Richards, Assistant Prosecuting Attomey, in support of the People’s Emergency to Revoke Bond states as follows: 1. Defendant is charged with four counts of resisting or obstructing an officer, MCL 750.81d(1), one count of operating with a high BAC, MCL 257.625(1)(c), one count of operating while intoxicated, MCL 257.625(1), one count of possession of a firearm while under the influence of alcohol, MCL 750,237(2), and one count of reckless driving, MCL 257.626. 2. Defendant was arraigned on April 16, 2021, and was given a $15,000 personal bond. Defendant was ordered to sign up for D-N-A and submit to random drug and alcoho! testing. On June 11, 2021, the Honorable Judge Daniel Bain of the 43" District Court signed an order, pursuant to stipulation of the parties, suspending Defendant's 10. pretrial drug testing from June 12, 2021 - June 27, 2021 for Defendant to attend training with the National Guard at Camp Grayling. On June 23, 2021, the People leamed Defendant was not staying at Camp Grayling as he had represented and filed an emergency motion to reinstate testing and for contempt of court. On June 24, 2021, Defendant appeared before the District Court and plead guilty to the bond violation. The Defendant was ordered to immediately submit to a full drug and aleohol test. The District Court also ordered that Defendant be placed onan alcohol tether. Defendant was enrolled for a SCRAM monitor on June 24, 2021 A preliminary examination was held in this matter on June 30, 2021. Defendant was bound over to the Cireuit Court on all counts. On July 15, The People filed an Emergency Motion to Revoke Bond alleging Defendant failed to timely pay his tether fees, which resulted a disruption in his tether monitoring. On July 23, 2021, this Honorable Court found Defendant in violation of bond and fined him $1,000.00. The People are again moving to revoke Defendant's bond as he tested positive for alcohol three times on September 3, 2021 and tampered with his tether on September 6, 2021. a. On September 3, 2021, Defendant three readings on this tether. At 12:59 PM his TAC level was 0.023; at 4:37 PM his TAC level was 0.023, and at 7:09 PM his TAC level was 0.022. (See Attachment 1). b, On September 6, 2021, the tether was detected as a tamper for fourteen hours and there was a positive alcohol reading. (Report to be provided when available) 11. The Court may revoke bond for Defendant's failure to comply with the conditions of release. MCR 6.106(1)(2). Wherefore, The People respectfully request Defendant’s bond be immediately revoked and Defendant be held pending tial.
