SECURITY BOND

This security bond is executed by Sh. Munshi Ram S/o Sh. Pokhar,
Mukesh Kumar S/o Sh. Munshi Ram and Rakesh Kumar S/o Sh. Munshi
Ram all R/o Village and P.O. Dhool Siras, New Delhi and also R/o
Village and P.O. Maidan Garhi, Delhi, aged about ___, ___ and ____
years respectively, in pursuance to the order passed by the Hon’ble Court
in C.M. No. 17417/2010 in L.A. Appeal No. 233/2009 vide order dated
10.1.2011.

1. That Munshi Ram s/o Pokhar, Mukesh Kumar and Rakesh Kumar
both S/o of Sh. Munshi Ram, had filed a petition under Section 18
of Land Acquisition Act, bearing LA No.233/2009, in which an
Award/Decree dated 10.1.2011 was passed by the Learned ADJ
(LAC), Tis Hazari, Delhi, against the appellant herein UOI & Ors.
The Respondent has preferred the aforesaid appeal for
enhancement of compensation against the Judgement/Award and
Decree dated _______, passed by Ld. ADJ (LAC), Delhi in LA
No. 233/2009, “UOI & Ors Vs Munshi Ram & Ors”, in this
Hon’ble Court, and the said appeal has been admitted.
2. That the appellant UOI filed appeal vide LA No. 233/2009 wherein
this Hon’ble Court directed the appellant Union of India to deposit
the decreetal amount.

3. That the respondents have been allowed to withdraw the said


amount after furnishing surety/security to the satisfaction the
Learned Registrar General of this Hon’ble Court.

4. That the Appellant/LAC has deposited a sum of Rs. _________/-


in favour of Registrar General, Delhi High Court.

5. Accordingly, I, of my own free will, stands surety to the extent of


Rs. ___________/-, by tendering in security my Kewat No.
_______________________________ and Khatauni No.
______Bighas ___________-, which I am the ½ share
holder/owner and convenant that if the decree of the first Court be
reversed or varied by the Appellate Court (the Hon’ble High Court
of Delhi), the respondents(Munshi Ram, Mukesh Kumar and
Rakesh Kumar), shall restore the said amount, which is sought to
be released as per the order dated 10.1.2011 of this Hon’ble Court
and shall duly act in accordance with the decree of this Hon’ble
Court and shall pay whatever may be payable by him thereunder,
and if he should fail therein, then any amount so payable are
insufficient to pay the amount due, I and my legal representative
will be personally liable to pay the balance. To this effect, I
execute this Security Bond on this ___ day of March, 2011.

6. That I the surety of the appellant undertake that my the above said
agricultural land is free from all encumbrances. I, further undertake
that I shall not sale or create any third party interest without the
prior permission from this Hon’ble Court or till the disposal of the
aforesaid appeal.

2. That the appellant Union of India/LAC filed aforesaid appeal LA


No. 233/2009 wherein this Hon’ble Court directed the appellant
Union of India to deposit the decreetal amount.

3. That the Appeallant/LAC has deposited the enhanced amount of


Rs. ________/-, in favour of the Registrar General, Delhi High
Court.

4. That the respondents have been allowed vide order dated


10.1.2011 to withdraw the said amount after furnishing
surety/security to the satisfaction the Learned Registrar General of
Delhi High Court.

5. That the present application is being moved bonafide and in the


interest of justice.

It is, therefore most respectfully prayed that this Hon’ble


Court may kindly be pleased to:
(i) Take on record the security bond filed by the appellant and

P.O. Maidan Garhi, Delhi -110086, do hereby solemnly affirm and
declare as under:

1. That I am Respondent No. 1 in the above noted case and am well


versed with the facts of the case, and as such, am competent to
swear this affidavit.

2. That the accompanying application under section 151 CPC has


been drafted under my instructions by my counsel. The contents
stated therein are true and correct to my knowledge, and the same
may be read as part and parcel of this affidavit.
