EXPLANATION WITH URGENT MOTION TO
LIFT WARRANT OF ARREST; AND REINSTATEMENT OF BOND

ACCUSED, thru counsel and unto this Honorable Court respectfully

alleges:

1. That herein accused stand charged of the above-entitled case before this
Honorable Court;

2. That on January 25, 2021, accused failed to appear before the Honorable
Court, thus, a bench warrant was subsequently issued against him and
his previous bond for provisional liberty was subjected for cancellation
and forfeiture in favor of the government;

3. That on January 22, 2021, accused had been hospitalized due to vertigo
and the medical doctor who examined the accused advised him that he
needed to rest for at least a week and to refrain from doing strenuous
activities. A copy of his medical certificate is herein attached as Annex
“A”;

4. That accused sincerely apologizes to this Honorable Court and the other
party for whatever inconveniences his actions may have caused;

5. That accused shall endeavor to attend all succeeding hearings in the

above-captioned case. If accused anticipates that he may not be able to
appear for just and valid reasons, he shall immediately inform this
Honorable Court;

6. That this motion is not intended to delay the proceedings of this case
but solely for the reasons stated above.

WHEREORE, it is respectfully prayed that this Explanation be noted as

satisfactory and the Bench Warrant of arrest against accused as well as
confiscation of his bond be lifted and set aside by this Honorable Court.
 Such other relief and remedies just and equitable in the premises are
likewise prayed for.
