UNDERTAKING

I, ____________________ _ , (name of Proprietor, President or Authorized Representative), of legal age,

Filipino/s, with postal address at ______________________________________________ , under oath, depose and
state, that:

1. I am the Proprietor/President/Authorized Representative of the establishment business/company

referred to as ___________________________ (name of Establishment/Business/Company), engaged in
________________________ (Kind/Classification of Business Activity), and located at
_________________________________________________________.

2. I/We own/lease the property where my/our business is located;

3. I am voluntarily applying for Provisional Business Permit with the city government of Makati as an
alternative scheme in securing Business Permit and Licenses;

4. I am fully aware and understand that there are documents, procedures, provisions of ordinances, laws,
rules and regulations that are required to be complied with to support my application for Business Permit,
and that the city government of Makati may require me to submit additional documents pending
evaluation and processing of my application for Business Permit;

5. I hereby declare, confirm and guaranty that the business I am applying for conforms with the existing
zoning ordinance of Makati, the National Building Code, and all other laws, rules and regulations;

6. I hereby voluntarily and freely undertake to comply with the necessary requirements and procedures for
my application for Business Permit within ninety (90) days, otherwise, I fully understand that (a)the
Provisional Business Permit issued to me/us shall be automatically revoked without notice; (b) I/we shall
voluntarily cease and desist from operating my/our business establishment; (c) I/we shall immediately
settle all taxes due and payable to the City Government of Makati which shall cover from the time of the
issuance of the Provisional Business Permit until its revocation; (d) that I/we/our business can no longer
ask same recommendation during business renewal; (e) that my/our company/business/establishment
shall be included in the roster of black listed companies and persons identified by the City Government of
Makati for a period of 5 years from the date of the revocation. In addition to the foregoing, it is
understood that the city government of Makati is hereby authorized to summarily close my/our business
establishment without the need of notice.

7. I hereby hold the city government of Makati and its officials free from any form of claim, suit or action for
the damages that I/WE may sustain, including but not limited to the costs it incurred for capital
investment, operating expenses, taxes, regulatory fees and charges during the provisional operation the
business, in case this Provisional Business Permit shall have been revoked or the pending application for
Business Permit is eventually disapproved for failure to comply with the Makati Zoning Ordinance, the
Makati Revenue Code and other law, rules and regulations, and for failure to submit the necessary
documents.

8. I hereby hold the city government of Makati free and harmless from all forms of third party claims and
suits by reason of damages and injuries that the third person may sustain on his/her person or property
on account or as a result of my/our provisional business operation.

9. I am executing this undertaking in order to attest to the truth of the foregoing declarations and to
expedite the release of my/our Provisional Business Permit, and for whatever lawful purpose this may
serve.
