1.0 TUJUAN
Makluman Khas dari Majlis Akreditasi Ukur Bahan (QSAC) ini bertujuan memberikan panduan bagi
membantu pihak Pemberi Pendidikan Tinggi (PPT) yang mengendalikan program Ukur Bahan (PPT-UB)
berkaitan pengekalan kualiti program pengajian ukur bahan semasa usaha menyekat penularan wabak
COVID-19 dalam kalangan mereka yang terlibat dengan pelaksanaan program ini.
2.1 QSAC menasihatkan agar PPT-UB mengambil serius dengan arahan Kerajaan dan mematuhi
arahan dan nasihat yang dikeluarkan oleh Kerajaan Malaysia dari semasa ke semasa supaya
kesihatan setiap staf akademik dan para pelajar dapat dijaga rapi pada tahap yang terbaik. Dalam
konteks ini, keselamatan dan kesihatan staf akademik, para pelajar dan semua yang terlibat harus
menjadi keutamaan bagi semua pihak.
2.2 QSAC turut mengikuti perkembangan serta arahan yang dikeluarkan oleh pihak universiti berhubung
aktiviti di dalam kampus khususnya yang membabitkan pengajaran dan pembelajaran (P&P)
langsung. Lembaga Juruukur Bahan Malaysia (LJBM) difahamkan kebanyakan pertemuan dalam
kuliah, makmal dan studio dibatalkan dan digantikan dengan pertemuan dan pembelajaran atas
talian menerusi apa juga platform, konferens video menerusi media sosial dan seumpamanya
termasuklah menerusi kaedah blended learning dan immersive learning tertakluk kepada keadaaan
dan keperluan sesuatu sesi P&P yang berkenaan.
3.1 Ketersediaan prasarana teknologi komunikasi dan maklumat (ICT) tidak sama tahapnya antara PPT-
UB. Mungkin ada PPT-UB yang lebih bersedia untuk mengendalikan pembelajaran secara maya.
Namun mengadakan pembelajaran maya secara komprehensif dan untuk tempoh yang
berpanjangan membabitkan semua pelajar dan staf akademik bagi sesebuah kelas atau studio yang
berkenaan tidak mungkin mampu dicapai oleh mana-mana PPT-UB pada masa ini.
3.2 Justeru, menggantikan kelas atau studio ukur bahan dalam bentuk atas talian atau maya perlu dilihat
sebagai satu tindakan yang berbentuk sementara. Umumnya diketahui kelas atau studio maya tidak
mampu menggantikan kelas atau studio yang dikendalikan secara bersepadu, sepakat, dan
muafakat. Persekitaran pembelajaran yang dinamik tidak mungkin dapat disimulasikan menerusi
maya atau apa juga medium atas talian.

Sehubungan dengan sub perkara 3.1 dan 3.2 di atas, QSAC berharap agar PPT-UB dapat merangka
strategi dalam merancang P&P iaitu dengan memberi keutamaan penggunaan kaedah atas talian kepada
aktiviti P&P yang membabitkan pertemuan satu-sama-satu antara pensyarah dan pelajar, lintas langsung
syarahan oleh pensyarah, dan seumpamanya. Seterusnya, strategi yang dimaksudkan ini turut mengatur
semula keperluan pertemuan secara berkumpulan seperti sesi pembentangan hasil kerja setiap pelajar
(membabitkan kehadiran semua pelajar dan staf akademik) dengan cara melewatkan penjadualannya ke
penghujung semester bila mana penularan COVID-10 dijangkakan menjadi semakin reda.
5.1 Walau apapun langkah yang diambil bagi menyesuaikan aktiviti P&P dalam konteks dan keadaaan
persekitaran yang terkekang, walaupun dengan niat untuk berbuat sebaik mungkin, QSAC
menjangkakan akan tetap berlaku kesusutan kualiti pencapaian hasil kerja pelajar lantaran ketirisan
masa P&P, kemerosotan intensiti penyeliaan dan berkurangnya jam pertemuan dan pembelajaran
bersemuka serta berkumpulan.
5.2 Sekiranya susutan kualiti seperti yang dinyatakan dalam subperkara 5.1 benar-benar berlaku, pihak
PPT-UB disarankan supaya mengambil tindakan pemulihan susulan bertujuan untuk memastikan
hasil kerja individu pelajar kembali memenuhi sekurang-kurangnya tahap kualiti minimum dan kualiti
program secara keseluruhannya tidak terjejas. Tindakan pemulihan ini perlu dilakukan secara
bijaksana dan penuh tanggungjawab dengan mengambil kira beban pembelajaran semasa para
pelajar. Adalah penting sekali tindakan pemulihan sepenuhnya berjaya diselesaikan dalam tempoh
yang sesuai berdasarkan perancangan setiap PPT sehingga bersedia dengan yakin untuk
menempuhi proses dan prosedur akreditasi khususnya ketika Lawatan Akreditasi oleh LJBM
dilaksanakan.
Makluman Khas ini adalah terpakai ke atas semua PPT-UB yang telah diluluskan atau/dan diakreditasi oleh LJBM
untuk semester yang sedang berlangsung sahaja iaitu bermula serta merta sehingga ke suatu masa di mana
keadaan penularan wabak COVID-19 menjadi reda dan terkawal sepenuhnya.

PENDAHULUAN
1. Lembaga Juruukur Bahan Malaysia (LJBM) merujuk kepada kenyataan Advisory Note
No.4/2020 – Panduan Pengendalian Program Pendidikan Tinggi Semasa dan Pasca
Perintah Kawalan Pergerakan yang dikeluarkan oleh Agensi Kelayakan Malaysia
(Malaysian Qualifications Agency, MQA) serta turut merujuk kepada Kenyataan Media
Kementerian Pengajian Tinggi (KPT) bertarikh 27 Mei 2020 berkenaan Pengendalian
Aktiviti Akademik Di Kampus Institusi Pendidikan Tinggi Semasa dan Pasca Perintah
Kawalan Pergerakan (PKP) yang memaklumkan bahawa semua aktiviti pengajaran dan
pembelajaran (PdP) hendaklah dilaksanakan secara dalam talian sehingga 31 Disember
2020 dan semua aktiviti PdP secara bersemuka adalah tidak dibenarkan. Pengecualian
diberikan kepada lima (5) kategori pelajar yang berkeperluan untuk pulang ke kampus secara
berperingkat bagi melaksanakan PdP seperti di dalam kenyataan media tersebut.

prospek kerjaya pada masa akan datang.
3. Panduan ini juga perlu dibaca bersama dengan arahan atau ketetapan yang dikeluarkan
oleh pihak berkuasa dari semasa ke semasa termasuk Jabatan Pendidikan Tinggi (JPT)
dan Agensi Kelayakan Malaysia (MQA).

5. PPT-UB merujuk kepada IPTA, IPTS, Politeknik dan Kolej Komuniti yang mengendalikan
program Ukur Bahan dan telah diakreditasi oleh LJBM dan MQA.
6. Pada umumnya sebarang perubahan dan pengubahsuaian kepada PdP perlu meletakkan
pencapaian hasil pembelajaran program sebagai parameter utama. Selaras dengan
ketetapan di dalam Manual Akreditasi Program Ukur Bahan LJBM (Edisi Ketiga) dan
Kerangka Kelayakan Malaysia (MQF) Edisi Kedua.
7. LJBM mengambil maklum akan cabaran dan kesukaran PPT-UB untuk membuat
penyampaian dan pengukuran pencapaian bagi domain hasil pembelajaran pelajar tertentu
dalam PdP alternatif yang diubah suai. Antara domain hasil pembelajaran tersebut
merangkumi:

10. Merujuk kepada Soalan Lazim - Berkaitan Pelaksanaan Program Pengajian Ukur Bahan
Semasa Perintah Kawalan Pergerakan Covid-19 yang dikeluarkan oleh LJBM pada
27 Mac 2020, PPT-UB telah diberikan fleksibiliti untuk mengendalikan PdP secara online/
remote learning. Tindakan ini merupakan langkah sementara sehingga keadaan kembali
pulih. Mengambil kira norma baharu dan pemakluman terkini MQA dan KPT, PPT-UB perlu
meneruskan pengendalian secara online/remote learning sehingga tempoh yang ditetapkan
oleh pihak berkuasa.
11. Dalam pada itu, LJBM turut mengambil maklum terdapat kursus-kursus kritikal yang perlu
dilaksanakan secara bersemuka dan sukar digantikan secara online/remote learning
terutama kursus-kursus yang bersifat teknikal, klinikal, penyelidikan kerja makmal atau lain-
lain aktiviti yang melibatkan keperluan kompetensi kemahiran yang spesifik. Dalam hal ini,
PPT-UB dinasihatkan untuk secara kreatif dan berinovasi dalam menyusun kursus-kursus di
semester yang terkesan seperti berikut:

13. Dalam membuat penyusunan dan penyelarasan semula sistem pengajian, PPT-UB
hendaklah mengutamakan pelajar-pelajar yang bakal bergraduat dan memastikan
pelajar-pelajar tersebut melengkapkan kesemua keperluan program termasuk aktiviti
praktikal dan pendedahan industri.
14. Dengan keadaan semasa, terdapat industri yang sedang giat memulihkan ekonomi mereka.
Lantaran itu, terdapat situasi di mana industri keberatan menerima pelajar latihan industri.
Oleh yang demikian, PPT-UB boleh membuat pindaan semester latihan industri ke semester
berikutnya ATAU menggantikan komponen industri/ latihan industri tersebut kepada alternatif
lain yang bersesuaian bergantung kepada bidang program dan memenuhi hasil
pembelajaran.

15. PPT-UB digalakkan untuk memberi penekanan kepada pendedahan industri supaya pelajar
mendapat manfaat yang optimum untuk persediaan mereka di alam kerjaya. Kaedah lain
yang boleh dipertimbangkan adalah seperti industry-based project, problem-based project,
topical studies atau research project. PPT-UB juga boleh menggabungkan beberapa aktiviti
bagi memastikan hasil pembelajaran yang ditetapkan adalah tercapai. PPT-UB boleh
mempelbagaikan kaedah pelaksanaan dengan membahagikan topik-topik yang besar
kepada komponen yang lebih kecil mengikut hasil pembelajaran kursus dan dilaksanakan
sendiri oleh pelajar dengan penyeliaan staf akademik dan/ atau pengamal industri.
16. PPT-UB boleh mempertimbangkan untuk menukarkan pelajar mod industri kepada mod kerja
kursus memandangkan menjalankan dua mod berbeza pada masa yang sama iaitu mod
kerja kursus dan industry (2u2i) atau WBL. Pengubahsuaian ini adalah untuk memastikan
pelajar dapat meneruskan program dalam situasi yang mencabar ini. PPT-UB boleh
menggantikan kursus latihan industri selaras dengan perkara di atas.
PENILAIAN PELAJAR
18. PPT-UB digalakkan untuk meneruskan Penilaian Formatif mengikut kesesuaian di mana
maklum balas atau dapatan daripada penilaian ini akan dapat membantu pelajar mengetahui
kelemahan dari aspek pemahaman/ penguasaan topik untuk diperbaiki. Maklum balas
melalui penilaian formatif turut membantu staf akademik untuk merancang dan
mengendalikan PdP dengan lebih berkesan.
19. Untuk Penilaian Sumatif, PPT-UB boleh mengenalpasti kaedah penilaian berterusan dan
penilaian akhir yang bersesuaian bagi menentukan pengukuran hasil pembelajaran pelajar.
20. PPT-UB diberikan autonomi untuk menentukan sistem penggredan yang bersesuaian bagi
menggambarkan pencapaian kompetensi pelajar terhadap satu-satu kursus semasa tempoh
krisis. Namun, PPT-UB mestilah mempunyai sistem penggredan yang telus dan sebarang
perubahan hendaklah dimaklumkan dan diperjelaskan kepada pelajar. PPT juga boleh
mempertimbangkan kaedah yang membenarkan pelajar menentukan cara penggredan
tersebut dinyatakan di dalam transkrip mereka.
21. MQA telah mengeluarkan pemakluman Panduan Kemasukan Pelajar Tempatan Akibat
Penangguhan/ Pembatalan Peperiksaan Sekolah Menengah Luar Negara dan Ujian
Kompetensi Bahasa Inggeris Tempatan/ Antarabangsa Disebabkan Penularan COVID-
19 bertarikh 13 April 2020 iaitu PPT dibenarkan untuk membuat pengambilan pelajar
tempatan secara tawaran bersyarat mengikut kriteria yang dinyatakan.

22. Pengambilan pelajar antarabangsa adalah berdasarkan syarat kemasukan yang ditetapkan.
Mengambil kira pembatalan/ penangguhan peperiksaan sekolah menengah luar negara,
pada prinsipnya, gred pelajar dan sijil yang dikeluarkan secara rasmi oleh pihak berkuasa
negara berkaitan atau badan persijilan terbabit boleh diterima oleh PPT tempatan bagi tujuan
kemasukan pelajar antarabangsa.
23. Pengambilan pelajar antarabangsa juga adalah berdasarkan ketetapan kompetensi Bahasa
Inggeris yang ditetapkan oleh KPT melalui surat berkenaan Syarat Kompetensi Bahasa
Inggeris Kepada Pelajar Antarabangsa bertarikh 9 Disember 2019. Berdasarkan pemerhatian
MQA, beberapa ujian kompetensi antarabangsa yang ditetapkan oleh KPT seperti Test of
English as a Foreign Language Internet-Based Test (TOEFL iBT) dan International English
Language Testing System (IELTS) telah menawarkan ujian dalam talian yang boleh diambil
oleh calon di rumah masing-masing. Pearson PTE Academic juga ditawarkan di sejumlah
lokasi di seluruh dunia termasuk Malaysia dengan kehadiran bilangan calon yang terhad.
24. Dalam pada itu, PPT boleh melaksanakan pengecualian pencapaian kompetensi Bahasa
Inggeris kepada pelajar tempatan berdasarkan Pemakluman Mengenai Keputusan Dasar-
Dasar Baharu IPTS yang dikeluarkan JPT bertarikh 27 Januari 2017 seperti berikut:

26. PPT-UB hendaklah memastikan pelaksanaan PdP secara online/ remote learning dapat
dimanfaatkan oleh semua pelajar. Sekiranya pelajar mengalami kesulitan untuk mengikuti
pembelajaran secara online/ remote learning, PPT-UB hendaklah mengenal pasti kesulitan
yang dihadapi oleh pelajar. Antara mekanisme yang boleh dipertimbangkan adalah
menyediakan kemudahan pinjaman alat peranti mudah alih dan internet bagi membolehkan
pelajar mengikuti program pengajian dengan efisien. PPT-UB hendaklah sentiasa
mendapatkan maklum balas pelajar dari semasa ke semasa supaya pembelajaran dapat
berlaku/ berlangsung secara berkesan.

STAF AKADEMIK
27. PPT-UB perlu memastikan staf akademik diberikan panduan, bimbingan dan sokongan yang
bersesuaian dalam merancang dan melaksanakan pengubahsuaian secara online/ remote
learning. Staf akademik hendaklah dibekalkan dengan kemudahan yang bersesuaian untuk
memastikan pengajaran yang dijalankan secara online/ remote learning berjalan dengan
lancar dan berkesan. Ini termasuk membenarkan staf akademik menggunakan kemudahan
di kampus sekiranya diperlukan.
28. Pusat/ Unit Jaminan Kualiti Dalaman PPT-UB bertanggungjawab memantau pelaksanaaan
dan keberkesanan penyampaian program yang dijalankan secara online/ remote learning
secara berterusan. Ini bagi memastikan isu atau masalah yang timbul semasa pengendalian
program secara online/ remote learning dapat diatasi dan ditambah baik.
29. Pusat/ Unit Jaminan Kualiti Dalaman PPT-UB perlu memantau keberkesanan pelbagai aspek
tindakan pasca krisis setelah keadaan kembali pulih. Tindakan tersebut boleh berbentuk
program pemulihan, pembetulan atau penambahbaikan berdasarkan keperluan dan boleh
dilaksanakan secara berperingkat.
30. Pengubahsuaian pelaksanaan PdP secara konvensional kepada online/ remote learning
sepenuhnya tidak mengubah kaedah penyampaian program tersebut kepada kaedah Open
and Distance Learning (ODL). Pengubahsuaian ini merupakan kebenaran khas kepada
semua PPT-UB secara interim dalam membantu PPT-UB memberi tumpuan sepenuhnya
untuk melaksanakan PdP yang terbaik dalam situasi yang mencabar ini.
31. Tidak dapat dinafikan perubahan dan pengubahsuaian ke atas program konvensional yang
dilaksanakan terutama secara online/ remote learning dalam tempoh krisis ini akan dapat
memberikan impak yang positif kepada PPT-UB untuk menawarkan program secara ODL
dan MC dengan lebih serius di masa akan datang.
Makluman ini adalah terpakai ke atas semua PPT-UB yang telah diluluskan atau/dan diakreditasi oleh
LJBM untuk semester yang sedang berlangsung iaitu bermula serta merta sehingga ke suatu masa
di mana keadaan pandemik menjadi reda dan terkawal sepenuhnya. Penetapan ini adalah tertakluk
kepada arahan pihak berkuasa berkenaan dari semasa ke semasa.

diadaptasi oleh penduduk seluruh dunia, khasnya oleh ahli-ahli berdaftar LJBM dalam menghadapi
cabaran getir dalam tempoh semasa dan pacsa pandemik ini.
Sehubungan dengan itu, sebagai salah satu inisiatif prihatin bagi membantu ahli-ahli berdaftar
LJBM dalam menempuhi situasi ini, LJBM ingin memaklumkan ketetapan-ketetapan baru yang
melibatkan keperluan berkaitan prosedur pendaftaran.
Ketetapan-ketetapan ini adalah selaras dengan peruntukan 4(g) Akta Juruukur Bahan 1967
(pindaan 2015).

1.0 TUJUAN
Surat Pekeliling ini bertujuan untuk memberi panduan kepada penganjur dan ahli-ahli yang
menganjurkan atau menyertai program CPD semasa usaha berikutan kekangan yang dihadapi
oleh semua pihak dalam tempoh semasa dan pasca pandemik Covid-19.
Sehubungan dengan perkara di atas, Lembaga Juruukur Bahan Malaysia (LJBM) telah
melaksanakan inisiatif prihatin dengan menetapkan beberapa peraturan baharu berkenaan
permohonan mata poin CPD yang dipohon oleh ahli-ahli dan para penganjur.
3.1 Permohonan Mata Poin CPD bagi kursus yang dianjurkan secara atas talian adalah
dibenarkan.
3.2 Tempoh minimum yang ditetapkan bagi setiap kursus adalah empat (4) jam (bersamaan
dengan separuh hari).
Sekiranya tempoh kursus yang dianjurkan adalah kurang daripada masa minimum yang ditetapkan,
penganjur perlu melaksanakan beberapa siri kursus yang berkaitan bagi memenuhi keperluan empat (4)
jam kursus. Penganjur perlu memastikan topik dan kandungan ceramah adalah berkaitan dengan
kemahiran teras dan pengetahuan profesion ukur bahan. Tiada sekatan sama ada ianya perlu
dilaksanakan oleh seorang

3.3 Peraturan 3.2 juga adalah terpakai bagi permohonan kursus satu (1) hari iaitu tempoh
minimum kursus adalah lapan (8 ) jam yang bersamaan dengan satu (1) hari.
3.4 Pemberian mata poin CPD, fi dan peraturan-peraturan lain kursus secara atas talian
adalah sama seperti permohonan mata poin bagi kursus biasa sebelum ini.
3.5 Semakan mata poin CPD seperti yang tertulis di dalam “Category 3” di dalam Jadual Mata
Poin CPD boleh dimuat turun melalui laman sesawang LJBM.

to the Defendant specifying the default and that if the Defendant failed to remedy such default within fourteen
(14) days then the Plaintiff could instruct such work to be omitted and claim the cost of re-awarding the omitted
works from the Defendant. Consequently, clause 29 was viewed as a forfeiture clause that allowed the Plaintiff
to omit work and to charge the Defendant for the costs of carrying out and completing the work awarded to a
third party. In the present case, the Plaintiff had written to the Defendant to submit their recovery plan within four
(4) days, without specifying any default to be remedied by the Defendant. Thus, the pre-condition under clause
29 had not been fulfilled as the Defendant had not been given an opportunity to remedy the situation within 14
days. Under the circumstances there was no compliance of clause 29 which required a strict construction such
that the Plaintiff was not entitled to backcharge for the work omitted and awarded to third parties. (paras 12, 13,
15-22)
(2) The Plaintiff’s claim for a refund and/or restitution for the granite work carried out by the Defendant, which had
not followed specification standards, was without basis. This was because the unit rate for the granite work had
been agreed and fixed in the BQ and could not be deducted by the Plaintiff. Further, the evidence showed that
when the granite works were being carried out by the Defendant, it was supervised and/or observed by the
Plaintiff’s representatives, who were present at the site. (paras 23-26)
(3) The Plaintiff also claimed for rectification work for efflorescence caused when water seeped under the granites
resulting in a chemical reaction which caused a white stain to rise to the surface. As a result of the efflorescence,
the Plaintiff had directed the Defendant to rectify the same within three (3) days failing which it reserved the
right to appoint other subcontractors to rectify and charge the costs to the Defendant. It was clear that the
Defendant’s defence that efflorescence was caused by the presence of a water source beneath the tiles was
not supported by any evidence. On the totality of the evidence and given there was no water source beneath
the tiles as alleged by the Defendant, it was more probable efflorescence was caused by the Defendant’s poor
workmanship whereby the gaps in between the tiles were not properly done. As such, the rectification costs of
RM233,625.00 incurred by the Plaintiff ought to be allowed (paras 27-37)
(4) The Plaintiff’s claim relating to DNs would comprise its purchase and supply of granites, adhesives, sealer and
grout to enable the Defendant to perform the subcontract works, together with the relevant transportation and
other attendant costs. This claim would be premised on clause 14, unjust enrichment and/or s 71 of the Contracts
Act 1950. Under clause 14 the supply of materials by the Plaintiff would have to be on the written request of the
Defendant followed by the issuance of an official DN. Based on the evidence, the DNs had not contained the
details of the cost and also there was no proof of any written request and so the claim under clause 14 would
fail. However, based on case law the Defendant should not be unjustly enriched and/or benefit from the non-
gratuitous payment for and/or delivery of materials from the Plaintiff to it. Whether or not those materials were
supplied on the Plaintiff’s accord or upon the Defendant’s written request was immaterial to the Plaintiff’s claim
for unjust enrichment and/or s 71 of the said Act. As such, the Plaintiff was entitled to debit such costs. (paras
41-54, 59)
(5) With regard to the claim on LAD the amount being claimed was RM727,032.22 which was the full contractual rate
of RM6,167.29 per day in clause 15 or the alternative rate of RM160,092.96 which was the sum imposed on the
Plaintiff. The Plaintiff had pleaded that the delay in the present case was caused solely by the Defendant, with
the subcontractor work representing 70% of the total physical work under the main contract and the remainder
30% of the physical work under the main contract being independent of and having no relation to the progress
and completion of the subcontractor work by the Defendant. Based on the evidence it was apparent that the
delay was not caused solely by the Defendant and as such the Plaintiff was not entitled to impose LAD. However,
if the Court was wrong on this, the Plaintiff would only be entitled to impose LAD of RM160,092.96, which was
the amount imposed by the Employer on the Plaintiff. As such, the Plaintiff’s claim for DNs for the amount of
RM2,430,999.22 on the basis of quantum meruit and costs of rectification due to efflorescence of RM232,427.67
was allowed with interest of 5% per annum with the rest dismissed. (paras 74, 75, 81, 82, 88-90, 180)

(6) The Defendant’s counterclaim amounting to RM4,382,903.79 was derived by deducting a previous payment of
RM3,018,461.50 from a total sum of RM7,385,003.71. It was not disputed that the Plaintiff had issued progress
payment certificates Nos. 1 to 15 to certify the value of work done by the Defendant for RM4,015,175.23. Thus,
the counterclaim was in respect of progress claims No. 16 to the final claim. The Plaintiff claimed that progress
claims No. 16 to the final claim were not valued and certified by it and that the reason why the final claim was
not valued and certified was due to there being no built drawings. However, the evidence showed that the
Defendant’s final claim on tiling work, granite work and preliminaries had been accepted by the Plaintiff. As such
the Defendant’s claim for the outstanding sum should be allowed, except for the item classified as additional
work. (paras 91-98, 102-105)
(7) The Defendant’s claim for loss of profit of 30% from the work amounting to RM93,791.92 (tiling) and RM104,578.47
(granite) was without basis as the work was omitted from the main contract and it was not work awarded by the
Plaintiff to third parties. Thus, the Defendant’s counterclaim of outstanding payment of RM4,382,903.79 minus two
items marked as ‘Non Scheduled Items’ was allowed along with the claim for granite in the sum of RM371,196.17
and RM96,090.64, with interest of 5% per annum with the rest dismissed. (paras 153, 154, 181)

Introduction
The case stemmed from a payment dispute between the subcontractor (Seacera) and the main contractor
(Ahmad Zaki). The Adjudicator awarded in favour of Seacera. Subsequently Ahmad Zaki applied to the
High Court under s 13 of the Construction Industry Payment and Adjudication Act 2012 (“CIPAA’) for the
dispute to be decided in court. The High Court allowed in part Ahmad Zaki’s claim and also Seacera’s
counterclaim.
Several issues were raised and decided by the High Court as follows:
(1) The Plaintiff Ahmad Zaki, was not satisfied with the performance of the Defendant, Seacera. The
Plaintiff therefore omitted some works from the Defendant’s scope and claimed for back charges due to
work awarded to others. The court held that since the Plaintiff did not give any notice to the Defendant
to remedy such default as provided in clause 29 of the contract, the claim would be dismissed.
(2) The Plaintiff was not satisfied with the workmanship of the Defendant and claimed a refund for granite
work carried out not in accordance with specifications. The court held that since the work together with
its unit rate were stated in the Bill of Quantities (“BQ”) and also since such work was carried out as
supervised by the Plaintiff’s representatives, the claim would be dismissed.
(3) The Plaintiff claimed for rectification work caused by the Defendant’s poor workmanship. Proper notice
was issued to the Defendant. The court held that since evidence showed Defendant’s poor workmanship,
the rectification costs incurred by the Plaintiff would be allowed.
(4) The Plaintiff’s claim also related to debit notes comprising the purchase and supply of building
materials. The court held that in accordance with clause 14 of the contract, the supply of materials
