Policies for this Course:

This two-hour once a week subject does not sanction absence unless it is for a valid
reason and/or with a medical certificate. Since classes will be conducted via Zoom, it is
imperative that students listen attentively and will not use or answer their cellular phone
during class. During surprise quizzes, tests and exams, if a student checks his/her cellular
phone, computer or i-pad other than the instrument/program he/she is using, this will be
considered cheating and will automatically be given a failing grade for that exam. Three
“cheating” cases will mean a failing grade.

Perfect attendance will automatically merit a grade of 2. This policy is an incentive


for students to always attend class.

1. Overview on Drafting Documents and Pleadings

Cardinal rules in drafting legal documents; form and size; notarial law;
typewritten or handwritten documents; fees payable (notarial, stamp taxes, land
registration; chattel mortgage, court fees, sheriff’s, costs)

2. Notarization through Videoconferencing during Quarantine

A.M. No. 20-07-04-SC known as the 2020 Interim Rules on Remote Notarization of
Paper Documents (“RON Rules”) issued in 14 July 2020 which became effective 15
days after its publication

Apostille: A certificate that authenticates the origin of a public document and makes
the document acceptable in member-countries of the Hague Apostille Convention

3. Notarization in relation to contracts

General Rule: A defective notarization does not affect the validity of a contract.

Exceptions:

a. Donation of immovable property


b. Partnership where immovable is contributed
c. Notarial Will
d. Registration of Documents (Forms in conveyancing – Section 112 of
Presidential Decree No. 1528 or the Property Registration Decree)
e. Transfer of Ownership
f. Effectivity as against Third Persons
- Assignment of credits and Partnership having a capital of P3,000.00 or
more Articles 1625 and 1772 of the Civil Code
Marriage settlements – Article 77 of the Family Code
g. Affidavit
h. Special Power of Attorney – Article 1878 of the Civil Code
i. Last Will and Testament
Release, Waiver and Quitclaim – Article 6 of the Civil Code
