PART IV: FLOW OF TITLE OF PROPERTY / DEVOLUTION OF TITLE.


The Property situated at Mauza- Patiyasa, P.S- Ahiyapur, Thana no- 648, Khata no- 709, Khesra
no.- 1802 & 1803, Anchal- Bocha, Jamabandi no.- 1367 and 1665, Sub-registry- Muzzafarpur,
District – Muzzafarpur, area – 18 dismil in the name of Shri Ajay Kumar dhandariya S/o Shri
Aatma Ram dhandariya.
From the perusal of documents mentioned above in part 2 of this opinion its appears that the
owner of the land property is Mohammad Alam Gir S/o Mohammad Safur Mudum.

Thereafter the said Mohammad Alam Gir S/o Mohammad Safur Mudum, sold the property to Sri
Kaushlendra Kumar, Sri Shiv Kumar Gunjan and Sri Gaurav Kumar all S/o Sri Ram Niranjan
Singh vide Sale Deed no. 59 dated 11.10.2009.

Thereafter the said Sri Kaushlendra Kumar, Sri Shiv Kumar Gunjan and Sri Gaurav Kumar all
S/o Sri Ram Niranjan Singh granted the aforesaid Property as Power of Attorney to his father Sri
Ram Niranjan Singh S/o Late Ramdev Prasad Singh vide power of attorney no. 40 dated
11.02.2017.
After that the aforesaid property was sold by Sri Ram Niranjan Singh to Shri Ajay Kumar
Dhandariya S/o Shri Aatma Ram Dhandariya vide Sale deed no.9124 dated 30.05.2019.

The property is fit for equitable mortgage.

PART V: TITLE OPINION / CERTIFICATE:


That on perusal of above mentioned documents Owner Shri Ajay Kumar Dhandariya S/o Shri
Aatma Ram Dhandariya has a clear, marketable, and unencumbered title to the property and he
can create Equitable mortgage in favour of the Bank.

We are of the opinion that aforesaid property is enforceable under SARFAESI Act.

Dhandariya. They has been living peacefully and holding title, interest, possession of the
aforesaid property.
