18. As a final point, while we note the irregular procedure adopted by the RTC
when it rendered a decision based on implications, we nevertheless hold that
the proper remedy to question this irregularity is not through a Rule 45
petition.
19. If indeed there is merit to the claim that the signatures had been forged or
that the signatory was unauthorized, or that the RTC failed to observe the
mandate of A.M. No. 04-7-02-SC, the proper recourse to question the RTC's
ruling on the motion to cancel the bond should have been a petition
for certiorari under Rule 65, not through the process and medium the
petitioner took.
