“ A RESOLUTION DECLARING APPROPRIATION ORDINANCE NO. 2021-02,

EMBODYING CY 2021 SUPPLEMENTAL BUDGET NO. 02 OF THE MUNICIPALITY
OF NABUNTURAN, PROVINCE OF DAVAO DE ORO INVOLVING AN AMOUNT OF
FIFTY FOUR MILLION THREE HUNDRED THIRTY THREE THOUSAND SEVEN
HUNDRED EIGHTY THREE PESOS AND 63/100 (P54,333,783.63) FOR THE
GENERAL FUND, OPERATIVE IN ITS ENTIRETY SUBJECT TO CONDITION”

WHEREAS, on August 6, 2021, the office of the Secretary to the Sanggunian

received the above-cited ordinance of Nabunturan, for this august Body’s consideration
and appropriate legislative action;

WHEREAS, said ordinance was calendared and referred to the Committee on

Budget and Appropriation on August 16, 2021 during the 110th Regular Session of the
Sangguniang Panlalawigan, in which the Committee conducted its hearing on August
23, 2021 and came up with a recommendation of declaring operative in its entirety;

WHEREAS, the Municipality of Nabunturan is capacitated under Section 447(a)

– 2 (i) of RA 7160 otherwise known as the Local Government Code of 1991, which
empowers the Sangguniang Bayan, as the legislative body of the municipality, to
approve the annual and supplemental appropriations of the municipal government and
appropriate funds for specific programs, projects, services and activities of the
municipality, or for other purposes not contrary to law, in order to promote the general
welfare of the municipality and its inhabitants, except for the finding:

1) That the account code for the purchase of Air Conditioner in the amount
of P35,000.00 was not in accordance with COA Circular No. 2020-004
dated January 31, 2020. Account code used is 1-07-06-010, instead of
1-07-05-020.

2) That contents of LBP Form No. 9 did not form part of the Appropriation
Ordinance.

WHEREAS, in plenary session, the august Body declare the afore-stated

appropriation ordinance OPERATIVE IN ITS ENTIRETY SUBJECT TO CONDITIONS,
to wit;

1. Implement the Chart of Accounts prescribed under COA Circular No.

2020-004 dated January 31, 2020 Government Accounting Manual
(GAM) for LGUs vol. III;

2. Use the format of the Appropriation Ordinance in accordance with the

Budget Operations Manual for Local Government Units (2016 Edition)

WHEREFORE, on motion of Hon. Arturo T. Uy duly seconded by Hon.

Nena G. Atamosa and Hon. Renato B. Basañes, be it

RESOLVED to declare, as the august Body is hereby declaring Appropriation

Ordinance No. 2021-02, embodying CY 2021 Supplemental Budget No. 02 of the
Municipality of Nabunturan, Province of Davao de Oro Involving an Amount of Fifty Four
Million Three Hundred Thirty Three Thousand Seven Hundred Eighty Three Pesos and
63/100 (P54,333,783.63) for the General Fund, Operative in its entirety Subject to
Condition.

RESOLVED FURTHER, that its implementation shall be subject to the following

recommendation;

1. Allocation and provision of Funds for Local Government Units for PPAs
to address the Corona Virus Disease 2019 (COVID-19) shall be made in
accordance with local Budget Circular No. 124 dated March 26, 2020 of
the Department of Budget and Management;

2. Utilization of 20% Development Fund shall be made in accordance with

Joint Memorandum Circular No. 1 dated November 4, 2020 of the
Department of Budget and Management, Department of Finance and
Department of the Interior & Local Government;

3. Purchase of Motor Vehicle should be in accordance with the DILG

Memorandum Circular No. 2021-004 dated January 18, 2021 and
Memorandum Circular No. 2014-155 dated December 17, 2014, Budget
Circular No. 2019-3 dated May 16, 2019, Budget Circular No. 2019-2
dated March 4, 2019, Budget Circular No. 2017-1 dated April 26, 2017
of the Department of Budget & Management and Administrative Order
No. 14 dated December 10, 2018 of the Office of the President.

RESOLVED FURTHERMORE, to require the Municipality to comply with the

herein conditions and notify this august Body on actions taken thereon; and to inform
the Municipality that this review action does not authorize any item of appropriation that
is specifically prohibited by or inconsistent with the provisions of law.

RESOLVED FINALLY, that copies of this resolution be forwarded to the offices

of the Sangguniang Bayan and the Municipal Mayor of Nabunturan; let copy hereof be
furnished to the office of the Honorable Governor, this province, for information and
reference.
