JUDICIAL AFFIDAVIT

I, Polnerio E. Gumanad, of legal age, residing at Sinaman,

Dipolog City, Zamboanga del Norte after having been sworn to in
accordance with law, do hereby depose and state:

That Atty. Mark Jerome C. Labad is the counsel who conducted

and supervised my examination as witness;

That I am answering the question herein fully conscious that I

do so under oath and that I may be criminally liable for false
testimony or perjury;

The testimony of Polnerio E. Gumanad is offered to prove the

following:

1. That on February 28, 2021 around 10:30 am he was doing

construction works at the residence of Clide Castañeda in
Sinaman, Dipolog City;

2. That at around 10:30 am on the same date as he was doing

construction works, he saw a man coming from a white
automobile, who was very mad and angry yelled some
threatening remarks against Clide Castañeda;

3. That the said man threw a rock at the house of Clide Castañeda
after yelling the threatening remarks;

4. That the threats uttered caused commotion on the construction

workers present there;

5. And such other matters relative to the incident.

I, Polnerio E. Gumanad, after having been sworn in

accordance with law, hereby depose and state that:

 Answer (A): I am Polnerio E. Gumanad, 20 years old, and I am
laborer of some Construction Works in the Construction project
of Clide Castañeda;
(Ako si Polnerio E. Gumanad, Baynte anyos, og
ako usa ka laborer didto sa usa ka konstruksyon nga gipanag
iyahan ni Clide Castañeda didto sa iyahang residensya didto sa
Sinaman, Dipolog City, Zamboanga del Norte.)

2. (Q): What is your purpose of executing this affidavit?

(Unsay tumong nimo sa pag gama niini nga affidavit?)

(A): I am testifying as a support for the criminal case filed by

Clide Castañeda against Christer Ruiz;
(Ako mo testigo isip supporta sa gipasaka nga kasong
criminal ni Clide Castaneda batok kang Christer Ruiz.)

3. Q: Where were you at around 10:30 am on February 28, 2021?

(Aha man ka kaniadtong alas dies y medya sa hapon sa
Pebrero baynte utso, tuig dos mil baynte uno?)

A: I was digging a hole for the piling of hollow blocks for the
wall of the constructed building at the residence of Clide
Castañeda in Sinaman, Dipolog City.
(Nagkalot ko para paylan ug hollowblocks para sa
bongbong sa building didto sa residensya ni Clide Castaneda
didto sa Sinaman, Dipolog City.)

4. Q: What are the peculiar events that happened during that

time?
(Unsa man kaayo ang mga kuyaw nga panghitabo
atong mga taknaa?)

A: While I was digging the hole, I heared a male individual

yelling at Clide Castaneda: “ Yawa ka Clide patyon tika”.
(Samtang ako nagakalot say uta, naka dungog kog usa
ka lalaki nag singgit ngadto kang Clide Castaneda nga “Yawa
ka Clide, Patyon tika”.)

5. Q: What happened next?

(Unsa may nahitabo sunod?)

A: I saw him drove his car away and never returned again on
that day.

6. What is the reaction of Clide after he heared the threatening

remarks?
(Unsa may reaksyon ni Clide pagkahuman atong mga

A: Clide seemed to be shocked, trembled and anxious after he

heared the threatening remarks.
(Si Clide murag na kalitan ug nakuyawan, nahadlok pd
sya human sya bahadi ug hulgaa niadton tawhana.)

7. Q: Do you have anything else to say?

A: None, unless further asked.
