Dear Mr. Mroz,

As you know, we have been building up the Online Animation Library (OAL) for approximately ten
years now. The OAL is a database that is structured according to classical library criteria and with
keyword indexing for aspects specific to animated film. Our aim was to provide film enthusiasts,
academics, students and people working in the film industry with a tool for research and scientific
investigation. We sought to increase the level of awareness for animated films overall, to make
them more visible and also accessible for interested members of the public for research
purposes, to support the industry in its efforts and to be an important partner. We have spent
considerable amounts of funding on setting up and operating the OAL and the feedback we have
received from the industry has always been very positive.

As you provided your consent, the OAL also stores audiovisual media which you hold the rights
to. Over the past few weeks, some uncertainty has arisen as to whether, when strict legal criteria
are applied, the declaration of consent which you agreed to really did comprehensively grant all
the rights necessary for providing access to the OAL. Despite this uncertainty, we are of the
opinion that all the rights holders who permitted us to make their works accessible in the OAL
were in agreement with the use we made of them, as the use was in their interests and was even
explicitly desired by them. This is why we would like to establish contact with you and ask you
whether our assumption is correct. We are sorry that the wording of the grant of rights was not
sufficiently precise or comprehensive. Please advise us whether you are in agreement with the
past use of your audiovisual works described below.

The mentioned audiovisual media are the following (Should you no longer own the rights
of some of the mentioned titles, please label them accordingly):

The Squarified

In the past, the audiovisual media have been used as follows during limited periods of time of
different length:

- Through accessing the OAL for password-protected viewing by library users at 1-3
stationary viewing units in the public library (Stadtbibliothek) in Stuttgart;

- Through accessing the OAL for password-protected viewing at 4 stationary viewing units
in the library of Nanyang Technological University Singapore by authorized university employees
and students for scientific purposes and research purposes;

- Through accessing the OAL for password-protected viewing at one stationary viewing unit
at the DEFA-Stiftung (DEFA Foundation) by authorized employees and voluntary workers for
scientific purposes;

- Through accessing the OAL for password-protected viewing at 3 stationary viewing units
in the library of the Filmuniversität Babelsberg Konrad Wolf (Film University Babelsberg Konrad
Wolf) by authorized employees and students for scientific purposes;

- Through establishing 13 access points for employees of the Goethe-Institut (Goethe


Institute) for password-protected viewing from any location for scientific and curatorial purposes;

- Through accessing the OAL for password-protected viewing at 3 stationary viewing units
in the library of the Hochschule der Medien Stuttgart (University of the Media) by students and
employees of the university for scientific purposes. In addition, professors were able to have
password-protected access to the OAL for teaching purposes from any location during seminars
and lectures. Viewing was not, however, possible from more than three viewing units at the same
time.

The use of the audiovisual works in the OAL was always enabled by streaming. It was not
possible to download works. Use was exclusively non-commercial. No rights of presentation or
other rights were granted. The rights of use solely served for search, training, research and
scientific purposes. Every OAL user was given an identification number which was superimposed
as a watermark on the audiovisual works.

As our technical services provider will no longer be available to further develop and maintain the
OAL in future, we have decided to discontinue the provision of access to the cooperation parties
named above for the time being. We could, however, envisage putting the project on a different
technological foundation and a new contractual basis if the rights holders are fundamentally
interested in this.

Please therefore give us an indication of whether you are still basically interested in having your
films made accessible in a database such as the OAL to the groups of addressees described
above for the named purposes. We will then be able to take this into consideration in any future
planning in this respect.
