Written statement on behalf of the Respondent under Order VIII (Rule 1)

The Respondent respectfully states as follows-

1 –Para 1 of plaint is admitted and needs no reply.

2- Para 2 of plaint is admitted and needs no reply.

3 –Para 3 of plaint is admitted and needs no reply.

4- Para 4 of plaint is admitted and needs no reply.

5- Para 5 of plaint is admitted and needs no reply.

6- Para 6 of plaint is admitted and needs no reply.

7- In reply of para no. 7 the plaintiff itself has mentioned that the defendant has supplied a
cheque of rupees 50,000 as per the plaintiff’s demand and thus the contract was initiated and the
plaintiff began supplying various reading materials to the defendant.
8- In reply of para no. 8 Rs 50000 of Rs 75000 was paid by defendant through a post dated
cheque which the plaintiff willfully accepted.

9-In response to para no. 10 it is nowhere mentioned that the defendant has denied from paying
the amount even after several requests from the plaintiff

10 In reply of para no. 11 Rs 50000 of Rs 75000 was paid by defendant through a post dated
cheque which the plaintiff willfully accepted.

11. In reply of para no. 12 no communications was made even by plantiff to defendant

12. In reply of para no. 13 the defendant defendant provided a post dated cheque 295959  of Rs.
50,000/- drawn on HDFC Bank, Branch Barakhamba Road, Delhi. The same was accepted by
the plaintiff. X must have checked the details on the cheque properly before entering into a
contract with Y

13. plantiff breached the Contract at moment he decided to not supply further reading materials
and magazines to Y which means that the plaintiff himself is liable to pay damages to the
defendant.

Prayer:
It is, therefore most respectfully prayed that this Hon‟ble Court may be pleased to:

a) Dismiss the suit of the plaintiff.


b) Pass any other just and equitable order as deemed fit in the interest of justice

Verification

In the above-named Defendant do hereby verify that the contents of the para no. 1,2,3 and 4 are
true to my knowledge and the contents of remaining paras are according to legal advice from my
advocate which I believe to be true.
