This Contract made and entered by and between:

Department of Environment and Natural Resources (DENR) - Provincial

Environment and Natural Resources Office (PENRO), a government agency with
office address at Brgy. San Juan, Surigao City, herein represented by
ALEJANDRA B. BOISER, OIC, PENR Officer herein referred to as the FIRST PARTY;

ENGR. HARRY A. SABANDAL, of legal age, Filipino and with residence address at
Purok Gumamela, Brgy. Taft, Surigao City herein after referred to as SECOND PARTY.

-WITNESSETH-

1. That FIRST PARTY is in need of the services of the SECOND PARTY who shall perform
work not performed by the regular and casual personnel of the FIRST PARTY;

2. That the SECOND PARTY has signified his intention, to which the FIRST PARTY has
accepted, to provide the service(s) needed by the FIRST PARTY;

3. That the SECOND PARTY hereby possesses the education, experience and skills required
to perform the job as described herein;

4. That the SECOND PARTY hereby attests that he is not related within the third degree of
consanguinity or affinity to the 1.) Hiring authority and/or Representative of the First Party;
that he has not been previously dismissed from the government service by reason of an
administrative offense; that he has not already reached the compulsory retirement age of
sixty five (65);

5. That in view hereof, the SECOND PARTY is hereby contracted as Infrastructure

Specialist for the period covering July 7, 2021 to December 31, 2021 in consideration of
wage in the amount of Twenty-Five Thousand Pesos (₱ 25, 000.00) computed on a daily

basis.

6. That as Infrastructure Specialist the Second Party is expected to perform the following
work / tasks: (This should be quantifiable)

a. Prepare the engineering plans, detailed cost estimates, program of works,

items, bill of quantities, cost and pertinent, operation and maintenance program
for proposed projects submitted by the End-users, which shall include among
others:
b. Conduct Project eligibility and environmental screening on-site of proposed
project concepts and proposals prepared by DENR PENRO, CENRO TUBOD
and SIPLAS Dapa prior to the conduct of site inspection to ensure that the
Projects environmental and social safeguard guidelines are followed during the
finalization of the project proposal;
c. Inspect all on-going physical construction activities and provide technical advice
to End users to ensure on-time and quality implementation of the project;
d. Prepare all physical progress reports for all on-going projects and consolidate
the same for submission of a monthly report to DENR PENRO which shall
serve as supporting document for the Contractor/Supplier’s billing;
e. Review the documents attached to the request of the Contractor/Supplier for
fund release submitted by the End user for their contracted project to ensure the
completeness, consistency and correctness of technical documents attached to the

 request for fund release matches with the physical accomplishment of the
project, before release of payment;
f. Preparation and construction of schedules and estimates cash flow, utility
relocation plan, safety and health plan being considered;
g. Preparation of site road right of way should it be necessary;
h. Preparation of value engineering studies which shall be conducted according
to accepted standards and practices;
i. In case of any infrastructure project changes that would arise desirable
design standards of principal features, he shall recommended the changes
thru a detailed justification including their effects in the cost;
j. Participate in the conduct of final inspection of completed projects ;
k. Performs other functions/ tasks as may be assigned by immediate

supervisor/higher authority which are necessary in connection with the

implementation of the project;

7. That the FIRST PARTY shall reimburse the SECOND PARTY for his actual travel cost
and expenses, should he be required to Travel, with corresponding Travel Order, upon
showing of Official receipts for the following expenses:
i. Transportation cost;
ii. Lodging cost; and
iii. Food (provided it does not exceed P 150.00 per meal).

8. That the SECOND PARTY shall work at least eight hours a day at 8:00 A.M. to 12:00 NN
and 1:00 P.M. to 5:00 P.M.

9. That the FIRST PARTY is authorized to automatically deduct the monthly Pag-IBIG of One
Hundred Pesos (₱100.00) on the SECOND PARTY under this contract who is a registered
self-employed member based on the approved monthly contribution/premium.

10. That the provision under Sec. 19 of R.A. 1161 otherwise known as the Social Security Law is
not applicable to the FIRST PARTY. Hence, the FIRST PARTY is excused from the so-
called Employer’s Contribution.

11. That instead of Sec. 19 of the said law, Sec. 19-A of the same law should be applied with
respect to payment of contribution. Therefore, the SECOND PARTY will solely shoulder
his monthly contribution based on the amount stipulated under par. 8 of this Contract.

12. That it is understood that this contract does not create an employer-employee relationship
between the FIRST PARTY and the SECOND PARTY, that the work rendered hereunder
are not considered and will not be accredited as government services.

NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE PREMISES, THE

PARTIES HEREBY AGREE AS FOLLOWS:

Section 1: This contract shall cover the period from July 7, 2021 to December 31, 2021.

Section 2: The terms of employment shall be effective from the months of October 1,
2021 to December 31, 2021. however, the terms of payment of services or the obligated fund
shall be only from the month of October 1, 2021 to December 31, 2021.

Second Party ENGR. HARRY A. SABANDAL Section 3: In view of the nature and significance of this contract being impressed with
public interest and to ensure compliance in good faith of the contracted services, the contract
may be terminated by the FIRST PARTY motu proprio or upon the recommendation of his/her
immediate supervisor, subject to the application of the 2017 Revised Rules on Administrative
Cases in the Civil Service, on the following grounds:

a. Serious Misconduct by the Second Party;

b. Willful disobedience by the Second Party;
c. Gross and habitual neglect of duty by the Second Party
d. Fraud by the Second Party;
e. Lack of trust and confidence by the First Party; and
f. Other similar causes.

Section 4: In the event of breach of this agreement, the parties may exclusively file an
action in the court of Surigao City, Philippines.

IN WITNESS WHEREOF, both parties have hereunto set their hands this ______ day
