CODE OF POLICY

ARTICLE 1
RATIONALE

To realize the Local Shelter Plan included in the executive Legislative Agenda,
Socialized Housing Program for its constituents, IRR for this purpose call the task of LHB to
prepare the necessary policies, guidelines, plans and program of Socialized Housing Program .

On July 1, 2019 by virtue of Executive Order no.33 Series of 2019, a Local Housing
Board of Lipa City was created and organized composed of the Local Government Unit of Lipa
City, with chairmanship of the City Mayor and Vice chairperson- Sangguniang Panlungsod
Member and Chairperson on Committee on Housing and Urban Development as well as the
representative of Community Based Housing Coordinating committee and representative of the
Presidential Commission of the Urban Poor..

To safeguard the interest of the said beneficiaries, the Local Housing Board of Lipa
adopted this “Code of Policy” which will serve as guidelines and will govern the selection and
qualification of beneficiaries and the disposition and award of home lot to qualified beneficiaries
within the abovementioned Socialized Housing Program.

ARTICLE II

SCOPE

This Code of Policy shall govern all matters and activities relative to the Socialized
Housing Program located at Bulacnin, Lipa City, Batangas pursuant to Executive Order No.
____ with particular reference to the qualification and selection of beneficiaries and the award of
home lots.

ARTICLE III

DEFINITION OF TERMS

For purposes of this Code:

1. ABSENTEE CENSUSED HOUSEHOLD - a household that vacates a duly tagged


structure of dwelling unit and leaves the area for a continuous period of at least six (6)
months without a written notice to the Local Housing Board / respective association.

2. ABSENTEE HOUSEOWNER – any individual / family who owns dwelling structure /


unit(s) in the project area but has not occupied the same prior to the closure of the
official occupancy verification survey.

3. AWARDS AND ARBITRATION COMMITTEE – committee that has the jurisdiction to


hear and decide cases involving controversies and disputes on award of home lots. The
committee is composed of representatives from the _____ as Chairman, LGU of Lipa
PCUP, Barangay and PO.

4. BENEFICIARY – a household/family who meets the criteria for beneficiary qualifications
imposed by the Beneficiary Selection Committee.

5. BENEFICIARY SELECTION COMMITTEE – This refers to the Committee tasked to


identify, select and qualify beneficiaries of home lots at Brgy. Bulacnin, Lipa City.
The Beneficiary Selection Committee shall be composed of representative for the LGU
of Lipa City City Mayor as as Chairman, __City Legal Officer as Co-Chair, ______ ,
PCUP and concerned PO.

6. CENSUSED HOUSEHOLD – a household registered in the official masterlist of


occupancy verification survey conducted from April 2018 to December 2019

7. DISMANTLING OF STRUCTURE – the authorized act of physically removing any


structure or improvement or a part thereof pursuant to the policies approved by the Local
Housing Board of Lipa and the provisions of R.A. 7279.

8. DUMMY – refers to person or persons used as imitative substitute in lieu of the structure
owner.

9. EXTENSION – any vertical and/or horizontal addition to the existing structure .

10. HOUSEHOLD – a group of persons living in one dwelling unit, and having common
arrangements for the preparation and consumption of food.

11. HOUSEHOLD HEAD – this refers to the primary breadwinner of a family / household .

12. ILLEGAL STRUCTURE – any new structure constructed, added or moved within the
prescribed boundary of the project site after December 2019 official closure of the
verification survey .

13. LOCAL HOUSING BOARD COMMITTEE – board created pursuant to the Executive
Order No. 33 Series of 2019 to address the various housing concerns affecting local
residents.

14. LOCAL GOVERNMENT – refers to the Local Government Unit of Lipa City.

15. LOT APPLICANTS – refers to a family who has intention to acquire and own a home lot
who meets the criteria for beneficiary qualification imposed by the Beneficiary Selection
Committee.

16. MULTIPLE STRUCTURE OWNER (MSO) – refers to a house owner, residing or not
residing in the project area, who owns more than one dwelling structure/unit within the
area .

17. NOTICE – official written communication duly signed by the Chairman of the Local
Housing Board or his officially designated representative to any resident of the project
area.

18. OCCUPANCY VERIFICATION SURVEY – This refers to the survey of households


conducted to informal settlers in dangered area & PNR from April 2018 to December
2019.

19. OCCUPANT – BENEFICIARY – this refers to household residing within the area who
was registered and included in the composition of official occupancy verification survey
master list and meets the criteria for beneficiary qualification by the Beneficiary Selection
Committee .

20. PROFFESSIONAL SQUATTERS – refer to persons who have previously been awarded
home lots or housing units by the Government but who sold, leased or transferred the
same to settle illegally in the same place or in another urban area and non-bonafide
occupants and intruders of lands reserved for socialized housing. The term shall not
apply to individuals or groups who simply rent land and housing from professional
squatters, or squatting syndicates.

21. RENTER / LESSEE – any household who pays the structure owner for occupying or
using a dwelling structure or unit.

22. RENT-FREE OCCUPANT – refers to the dweller other than the owner who occupies the
dwelling structure/ unit for free.

23. SECURITY OF TENURE – refers to the degree of protection afforded to qualified


beneficiaries against infringement or unjust, unreasonable and arbitrary eviction or
disposition, by virtue of the right ownership, lease agreement, and other contractual
arrangements .

24. SHARER – refers to a rent-free family, related to the structure owner by consanguinity or
affinity , who occupies the dwelling unit for free with separated arrangement for the
preparation and consumption of food.

25. SQUATTING SYNDICATES - refer to groups of persons whether living within the
project site or not, who engage in the business of squatter housing for profit or gain.

26. STRUCTURE – a man-made facility, built for the support, shelter or enclosure of
persons, animal chattels or property of any kind.

27. STRUCTURE OWNER – any person or persons who constructed or caused the
construction of structure in the subject danger area.

28. TAGGING – the official act of registration of structures in the project area by the
issuance within a specific time frame thereon.

ARTICLE IV

DECLARATION OF POLICIES

The Local Housing Board of the City of Lipa created for the disposition of the award of
home lot located in Bulacnin Lipa City, Batangas to qualified beneficiaries shall strictly adopt the
following policies as agreed, to wit:

1. That the primary objective is to provide security of tenure to occupant –beneficiary/and


lot applicants of Socialized Housing Program through lot award.

2. That maximum participation and involvement of the affected community shall be


encouraged and sustained in the planning and implementation of the various
undertakings .
3. That only those occupant-beneficiaries/lot applicants who have compiled with the
prescribed pre-planning requirements by the LHB of Lipa City shall be considered as
potential beneficiaries of the project.

Lot applicants who have initially passed the pre-qualification and/or requisite of the
Beneficiary Selection Committee (BSC) and have with the prescribed requirements may
be considered as prospective beneficiaries after all the primary beneficiaries have been
allocated their respective home lot. Said lot applicant shall be subjected for the final
evaluation and subsequent approval of the LHB.

4. That the occupancy verification survey conducted from Barangay 8, Latag & Barangay
10 from April 2018 to December 2019 shall be primary basis in determining the qualified
beneficiaries of the project.

5. That any mode of transfer of beneficiary rights over the awarded homelots shall be in
accordance with this Code and/or guidelines set forth by the LHB.

6. That only bonafide occupant-family who does not own any residential property within the
City of Lipa, inclusive of land/housing unite provided under any government resettlement
/ relocation projects shall have the opportunity to purchase and own home lot in the
Social Housing Program

7. That the comprehensive development plan of the said SHP as approved by the LGU of
Lipa and concerned government agencies shall be implemented.

8. That the project shall conform to the approved development plan and shall strict comply
with the minimum design standards and requirements for socialized housing projects
pursuant to the revised B.P. 220 and applicable ordinances of Lipa City.

9. That each family shall be allocated and awarded only one home lot.

10. That each home lot shall have a minimum lot area of forty (40) square meters.

11. That the Local Government Unit of Lipa shall assume the estate management of the
SHP property and the provision and maintenance of various facilities and amenities of
the subject project area.

12. That the LHB of Lipa shall apply all appropriate sanctions for violation of any of the
above-mentioned policies within the parameters of the existing law.

13. That the procedure for the selection of beneficiaries shall be applied and implemented.

ARTICLE V

BENEFICIARY SELECTION

1. The official masterlist based on the result of the occupancy verification survey and
tagging operation conducted from April 2018 to December 2019 shall be the primary
basis in determining the potential program beneficiaries of the project by the Beneficiary
Selection Committee, whether they are house owners, renters, tillers/cultivators, sharers,
rent-free occupants. Issuance of a Censused household for during Structure tagging
shall in no way constitute guarantee for lot allocation.

2. Potential program beneficiaries must have the following qualifications:

2.1 Lot applicants and Occupant – beneficiary

I. Those who do not own or co-own any real property in Lipa City and whose
income falls below poverty threshold;

II. Those who have been residing in the area for a period of before closure of
the official occupancy verification survey on December 2019 and residing in
the area for more than 10 years;

III. Inclusion on the masterlist of occupancy verification survey conducted from


April 2018 to December 2019.

IV. Those who have not been beneficiaries of NHA and FPICX housing
programs and/or any government resettlement / relocation programs and
projects and not been a recipient of CALABARZON project.

V. Must be a member of “good standing” of their respective
Homeowners/Neighborhood Association.

VI. Must be a Filipino citizen either by birth or naturalization of legal age and
registered voter of Lipa city,

VII. Must not own any residential property in Lipa City.

ARTICLE VI

PRIORITIZATION FOR BENEFICIARY SELECTION AND AWARD

The following shall be the basis in determining the matter of prioritization of potential
beneficiaries for the award of home lots in the project area.

1. First priority shall be given to structure / house owner who continuously resides in the
area for more than 10 years and included in the official masterlist of the occupancy
verification survey conducted from April 2018 to December 2019 and income is below
property threshold .

2. Second priority shall be given to sharer / rent-free occupant registered in the official
masterlist of occupancy verification survey residing in the area for more than 5 years and
whose income is within poverty threshold.

3. Third priority shall be given to renter registered in the official masterlist of occupancy
verification survey. Lot applicants shall only be recognized as potential beneficiaries of
the project after all the primary beneficiaries have been evaluated and qualified, subject
to evaluation of the Arbitration and Awards Committee and approval of the LHB.

In the event that there will be residual lots after all the primary beneficiaries under
Priority 1 have been given their respective lot allocations, the distribution of the said
residual lots shall be undertaken through raffle-award by the LHB (only in case the
generated lots are insufficient to accommodate the qualified beneficiaries in accordance
to its prioritization as stated in Article VI, item 2 and 3 of this code.

ARTICLE VII

DISQUALIFICATIONS

The following shall be the grounds for disqualification from being a beneficiary of the
project:

1. For Occupant – Beneficiary

a. A censused household who resided in the area for a period of 8 years below .

b. Continuous ownership or possessions of more than one dwelling unit upon
verifications during tagging of structures;

c. Disposition or lending and expanding the coverage of any project Tag Number to
another household or households;

d. Unjustifiable and unreasonable ejectment of any renter, sharer, rent-free occupant by


an owner of the dwelling unit ;

e. Recipient of NHA, FPIC and CALABARZON housing programs and/or any


government resettlement / relocation programs and projects ;
f. Identified as dummy for the purpose of acquiring rights over the lot/dwelling unit ;

g. A household who shall make unauthorized construction despite a notification and


reminders of urban poor leader responsible I the area.

h. Those who found guilty after due process for deliberately, maliciously and in open
defiance to any orders or policy of the LHB;

i. Those who allow to be a witness to an arrangement with relation to the unauthorized


mortgage, sale, lease or any disposition of lot/unit to any person whether censused
or uncensused .

2. Lot-applicants

a. Those who settle in the area less than 8 years are least priority.
b. Those who are found to submit spurious / tampered documents;
c. Those who reconstruct and improve units being occupied for other purposes.
d. Recipient of housing or home lot under any of the government housing program /
project ;
e. Those who are found to own or co-own real properties in Lipa City, Batangas ;
f. Those who are found guilty for deliberately, maliciously and in open defiance to any
orders, decision or policy of the LIAC;
g. Those who are fund to be members of professional squatters and squatting
syndicates as defined under R.A. 7279;

ARTICLE VIII

BEENFICIARY SELECTION COMMITTEE

1. The Beneficiary Selection Committee which is empowered by the LHB of Lipa shall be
composed of the LGU of Lipa City as Chairman, ______ as co chair and concerned PO
as members.
2. Jurisidiction of Beneficiary Selection Committee (BSC)
The BSC shall have the full authority to identify, select and qualify the beneficiaries of
homelots in Housing Project located in Brgy. Bulacnin, Lipa City.

ARTICLE IX

AWARDS AND ARBITRATION COMMITTEE (AAC)

1. The AAC that has been created and empowered by the BSC shall be composed of
representatives from the City Mayor as Chairman, City Legal as Vice Chairman and
______ , Community Based Housing coordinating Committee and PO as member

2. Functions of the AAC

The AAC shall have the authority to resolve and decide disputes arising from the
disposition of home lots to safeguard the rights of the beneficiaries. It shall have
jurisdiction to hear and decide cases involving the following :

a. Petition for revocation of qualified status due to violation(s) of the provisions of


this Code;
b. Controversies and disputes on the matters of selection of beneficiaries;
c. Appeal on the decision on the matters of beneficiary selection;
d. Controversies affecting allocation and award of homelots ;
e. Resolution for the disposition of more than one structure ;
f. Claims for inclusion on the occupancy verification masterlist and/or potential
beneficiaries of the project ;

3. Any decision of AAC shall be final and executory unless the same is appealed to the
Chairman of the LHB within thirty (30) days from receipt of the adverse resolution. In
such case, the decision of the AAC shall be final, binding and executory on all parties
concerned.

ARTICLE X

PROCEDURES FOR BENEFICIARY SELECTION

1. A masterlist of censused families based on the occupancy verification survey shall be


posted in the areas affected by the project and/or a copy of said masterlist shall be
provided to the office of the Brgy. Chairman;

2. Families included in the masterlist shall be informed by the LHB or requiring them to
submit the following documents within fifteen (15) calendar days after the first day of the
Second Social Preparation Meeting.

2.1 Duly notarized Certificate of Lot Availment, with 2x2 picture (1 pc. Only) of HH
If single, a duly notarized affidavit stating that he/she is the head of the family

2.2 Birth / Baptismal Certificate

2.3 Community Tax Certificate of HH and spouse

2.4 Marriage Contract

For couples, cohabitating without the benefit of marriage and without any legal
impediment, a notarized affidavit of co-habitation .

2.5 Police / NBI Clearance

2.6 Barangay Certification of residency and good moral standing in the Brgy.

2.7 Certification from the Assessor’s Office stating of non-ownership of residential


property in Lipa City, Batangas .

2.8 Duly notarized self-sworn affidavit of no-ownership of real property;

2.9 Latest Identification Card

2.10 Voter’s Identification / Certification

3. Upon submission and verification of the above-mentioned documents, the LGU of LHB
shall file in an individual folder and the said documents for the conduct of deliberation of
each beneficiary by the Beneficiary Selection Committee. A notification letter on the
result of deliberation shall be issued to the concerned household head.

4. The recommendation/decision of the Beneficiary Selection Committee shall be posted in


strategic locations in the community within fifteen (15) calendar days for reaction or
appeal in case of disqualification. Non receipt of written individual/community reaction
after the said period shall render such listing as final. All family-beneficiary qualified by
the Beneficiary Selection Committee shall be included in the Masterlist/Roster of
qualified beneficiaries of the project .

ARTICLE XI

DISPOSITION OF RIGHT TO OWNERSHIP

Disposition of rights as herein used refers to any mode of transfer of rights and privileges over
the structure(s) including claims to the occupied lot prior to actual and legal awarding.

1. Multiple Structures

In case of ownership of more than one structure within the area, the censused Multiple
Structure Owner (MSO) shall be required to retain ownership of only one unit.

MSO who is not included in the masterlist of the occupancy verification survey is
automatically disqualified from being an awardee and/or retain ownership of
dwelling unit/structure .

Relinquent and transfer of rights of censused structure owner over the structures and
claims to the occupied lot shall be allowed under the following conditions :

1. Applicant for homelot allocation shall be related to the censused structure owner up
to the first degree of affinity only and must be a Filipino citizen either by birth or
naturalization and of legal age and registered voter of Lipa City;

2. The LHB must be informed by the censured structure owner of the intent to transfer
his/her rights, through a duly notarized sworn affidavit

ARTICLE XII

DISMANTLING OF STRUCTURES

1. Dismantling of structures shall be undertaken as a matter of procedure and for public


interest in accordance with the policies, rules and regulations promulgated by the
LHB, to wit:

a. Any structure constructed after the Official Tagging ;

b. Any structure modified, transferred or constructed despite issuance of cease and


desist order by the LHB;

2. The LGU of Lipa City shall initiate the conduct of demolition of structure of
dismantling. Procedures for dismantling shall comply with the Implementing Rules
and Regulations of R.A. 7279.

ARTICLE XIII

AMENDMENT CLAUSE

The LHB may issue additional / amendatory policy / provision to supplement this Code.

ARTICLE XIV

EFFECTIVITY DATE

This Code of Policy shall take effect on this _____________ day of ______________
2021.
