EXTRA-JUDICIAL 

SETTLEMENT OF REAL ESTATE


WITH WAIVER AND RENUNCIATION OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, ROMUALDO D. DOMINGO died intestate, in Agana, Guam


on October 4, 2016. Leaving no will nor debts settled to date but leaving one (1)
parcel of land situated at the J. Cailles St., Calamba City, Province of Laguna;

WHEREAS, at the time of their death, they left as forced heirs, the
following and to wit:

1. Iluminosa C. Domingo, American Citizen, 92 years old, with residence


at 1989 E. Haller St. Covina CA 91724;
2. Maria Christina C. Domingo, American Citizen, 58 years old, with
residence at 1989 E. Haller St. Covina CA 91724;
3. Julius Cesar C. Domingo, American Citizen, 55 years old, with residence
at 2048 S. Bonview Ave. Unit E. Ontario CA 91761;

WHEREAS, they are all the legal and compulsory heirs and who are
supposed to inherit by way of intestate succession;

WHEREAS, at the time of their death, they left one (1) parcel of land
together with its improvement thereon and covered by Transfer Certificate of
Title No. T-622345, Registry of Deeds of Calamba City, containing a total area of
Four Hundred Sixteen (416) SQUARE METERS, more or less, and more
particularly described as follows:

“A parcel of land (Lot 564 of the Calamba Estate, G.L.R.O. Rec No.
8418), situated in the Municipality of Calamba, Province of Laguna,
Island of Luzon. Bounded on the N., by Lot No. 565; on the E., by
Lot No. 571, on the S., by Lot No. 563; and on the W., by Road ….
containing an area of FOUR HUNDRED SIXTEEN SQUARE
METERS, more or less. x-x-x-x”

WHEREAS, we undertake that this Deed will be published in a newspaper


of general circulation once a week for 3 consecutive weeks;

WHEREAS, in view of the above facts and circumstances, we are therefore


co-owners and to terminate co-ownership over the same, we hereby adjudicate
over the same in pro-indiviso sharing pursuant to Section 1, Rule 74 of the Rules
of Court of the Philippines, subject to the liabilities imposed by Section 4, of the
same Rule;

WAIVER OF RIGHTS

            WHEREAS, WE, Iluminosa C. Domingo, Maria Christina C.


Domingo and Julius Cesar C. Domingo (whose personal circumstances are
mentioned above) have agreed and covenanted to CEDE, TRANSFER and
CONVEY unto ROBERTO D. DOMINGO married to JEANNIE O. DOMINGO,
his heirs and assigns the full ownership and possession of the above-described
properties.

            NOW, THEREFORE, for and in consideration of the foregoing premises,


we waived and renounced, as by these presents we hereby WAIVE and
RENOUNCE our share, right and participation over the above-described
property in favor of ROBERTO D. DOMINGO.

By virtue of this instrument, I, ROBERTO D. DOMINGO married


JEANNIE O. DOMINGO, hereby accept their waiver and renunciation.

            IN WITNESS WHEREOF, we have hereunto set our hands, this ____ day

Judicial Settlement of Real Estate with Waiver and Renunciation of Rights consist
of three (3) pages including this page have been signed by the parties and their
two (2) instrumental witnesses and signed on the left hand margin of each page.
