Instructions:
As this examination is in online mode with open book system, the students are expected to demonstrate a very high degree of
Academic Integrity and not copy contents from resources referred. Instructors would look for understanding of the concept by
the students and any similarity found from resources online/ offline shall be penalized in terms of deduction of marks and even
cancellation of paper in requisite cases. The online examination committee of the School would also look for similarity of two
answer scripts and if answer scripts of two or more students are found similar, both the answer scripts shall be treated as copied
and lead to cancellation of the paper. In view of the aforesaid points, the students are advised that they should desist from using any
unfair means.

extent and with the same pace law has also evolved. On the basis of abovementioned
statement, trace down the evolution of competition law from MRTP Act. 25 M CO 1
b. Also explain what difference it would have created in the existing market scenario
if we would have still followed the old MRTP Act.

2 While dealing with Anti-Competitive agreements the thing which we need to be


considered is not Adverse effect on competition but we should rather focus on
Appreciable Adverse Effect on Competition.
a. In the light of abovementioned statement critically comment how appreciable

Competition.
b. Also explain what difference it would have created if we would have used the
term Adverse effect on competition in the section.

3 General Motor Company, a renowned company manufacturing trucks, imposed 25 M CO 3
conditions restricting to sell the trucks and other spare parts only within specified
geographical territories to its distributors and dealers. They were not allowed to sell
the trucks and spare parts except to the individuals, firms or corporations having the
place of business in the specified territory. Aggrieved by this the distributor and
dealers outside this geographical area wants to bring a legal action under
Competition Act 2002.
a. On the basis of aforementioned statement, critically analyse whether this type
of conditions can be imposed.
b. What difference it would have created in the situation if the condition was
imposed in such a manner that only a franchisee system would have preferred
outside the geographical area.

4 Zuber, a renowned cab service provider company entered into Indian market. While
starting its business in India, Zuber Provided huge discounts for cab rides to its
customers which were below the actual cost incurred by Zuber on every ride, also
they were provided with certain reward points which they can redeem later. Since the
prices were exorbitantly low, this has created a problem to other service provider in
the market, and for the same they filled a complaint to CCI alleging that Zuber has

indulged into Abuse of Dominant position.
a. In the Lights of abovementioned statement, critically comment that whether
Zuber has indulged into Abuse of dominant Position.
b. Also Explain the concept of Predatory Pricing.
c. Does promotional schemes also amount to Abuse of Dominant Position. If
not than what is the exact parameter which should be looked upon.
