“The fundamental rule is that, the lack of jurisdiction of the court over
an action cannot be waived by the parties, or even cured by their silence,
acquiescence or even by their express consent.”
FACTS:
Private respondent filed a Motion for New Trial, alleging that he has been
occupying the land as a tenant of Artemio Laurente, Sr. in which the RTC
denied later on.
Private respondent filed before the RTC a Petition for Relief from
Judgment, reiterating the same allegation in his Motion for New Trial. The trial
court issued an order denying the Petition for Relief from Judgment.
On November 22, 1996, the RTC denied the motion for reconsideration.
COURT RULINGS:
RTC ruled against the private respondent and ordered the same to
peacefully vacate and surrender the subject land. RTC denied the motion for
reconsideration filed by the private respondent alleging the lack of jurisdiction
of the RTC over the instant case.
The Court of Appeals gave due course to the petition of the private
respondent, maintaining that private respondent is not estopped from assailing
the jurisdiction 'of the RTC.
ISSUES:
WON the private respondent is estopped from assailing the jurisdiction of the
RTC despite him being in default during the trial.
SC RULING:
No. In the present case, private respondent questions the jurisdiction of RTC
on legal grounds. Recall that it was petitioner who filed the complaint against
private respondent and two other parties before the said court, believing that
the RTC had jurisdiction over his complaint.
