JOINT AFFIDAVIT OF THIRD PARTY CLAIM

We, MARISSA C. GO – HEVERA and MARISOL C. GO-BUAN, both of legal

age, Filipinos, married and with residence at No. 34 Unit- A Halcon I St. Quezon City,
and No. 36 Halcon I St., Quezon City, respectively, after being sworn to in accordance
with law, hereby depose and state that:

1. We, MARISSA and MARISOL, together with Jesus Manuel C. Go, the
legitimate children of Spouses Manuel and Angelita Go, are the registered owner of two
(2) parcels of land covered by Transfer Certificate of Title Nos. 214800 and 220996
issued by the Registry of Deeds for Manila. Attached as ANNEXES “A” and ”B” are
copies of the Transfer Certificate of Title Nos. 214800 and 220996.

2. Since the said realties are titled on us, we have not executed any partition
among ourselves on any of the properties.

3. We are in actual and peaceful possession of the properties since time

immemorial even before the realties were registered in our names.

4. We were surprised that our co-owned property is levied upon by Sheriff

Ricardo Albano to the detriment of our legitimate rights and interests on the realties.
We learned that said properties as subject of a Sheriff’s Sale on 23 March 2007.

5. We are not privies to the subject transaction of plaintiffs Jesus Manuel Go

and Lani Go, thus, we should not be prejudiced by any adverse consequence of said
transaction and the instant case.

6. We are executing this Affidavit to attest to the truth of the foregoing facts, to
establish our rightful title and possession over the realties covered by Transfer
Certificate of Title Nos. 214800 and 220996 and to discharge the same properties from
levy on execution pursuant to Section 16, Rule 39 of the 1997 Rules of Civil Procedure.

IN WITNESS WHEREOF, we have hereunto set our hands at Quezon City, this

EXPLANATION

The foregoing Joint Affidavit of Third Party Claim is filed personally with the
Honorable Court and Sheriff Albano while a copy thereof served on the other party’s
counsel by registered mail because of time and personnel constraints.
