Contd...page 6Annexvac “A —_— CONFIDENTIAL VERIFICATION REPORT DATED 27.06,2021 A typed complaint dated 24.08.2021 in Hindi vernacular was marked to me for verification and report, | went through the contents of the complaint. | also discussed the contents of the complaint with the complainant Shri Naresh Kumar @ Naresh. Dahia, resident of Ward No.7, Pratap Colony, Village Kharkhoda, Distt. Sonepat, Haryana in detall, who was present in the office. Shri Naresh Kumar, complainant identified his signature on each page of the said complaint dated 24.06.2021 and also owned the contents of the complaint. Contents of the complaint: Shri Naresh Kumar (Complainant) in his complaint dated 24.08.2021 has alleged that he has personally very well known to Shri Gourav Kumar and his family from the last 15 years. On 30.01.2021, the complainant received a phone call from Shri ‘Sandeep, the driver of Shri Gourav Kumar. He told complainant that “Bhalya, some officers from GST Rohtak have come to resident of Shri Gourav Kumar at C-404, 2° floor, Saraswati Vihar, Pitampura Delhi". Thereafter, Complainant talked with Shri Rohit Sharma, Superintendent, through the mobile phone of Shri Sandeep, Driver and asked the reason for visiting Gourav's residence. On this, Shri Rohit Sharma, Superintendent informed that he wanted to take statement of Shri Gourav in case of any GST matter. The complainant informed Shri Rohit Shamma, Superintendent that Shri Gourav and his entire family have gone to Jagannath Puri Temple. Thereafter, he took the contact number of the complainant and informed him that he (Superintendnet) would call complainant later on. Then In the evening, Shri Rohit ‘Sharma, Superintendent called complainant Naresh and told to meet complainant tomorrow in restaurant located opposite to Baba Mastnath University, Rohtak. It is further alleged in the complaint that during meeting, complainant asked Shri Rohit Sharma, Superintendent that why had he conducted raid at residence of Shri Gouray Kumar at Delhi and what are the issue. Shri Rohit Sharma replied to complainant that on 23,08.2018, CGST Rohtak had conducted raid at some firms 1 a we Wk teviz. MIS Sarlia Rolling Mills and M/s Jindal Rolling Mills Ltd. at Hissar and when CGST officers inquired from these firms, the proprietor of above mentioned firms informed them that Shri Purushotam Goyal of Hissar sells bills of scrap to them. On. 25,08,2018, CGST officers had summoned Shri Purushotam Goyal who tendered his. statement at CGST Rohtak. In his statement, Shri Purushotam Goyal informed that ‘Shri Ankur Mittal of Meham Is working with him to sale bill. Thereafter, GST Officers summoned Shri Ankur Mittal, who appeared at CGST Rohtak on 22.08.2019 and got recorded his statement that he know Shri Gourav Kumar very well since schoo! times and they have strong family relationship and they are doing fake billing work together to eam easy money. Shri Ankur Mittal also told that he had provided [Ds and photograph to Shri Gourav Kumar for creating fake firms and as per Shri Rohit ‘Sharma, Superintendent, the said firm are involve in generating fake bill. Shri Rohit ‘Sharma found that some entries had gone through RTGS from fake firms to personal account of Shri Gouray Kumar and his family bank account. On this ground, Shri Rohit Sharma told me to make call to Shri Gaurav for giving clarification regarding theses entries. itis further alleged that during meeting, Shri Rohit Sharma Superintendent told complainant that complainant should call to Shrl Gouray Kumar for giving a statement regarding these issues. On this, complainant informed that he would discuss with Shri Gourav Kumar and will reply to him, Next day, complainant had arrangedimade phone call with Shri Gouray Kumar, Shri Rohit Sharma, Superintendent, CGST and Shri Sachin Ahlawat, IRS, DC CGST, Rohtak. During said ensuing call, Shri Rohit Sharma, Superintendent, CGST directed Shri Gourav Kumar to attend CGST office on 02.02.2021 for tendering his statement. On this, Shri Gourav Kumar informed that he will atiend office on 03.02.2021 (Wednesday) instead of Tuesday due to fasting. On 03.02.2024 (Wednesday) Complainant alongwith Shri Gourav Kumar reached GST office Rohtak at 14AM and met Shri Rohit Sharma, Superintendent and Shri Sachin Ahalawat, IRS DC CGST. Shri ‘Sachin Analwat told complainant that he can pick Shri Gourav Kumar after 02.00 PM after completion of official statement. It is further alleged that Shri Rohit Sharma, Superintendent and Shri Sachin Ahalawat, IRS DC CGST tortured Shri Gouray Kumar physically and mentally during 2 ue’the whole day. They also done misbehave and used abusive language. Shri Vikas Nain, Inspector CGST had pressurized Shri Gourav Kumar to admit totally false and concocted story for extracting bribe monay from him. Complainant received a call at 2PM from Shri Rohit Sharma, Superintendent, CGST who informed that he will not release Gourav Kumar today and directed him to come at his office to meet him. When complainant met Shri Rohit Sharma in his office, Shri Rohit Sharma demanded bribe of Rs. 2 crores in lieu of releasing Shri Gouray Kumar from the case. When complainant denied that Gourav kumar is not involved in any such case and it is not possible for him to give bribe of Rs, 2 Crores. Thereafter, above mentioned CGST officers had arrested Shri Gowrav Kumar by evening and on the same day, they got conducted the medical examination of Shri Gourav and locked ‘Shri Gourav Kumar at Urban Estate Police Station, Rohtak, Itis further alleged in the complainant that on 04.02.2021, Shri Rohit Sharma, CGST called complainant and demanded bribe of Rs.80 lacs and told that he will not arrest Nourav and Sourav, both younger brother of Gourav and he will also make delay in filing chargesheet and by doing so, Gourav will get bail automatically, if the amount of Rs. 50 lacs are paid to him. After this, Shri Rohit Sharma, Supdt. CGST continuously talking over mobile phone with complainant regarding bribe amount and is always demanding bribe of Rs.50 lacs. When, Complainant refused to pay such a huge amount, then Rohit Sharma, bargained and said, complainant can give bribe amount of Rs.35 lacs instead of 50 Lacs. He also told that he will give full relief to Shri Gouray in releasing him from this matter and will not disturb both younger brothers also. Parallelly, after few days, interim bail was granted to Shri Gourav on 17.05.2021 from District Court, Rohtak. Now, again Shri Rohit Sharma, Supdt CGST was constantly calling complainant and demanding bribe of Rs.35 lacs and saying ‘that if complainant will not pay bribe, they will arrest the younger brothers of complainant's friend Gouray and will create hurdies In getting Gourav Kumar regular ball. Shri Rohit Sharma Supdt. CGST again called complainant and directed that if he along with Gouray and his younger brothers come to his for recording their statement and if complainant will pay bribe of Rs.35 facs to him, then thay will felease all three Gourav, Sourav and Nourav cutside from this false case, 3 whOn 17.06.2021, Shri Rohit Sharma, Superintendent telephonically called me and directed to come near CGST office for meeting. On 18.06.2021, | met Shri Rohit Sharma, Superintendent near CGST office, who told me that if complainant will not pay bribe amount of Rs. 35 lacs to him, he will array complainant friend Gouray and his younger brothers in this case and directed fo get record statements of younger brothers of Shri Gourav and handover bribe amount of Rs. 35 lacs and he will manage to get the name of younger brothers of Gourav out from the ease. Shri Rohit ‘Sharma also told that he will help Gourav in getting regular bail. He also told that he can record statement of younger brothers of Gourav outside from the office. In his complaint, complainant has requested that he does not have Rs. 35 lacs to pay bribe and he is not ready to pay even this bribe amount also. The complainant has made request to take strict appropriate and prompt action against Shii Rohit Sharma, Superintendent, Shri Sachin Ahlawat IRS, DC and Shri Vikas Nata Inspector, all from Antievasion Cell, CGST, Rohtak and give justice to his fiend. Result of Verification In order to verify the genuineness of content of the complaint, | arranged one Sony DVR, one spy camera alongwith 04 fresh Memory cards of 16 GB from the office for the purpose of recording the conversations to be held between the complainant and suspect Shri Rohit Sharma, Superintendent. In order to further substantiate the allegation of demand of bribe of Rs, 35 lacs, it has been deckded to send complainant to meet suspect Rohit Sharma, Superintendent at CGST, Rohtak. ‘Thereafter, | alongwith Shri Gurpreet Singh, Constable left CBI Office Chandigarh for CGST, Rohtak on 24.06.2021 at about 12:15 PM accompanied with Shri Naresh Kumar, complainant in the private vehicle bearing No. DL. 8C AR 6929 make Innova of complainant being driven by Shri Sandeep, Driver of complainant, We reached near the CGST office at about 03:20 PM, | briefed the complainant and apprised him about the method of verification. Thereafter, it was decided to make a telephonic call to suspect Rohit Sharma for ascertaining his location. Thereafter, a fresh 16 GB Micro SD Card make Sandisk was inserted into Sony DVR and Kept the same an recording mode after switching it on, As directed, at about 3:27 PM, Shri Naresh 4Kumar made a telephonic call from his mobile number 9812763222 to mobile number 9910820259 of suspect Rohit Sharma after Keeping his mobile phone on speaker mode. The said call was recorded in the 16 GB memory card already inserted in the DVR. During the ensuing call, Shri Naresh Kumar, complainant asked suspect Rohit Shamma regarding his presence in office, On this, suspect Rohit Sharma informed complainant that he Is on rald and he will meet complainant in tomorrow morning at about 11 AM. Thereafter, the SONY DVR was switched off. Thereafter, it was decided to conduct further verification of complaint dated 24.06.2021 on 26.08.2021 and complainant was directed to report undersigned at room no. 9 of Circuit House, Rohtak at about 10 AM. On 25.06.2021, complainant Shri Naresh Sharma appeared before me at about 9:30 AM at Circuit House, Rohtak, He was again briefed and apprised the method of verification. As meeting time was fixed for 11AM at CGST office, it was decided to wait till 11 AM. At about 10.59 AM, no call was received from suspect Rohit Sharma, so it was decided to make telephonic call to suspect to ascertain his location. A fresh memory card of 16 GB was inserted in DVR and kept the same on recording mode after switching it on, As per direction, Shri Naresh Kumar made a telephonic call from his mobile number 9812763222 to mobile number 9910620259 of suspect Rohit Sharma at 10:59 AM, after keeping mobile phone of complainant on speaker mode but sald call was not picked by Shri Rohit Sharma. At about 11:00 ‘AM, phone call was received from Shri Rohit Sharma on the mobile of complainant but same was not connected well due to technical issue. Thereafter, as directed, complainant again made a phone call fo suspect Rohit Sharma but same was again not connected well. At about 11:02 AM, complainant again received call from suspect Rohit Sharma and the sald call was recorded in the 18 GB memory card already inserted in the DVR, Thereafter, the sald Sony DVR was switched off. During the ensuing call, complainant asked about the presence of suspect Rohit Sharma, ‘On this, suspect informed complainant that he will ba reaching office within 30 minutes and directed complainant to reach office in 20 minutes, As the office of suspect Rohit Sharma was nearby from the circuit house and hence It was decided to send complainant alone and we will wait for complainant for his return at circult house to avold any unwanted situation, Thereafter, a fresh 5 wememory card of 16 GB has been inserted in Spy Camera and placed the same on. person of complainant. The Sony DVR having already inserted 16GB Memory Card has also been placed on person of complainant. It was apprised to the complainant that the Spy Camera picks up the date and time randomly by default and prepares separate files at regular intervals. Thereafter, at about 11:15 AM, complainant was directed to go to office of suspect to meet him after switching both the devices on recording mode, which he did. At about 11.50AM, complainant came back at Circuit House, Rohtak. | took out the Spy Camera and DVR from the person of the complainant and switched it off. Thereafter, | enquired complainant Naresh Kumar who narrated the whole conversation held between him and suspect Rohit Sharma. | heard the whole conversation held between suspect Rohit Sharma and complainant. From the said conversation, it has been clearly substantiated demand of bribe of Rs. 35 Lakhs on the part of suspect Rohit Sharma at the behest of suspect officer Sh. Sachin Ablawat, Deputy Commissioner, CGST, Rohtak and further reduced the same to Rs.30 Lakhs on the request of the complainant. From the above said recorded conversation, it has been substantiated that accused Rohit Sharma is demanding bribe of Rs, 30 Lakhs from the complainant, Nowever in order to further clarify the role of Sh, Sachin Ahlawat, DC, CGST, Rohtak, it has been decided that complainant would again telephonically contact suspect Rohit Sharma and request him ® make arrangement of his meeting with x \suspect Sachin Ahlawat for confirmation of his work as discussed with Rohit Sharma and further to request to make payment of bribe money of Rs.30 Lakh in two installment of Rs. 15 Lakh each, At this complainant informed that suspect Rohit Sharma will not talk about bribe money on normal telephonic call, however, he will take the call when complainant will call on his whatsapp number and can also arrange whatsapp call with suspeot Sachin Ahlawat through his mobile phone. Accordingly, at about 2.11PM, whatsapp call was made from the mobile number 9812763222 of complainant Naresh to the mobile number 9910620259 of suspect Rohit Sharma, The said call was not attended by suspect Rohit Shama. The said call was recorded in DVR. At this complainant informed that suspect Rehit Sharma fs also using another mobile number i.e. 9812480411. At about 2.12 PM, complainant made a whatsapp call at mobile number 9812480411 of suspect Rohit Sharma from his above said mobile number. The said call was attended by suspect Rohit Sharma. Thereafter, at about 2.58PM, a whatsapp call was received from the mobile number 9812480411 of suspect Rohit Sharma to above said mobile of complainant. At about 3.40 PM, he retumed back to Circuit House, Rohtak. | took out the DVR from the person of the complainant and switched it off. Thereafter, | enquired complainant Naresh who Informed that affer reaching the CGST office, Rohtak, he was taken to the office room of suspect Sachin Ahlawat by suspect Rohit Sharma. Complainant narrated the whole conversation held among suspect officers Sachin Ahlawat, Rohit Sharma and compfainant Naresh Kumar. | heard the whole conversation held between suspect Rohit.Sharma, Sachin Ahlawat and complainant. From the sald conversation, it has been substantiated that Rohit Sharma is demanding bribe from complainant at the behest of suspect officer Sh. Sachin Ahlawat, Deputy Commissioner, GGST, Rohtak, During the said conversation, when complainant told suspect Sachin Ahlawat about the giving amount, instead of asking complainant about the same, suspect Sachin Ahlawat, DC told complainant to check official file pertaining to the case of complainant fiend and given assurance that he has already told to suspect Rohit Sharma to finalize the work related to complainant, which cleatly establish the role of, suspect Sachin Ahlawat as @ conspirator in conspiracy of extract bribe money of Rs, 30 Lakhs from complainant. During conversation with complainant, suspect Sachin Ablawat was in the knowledge of matter for which conversation was being held. I directed the complainant Shri Naresh Kumar to arrange bribe amount of Rs. 16 tacs as first installment to be handed over the suspect persons on Monday i.e. 28.06.2021. The conversation held between the complainant and suspect officials 2 al verecorded in memory cards inserted in Sony DVR and Spy Camera were copied in my official Laptop. i heard the said conversation with the help of earphone. The transoription of conversations recorded in 16 GB Micro SD card Make SanDisk hes been prepared by me, which is enclosed herewith. Three memory cards of 16 GB each, which were used for the purpose of verification of this instant complaint, are in my custody, which will be handed over to the TLO. Recommendation ‘The mere fact that the suspect Rohit Sharma, Superintendent has taken the complainant to the office Chamber of suspect Sachin Ahlawat, Dy. Commissioner, where the complainant has met him and the instant matter of the complainant was discussed with suspect Sachin Ahlawat in the presence of the suspect Rohit Shama is very incriminating, as the suspect Rohit Sharma is demanding bribe for the same matter on behalf of suspect Sachin Ahlawat which was discussed by Sh. Sachin Ahlawat, Dy. Commissioner with the complainant. The subject matter of the discussion held are the allegations of the instant complaint. It is clear from the conversation that the complainant has told suspect Rohit ‘Sharma that he was afraid of bringing his friend Gourav to meet him, but despite of his fear, he had brought his friend to him and he had been arrested. In this context, the complainant told suspect Sachin Ahlawat, Dy. Commissioner that he is afraid, despite of making payments, his work may not be done, More so, suspect Sachin Ahlawat has also told the complainant to see his file in this regard. Suspect Sachin Ablawat has said that he could not give more guarantee than this for getting his work done. The factum of conversation makes it amply clear that suspect Sachin Ahlawat has given assurance to the complainant that his work would be done, Besides the above factors, suspect Sachin Ahlawat in the conversation had told the complainant that suspect Rohit Sharma has already been directed by him for getting his work done. The entire conversation of complainant Naresh Kumar has taken place in officer chamber of Sachin Ahlawat in presence of Rohit Sharma, leaves no iota of doubt that the Rohit Sahrma is demanding bribe of Rs. 30 Lacs from the complainant ‘on behalf of Sachin Ahlawat. The link of chains as established by the conversation 23 > av qeheld between the complainant and Rohit Sharma in the presence of the Sachin Ahlawat clearly reveals that the suspect Rohit Sharma is demanding bribe from the complainant on behalf of suspect Sachin Ahlawat for getting the work done of complainant. Thus, shows intension of suspect Sachin Ahlawat for collecting bribe from the complainant through suspect Rohit Sharma. In the Tight of the above mentioned facts, it is recommended that a regular case may please be registered u/s 120-B of IPC and section 7 of Prevention of Corruption Act, 1988 (as amended in 2018) against suspect Sachin Ahlawat, Dy. Commissioner and suspect Rohit Sharma, Superintendent, both from CGST office, Rohtak for demanding bribe of Rs. 30 Laos for getting the matter resolved.
