=SPECIAL POWER OF ATTORNY=

KNOW ALL MEN BY THESE PRESENTS that;

We (1) ABHAY SINGH CHAUHAN S/o. Mr. RAJ KUMAR SINGH an


adult, (PAN- BAAPC0106Q) Indian Inhabitant, AND (2) AKSHAY
SINGH CHAUHAN S/o. Mr. RAJ KUMAR SINGH an adult, (PAN-
BBZPC0290F) Indian Inhabitant, both residing at: Flat No. J-1004,
Nargis, Jal Vayu Vihar Phase-1, Sector-20, Kharghar, Navi Mumbai-
410210, Taluka-PanvelDist: Raigad;

SEND GREETINGS;

WHEREAS:-
That our FatherMr. RAJ KUMAR SINGH, mother Mrs. SANDHYA
CHAUHAN, we Mr. ABHAY SINGH CHAUHAN and Mr. AKSHAY
SINGH CHAUHAN are lawful joint owner and well sufficiently
entitled to all the piece and parcel of Flat No. 2101, C wing, 21 st
Floor, Suntek City Avenue-I, Ram Mandir Road, Goregaon (West)
Mumbai-400104 [Hereinafter referred to as “THE SAID FLAT”]

AND WHEREAS

By registered Agreement for Sale vide document serial No.


8711/2017 dated on 16/10/2017, we have purchased the said Flat
from SkystarBuildcon Pvt. Ltd.

AND WHEREAS

Due to our pre-occupations we could not be personally able to


attend and present before the concerned authorities of Sub
Registrar and all or any Government Authorities for execution of
Agreement for Sale/Sale Deed/MOU/ Affidavit/ Declaration and all
other required deeds/documents and complying the various
formalities in respect of sale and Transferof the said Flat, and for
the reasons of convenience it is necessary to appoint some fit and
proper person as an attorney to act for us on our behalf to appear
and present at the office of concerned Sub-Registrar of Assurances
to perform all or any of the following acts, deeds, matters and things
and confer upon all the powers hereinafter stated.

AND WHEREAS
Due to our un-availability for execution of said MOU/Agreement for
Sale/Sale Deed & all incidental acts /deeds/documents in respect
of sale/transfer of said Flat, we do hereby appoint, nominate and
constitute our Father Mr. RAJ KUMAR SINGH, an adult, (PAN-
AMFPS1686M) Indian Inhabitant, Residing at: Flat No. J-1004,
Nargis, Jal Vayu Vihar Phase-1, Sector-20, Kharghar, Navi Mumbai-
410210, Taluka-PanvelDist: Raigad; [hereinafter referred to as “THE
ATTORNEY”] to be our true and lawful attorney, to do and execute
following acts, deeds, and things for us and on our behalf which the
Attorney has consented to do so in respect of said Flat.

NOW KNOW YE ALL AND THESE PRESENT WITHNESS that;

WeABHAY SINGH CHAUHAN and AKSHAY SINGH CHAUHANdo


hereby appoint, nominate & constitute our father Mr. RAJ KUMAR
SINGHto be our lawful attorney to do act for us and behalf all or
any of following acts, deeds and things and look after our affairs in
respect of said Flat which the Attorney has consented to do:-

1. To manage, control, supervise and look after the said Flat in the
manner as our said attorney may deem fit and proper.

2. To represent us before the office/authority of any State/Central


Government, local body, Society, management committee in
respect of said Flat and to make declaration/ statement/
application/ undertaking etc. in our name and behalf.

3. To negotiate and agree to sell the said Flat with prospective


purchaser and to conclude such negotiations at such terms
which our said lawful special attorney deems fit and proper.

4. To enter into and conclude the Agreement for Sale/Sale Deed/


MOU/ Deed of Transfer/Deed of Assignment of said Flat at such
price, with the prospective purchaser(s) and to collect earnest
money/ part payment/ full and final consideration on our behalf
and to issue receipts thereof.

5. To sign and execute MOU/Agreement for Sale/ Sale Deed in


respect of said Flat and to execute all other deeds which shall be
considered necessary and to present such Agreement/Sale Deed
for registration before the concerned authorities and to execute
the receipt of consideration of said Flat on our behalf.

6. To sign and execute all other instruments, which our said
attorney may consider necessary, and to enter into or agree to
such covenants and conditions as may be required for fully and
effectually sell of said Flat as we could do, if personally present.

7. To sign and present such deed of sale for registration, and


receipt of consideration before the Sub-registrar and to do all
acts, deeds and things which may said Attorney shall consider
necessary for conveying the said Flat to the purchaser(s)/
Transferee as we could do the same.

8. To collect the earnest money, installments consideration from the


intending purchaser(s) and to sign all such formal registered
agreements or any deeds as and when required for scheduled
Flat and represent us before the registering authority and verify
all such Agreement of sale/ Sale Deed/Deed of Transfer.

9. To present and lodge the Agreement for Sale/Sale Deed/ Deed of


Transfer/Deed of Assignment whatsoever, for registration and
execution before the concerned Sub-registrar of Assurances.

10. To deposit and pay the outstanding taxes, charges, and dues to
concerned authorities in respect of said Flat and to make
applications for withdrawals of such taxes, charges, levies, dues,
demands etc. paid in excess or not chargeable and to receive the
amounts & sign receipts thereof.

11. To sign the necessary transfer forms for transferring the said Flat
to the Purchaser(s)/ Transferee in the records of concerned
authorities.

12. To apply for and get the Income Tax Clearance Certificate if
required for the sale of said Flat, from the office of concerned
Income Tax Officer in Form 34-A, under the provisions of Income
Tax Act, 1961, and for the purpose to sign and apply any form /
document & to do all acts, deed and things which are necessary
for same.

13. To apply and get permission from the office s of competent


authorities/BMC/Society for sale and transfer of our rights,
interests in the said Flat in favor of intending purchaser(s).

14. To represent us before the office of Society/ Builder or any
authority of Government or local body which are concerned with
said Flat and to collect NOC/No dues from them for completion
of sale/Transfer/assign of the said Flat and to do all other acts
things as may be required to be done for Agreement for Sale/Sale
Deed as we would do if personally present.

15. To commence, carryon and prosecute or defend any action, suit,


appeal or other proceedings relating to the said Flat or for the
purpose of these presents to appoint Advocate/ Lawyer to appear
in any court of law or before any public or Local Officer and
Authority and sign, declare, verify and affirm Plaint, written
Statement, petition & all documents as our Attorney may from
time to time he think fit and proper.

16. To submit an application or letter to Electricity Board/ PMC/


Government/Semi Government/Local Bodies/CIDCO/Society in
concern of the said Flat.

17. To appear before the management committee, AGM, SBGM,


Committee meetings of Society and the Officials of MSEB, L.P.G
Distributor Co., Municipal Corporation or any other Govt. or
Semi Govt. Authorities on our behalf and to do all other acts and
deeds and things in respect thereof which may required.

18. To declare, affirm and execute any declaration, Affidavit, Bond or


undertaking as may be required from time to time by any
Authority pertaining to the said Flat.

19. To sign and collect any educational/official documents/Bank


Documentsof Executant No. 2 from College/University/Bank/
Post office etc. and the Executuant No. 2 will take complete
responsibility if the said documents get lost or damaged after
handed over to thesaid constituted Attorney.

20. We hereby agree to ratify and confirm all and whatever act, or
acts our said attorney shall lawfully do or perform in connection
with and/or any of the powers in respect of said Flat and receipt
of any educational document under by virtue of power of
attorney notwithstanding no express power in that behalf is here
under provided.

21. AND GENERALLY to do and execute all such matters acts &
things as are necessary for said purposes as fully & effectually as
we executed to do and we hereby agree to ratify and confirm all
and whatever act, or acts our said attorney shall lawfully do
execute or perform in connection with any of powers transferred
in respect of said Flat by virtue of said power of attorney.

and understanding all the clauses of this Power Of Attorney, set and
