MEMORANDUM OF AGREEMENT

KNOW TO ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement made and executed by and

between:

LENNE B. CHUA, Filipino, of legal age, and a resident of

Sta. Cruz, Rosario, Agusan del Sur, herein called the First Party
; and

ALBERTA ELEGUERO, Filipino, of legal age and a resident of

Sta. Cruz, Rosario, Agusan del Sur, hereinafter referred to as
the SECOND PARTY ;

WITNESSETH:

WHEREAS, the FIRST PARTY is the owner of a parcel of land,

known as Lot No. 1369-A, Psd-13-16764, situated at Sta. Cruz,
Rosario, Agusan del Sur, containing a total area of FORTY NINE
THOUSAND EIGHT HUNDRED SEVENTY EIGHT (49,878) sq. meters more or
less, covered by Transfer Certificate of Title No. T-22647;

WHEREAS, the SECOND PARTY reside in the said area, without

permission or consent from the FIRST PARTY ;

WHEREAS, for value received, the SECOND PARTY and her heirs,
successors, assigns and interests, are willing to vacate the
above-described area, under the following terms and conditions ;

NOW, THEREFORE, for and in consideration of the foregoing,

the parties hereby agree to the following terms and conditions
stipulated hereunder :

1. That the SECOND PARTY pledged to vacate the above-

described parcel of land on January 18, 2012, together
with her heirs, successors, assigns and interests ;

2. That the FIRST PARTY shall in return give THIRTY Thousand

(P30,000.00) Pesos to the SECOND PARTY, for the her
improvements introduced over the said area ;

3. That the parties shall observe good faith and fidelity in

the performance of their respective duties and
obligation.
 IN WITNESS WHEREOF, the parties have hereunto affixed their
hands this 11th day of December 2012, in San Francisco, Agusan
del Sur, Philippines.

ACKNOWLEDGMENT

BEFORE ME, this 11th day of December 2012 at San Francisco,

Agusan del Sur, personally appeared the above-named persons
represented to me to be the same persons who executed the
foregoing instrument, and they acknowledged to me that the same
are their free act and deed.

The parties and their witnesses at the left margin of each

and every page have signed this instrument consisting of 2 pages
including this page hereof.
