, I need to report to the higher,
communicated AND who you need to tell
management of the organisation such as project manager, construction manager, site
manager, safety manager, site supervisors, store managers, procurement officers, admin
manager . so as to discuss the risk assessment and finding that I found during my
walkthrough for risk assessment of work activities and site environment and condition. I will
providing a printed copy of all my findings to all the responsible persons who can take actions
and rectify the findings which observed in accordance to their immediate action so as to run
the site or work area further more safely both to workers and organisation. I will also make
an individual appointment with the department heads directly face to face to discuss and

Learner number:00551016 Learner name: BURIDI KIRAN KUMAR Page 18 of 19

narrate them the importance of rectifying the prioritized issues immediately in order to avoid
any legal and financial actions against the organization. I will request them to make sure the
work area will be safe on daily basis before start and end of the work shift.

I will give all the department heads the next review date to follow up on the issues that
have been raised in my risk assessment. I would also like to discuss this with my fellow
safety staff to follow up on the resolution of the issues that mentioned to the higher
