against the offenders. Ref: - Incontinuation to this office memo no. 2566-2570 dated 28.08.2020 (copy
enclosed). On the subject cited above, it is intimated that a complaint for lodging of FIR against Sh.
Surender Kumar S/o Sh. Manhor Lal R/o Village- Daliyaki, Tehsil District- Rewari for carving out or
unauthorized colony falling in Rect./Killa no. 67//18/2, 19/2, 20/2, 21/2, 22, 23 having approx. area
35K- 08M in the revenue estate of Village- Rewari, Tehsil District Rewari in violation of provisions of
Haryana Development and Regulation of Urban Area Act, 1975 was sent to your good office vide
above referred letter The same was got Registered/lodged as FIR No. 341 dated 15.09.2020 in Police
Station, City Rewari, District- Rewari. Now it has been came to know by the site of field official of this
office that some unscrupulous elements/offenders whom details have been obtained by the field staff of
this office through local enquiry at site/record (as per Annexure-1) are raising unauthorized
construction: Over the land/colony falling in Rect./Khasra no. 67//18/2, 19/2, 20/2, 21/2, 22, 23 having
approx. area 35K-08M in the revenue estate of Village- Rewari, Tehsil District Rewari, without
obtaining any permission under of Haryana Development and Regulations of Urban Areas Act, 1975
(Act No. 8 of 1975) from the
competent authority i.e. Director, Town Country Planning, Haryana and thus violated the provision of
section 7 (ii) of the Act No. 8 of 1975 and the rules framed thereunder. The aforesaid site of offenders
falls within notified Urban Area Rewari. Section 3 of the Act no. 8 of 1975, specifies requirements of
license for carving out a colony within urban area with prior permission of the competent authority i.e.
"The Director, Town and Country Planning, Haryana, Chandigarh." Further Section 7 (i) of Act no. 8 of
1975 provides for prohibition on sub-division of land for carving out colony and section 7(ii) provides
for prohibition on erection or re-erection any building in any colony in respect of which a license under
section 3, has not been granted section 7(iii) provides for prohibition on erection or re-erection any
building other than for purposes of agriculture on the land sub-divided for agriculture purpose. In
aforementioned colony the above named offenders have thus violated section 7 (ii) of Act no. 8 of 1975
by erecting building in unauthorized colony wherein License under section 3 is not granted and has
also caused financial loss to the state exchequer by not paying the prescribed fees and charges (license
fee, EDC, IDC etc.) for erection of unauthorized building. The offender is deliberately continuing with
the offence/violation/ contravention of provisions of Act no. 8 of 1975 and rules framed there under. In
view of above, the offenders have warned various time to stop/raised the unauthorized construction by
the field staff of this office during visit of this unauthorized colony/area necessary notices/orders have
been issued to the offenders on the basis of available revenue documents/local enquiry under the Act
ibid, but the offenders are still continuing the una construction and contravention of the Act ibid.
Accordingly, the site sketch plan of this unauthorized colony/constructions has been prepared and latest
photographs of the unauthorized constructions has been obtained at site and Annexured. You are
requested to direct the concerned to get stop the unauthorized constructions being that theraised
immediately by the above named offenders. is further intimated contravention/violation of section 7 (ii)
of Act ibid and rules framed there under, is a punishable offence with imprisonment up to 3 years.
Therefore, you are requested to register a FIR against the above named offenders, investigate the matter
so that the case against the offender be brought to its logical end. You are also requested that the
sanction for prosecution of the above named offender may be obtained from the District Magistrate,
Rewari as required under section 11 of Act no. 8 of 1975, before putting the challan in the competent

court of law. Please also find enclosed documents procured/obtained showing the ownership of the
above unauthorized construction. These documents shall help you to investigate the offence and also
during the prosecution of the aböve named offender. If during course of investigation, name of above
referred contravention/violation of Act no. 8 of 1975 and rules framed there under, and then similar
action may also be initiated against such offenders. It is further intimated that under section 11 B of Act
no. 8 of 1975, police officer not below the rank of Sub Inspector has power to arrest such offenders (A
copy of relevant portion of section 11B of Act no. 8 of 1975 is enclosed for your ready reference). You
are also requested to keep vigil on the above referred unauthorized construction and the surrounding
area and get them stopped immediately when such unauthorized constructions are in initial stage of
development and also bring such unauthorized construction in the notice of under signed as envisaged
in section 11A of Act no. 8 of 1975 (A copy of relevant portion of section 11A of Act no. 8 of 1975 is
