IMPORTANCE OF ESTABLISHING AND MAINTAINING A
FRAMEWORK FOR HEALTH, SAFETY AND SECURITY
• A growing focus on the need for workplace safety and a commensurate
increase in legislated obligations on employers to provide a safe
working environment for their workforce has seen workplace health and
safety become arguably one of the largest compliance obligations
faced by businesses.

WHS ACTS, REGULATIONS AND CODES OF PRACTICE

• In 2011, Safe Work Australia developed a single set of WHS laws to be
implemented across Australia.
• These are known as ‘model’ laws. For the model WHS laws to become
legally binding, the Commonwealth, states and territories must
separately implement them as their own laws.

WHS HARMONISATION
• WHS legislation has been harmonised with the aim to have balanced
and nationally consistent WHS legislation.
• The Commonwealth legislation and regulations listed are the
framework to which most Australian states and territories have
modelled their own legislation and regulations.

ACTS
• In most states:
• the Work Health and Safety Act
• The WHS Act provides a framework to protect the health, safety and
welfare of all workers at work and of other people who might be
affected by the work.

REGULATIONS
• Set out the standards you need to meet for specific hazards and risks.
• Also set out the licenses you need for specific activities, the records
you need to keep, and the reports you need to make.

CODES OF PRACTICE
• Provide practical guidance on how to meet the standards set out in the
WHS Act and the WHS Regulations.
• Are admissible in proceedings as evidence of whether or not a duty
under the WHS laws has been met.

AUSTRALIAN STANDARDS
• Standards are published documents that set out specifications and
procedures designed to ensure products, services and systems
are safe, reliable and consistently perform the way they are
intended to.

WHS RESPONSIBILITIES
The following key elements of the WHS legislation will impact the way a
person will do their job:
1. PCBU must ensure the health and safety of workers and others.
2. Officers of corporations and unincorporated bodies exercise due
diligence to ensure compliance.
3. Workers must make sure their acts do not adversely affect the health
and safety of persons at a workplace.

THE ORGANISATION'S WHS MANAGEMENT SYSTEM (WHSMS)
• A workplace health and safety management system (WHSMS) can be
thought of as a particular, organisational wide approach, instituted by a
person conducting a business or undertaking (PCBU), in order to
minimise the risk of injury and illness arising from activities related to
their business.

FINANCIAL AND HR REQUIREMENTS
• In order for a WHS system to function effectively as an integrated
working whole, it must be supported by effective management of both
financial and human resources. It is a manager’s role to ensure that
these are identified and provided.

FINANCIAL RESOURCES
• Money is needed to fund a range of areas related to WHSMS such as
establishment activities, acquiring necessary physical resources and
maintaining the system once it has been created.

HUMAN RESOURCES
• ‘Human resources’ refers to the personnel required to implement the
WHSMS.
• Like financial resources, all the activities listed will require human
resources support from the business which underlines the need for
management to identify and allocate required human resources.

IN THE WORKPLACE
• Consultation gives people the opportunity to participate and share
information about work health and safety.
• Consultation is a legal requirement and an essential part of managing
health and safety risks.

CONSULTATIVE PROCESSES
• A list of approaches to consultation have been provided. The
mechanisms used will vary according to the size of the workplace but
these are common ways of getting others involved.

DEALING WITH ISSUES RAISED
• Each workplace will have different processes, however the committee
or the HSR will generally present issues to management.
• This may occur at a formal meeting or via email.

OUTCOMES OF CONSULTATION
• Once consultation has been undertaken it is
important to communicate the information received
and analysed as quickly as possible.

HAZARDS, RISK ASSESSMENT AND CONTROL IN THE
WORKPLACE
• It is a legal requirement that workplaces are free of hazards and safe.
This means hazard identification and risk assessment and control is an
essential part of WHS and are also necessary to meet legislative
requirements.

RISK CONTROLS AND HAZARD PROCEDURES
• Risk management is the process of reducing or managing the risks
when working with a hazard or in a hazardous situation.

RISK ASSESSMENT
• To be able to manage risk you need to recognise the hazards you may
encounter in the workplace.
• This is done by completing a risk assessment.

• WHS can be complex, needing interpretation from legislation and
industry regulations with heavy penalties and risks associated with
non-compliance.

• You are required to develop a WHS induction manual for an industry
sector/organisation of your choice.
• The manual is to provide basic WHS guidelines and information for employees on
hazard identification and risk assessment and control.
• It should be no more than three pages and you can include graphics and images.

• All employees must be provided with the necessary training and
information to ensure they can work safely.
• It is also an employee’s responsibility to participate in WHS training as
required of their job role, and any refresher training.
