Dear Ma’am/Sir:

By virtue of the authority vested upon this Office under HLURB Resolution No. R – 611, series of 1998, and
HLURB Resolution No. R – 606, series of 1997, non-field monitoring was conducted by this Office on July 22,
2021 to determine your compliance with laws, rules, regulations, standards and guidelines that the Board
implements.

Upon evaluation of your project’s records on file, the following violations relative thereto have been noted, to wit:

1. Failure to secure Development Permit (DP)

2. Failure to Register Project
3. Selling without development permit
4. Selling without License to Sell
5. Selling without Certificate of Registration
6. Advertisement without prior approval

In view of thereof, this Office hereby issues this NOTICE OF ALLEGED VIOLATION AND ORDERS you to
undertake the following actions within ten (10) days from receipt of this Notice:

 Submit a sworn explanation/s why no administrative fines/sanctions shall be imposed against you for
the above-stated violations
 Cease and Desist Order from further selling of lots unless permitted by this office and/or pertinent
permit/s and licenses/s shall be secured; and
 Secure/or Apply for Development Permit with the LGU of President Quirino
 Secure Certificate of Registration and License to Sell from this Office before selling any subdivision
lot

Non – Compliance with this Notice and Order within the period herein prescribed shall be deemed by this Office as
basis to institute administrative sanctions as may be warranted under existing laws, such as but not limited to,
issuance of an order for the imposition of fine.

RE: REQUEST FOR ASSITANCE IN THE ENFORCEMENT OF CEASE

AND DESIST ORDER FROM THE SUBDIVISION LOTS

Dear Sir/Ma’am:

On ____________ this Office issued a Cease and Desist Order from selling subdivision lots
to ABC Real Estate Development, Inc. for its project, ABC Subdivision located at Brgy.
ABC, Koronadal City for violating Section (4)- Registration of Projects, Section (5) –
License to Sell and Section (19)- Advertisements of Presidential Decree No. 957.

In this Regard, we would like to seek your assistance in the enforcement of the CDO by not
allowing the transfer of titles from ABC Real Estate Development, Inc. to its buyers. The
non-transfer of the titles is necessary in order not to render nugatory and ineffectual the CDO
