POWERS OF THE REGIONAL SUPERVISORY COUNCIL AND THE
NOTARY BOARD OF HONOR IN RELATION TO VIOLATIONS COMMITTED BY NOTARY (a case study in the city of Tangerang)
Notary as a public official, is one of the state organs with legal
authority to provide public services to the community, in making Authentic Deed as a perfect proof with respect to law actions in the field of civil law. Notary is of private and bound by the rules of his tenure and subsequently a notary is free in carrying out his profession. Notary is appointed and dismissed by the Government however the notary does not receive any salary and pension from the Government, the revenue is received from Notary’s client honorarium. The notary is a public official appointed by the State, be given certain duties and authority by the State in order to serve the interests of society, namely to make an authentic deed. The duties and powers which must be run with the best effort and precision because any mistake, the more ill- treatment by the Notary might lead to disruption causing legal certainty and other losses that are not necessary to happen. Therefore we need coaching, development and continuous monitoring so that all notaries will further improve the quality of public service, it is necessary to place an organization with a code of ethics and a standard of public service quality, in the presence of a notary organization it will be easier to carry out supervision to the holders of notarial profession who are given duties and authority as public officials. This study uses empirical juridical approach, used to provide an overview and analysis on the Authority of the Regional Assembly and the Board of Trustees Honorary Deed in relation to offenses committed by the Notary (Case Study In Kota Tangerang). In conducting this research the writer uses a combination of quantitative and qualitative data analysis. From the result of the research it shows that violations of the profession and Notarial Code of Ethics are difficult to recognize, for example ones occur in Notary practices which are not honest in terms of work areas, if any notary works outside his working area, the extent of MPD to find out and prove it as well as the extent to which MPD dare to take action for these violations. MPD is given the authority to inspect the Notary, among others, to held a hearing to examine any alleged breach or violation to the Notary Code of Ethics or violation to Public Notary office implementation; to make the decision to impose sanctions on those who violate UUJN and Notary Code of Ethics
