IMPORTANCE OF ESTABLISHING AND MAINTAINING A
FRAMEWORK FOR HEALTH, SAFETY AND SECURITY
• A growing focus on the need for workplace safety and a commensurate
increase in legislated obligations on employers to provide a safe
working environment for their workforce has seen workplace health and

WHS ACTS, REGULATIONS AND CODES OF PRACTICE


• In 2011, Safe Work Australia developed a single set of WHS laws to be
implemented across Australia.
• These are known as ‘model’ laws. For the model WHS laws to become
legally binding, the Commonwealth, states and territories must
separately implement them as their own laws.

WHS HARMONISATION
• WHS legislation has been harmonised with the aim to have balanced
and nationally consistent WHS legislation.
• The Commonwealth legislation and regulations listed are the
framework to which most Australian states and territories have
modelled their own legislation and regulations.

CODES OF PRACTICE
• Provide practical guidance on how to meet the standards set out in the

WHS RESPONSIBILITIES
The following key elements of the WHS legislation will impact the way a
person will do their job:
1. PCBU must ensure the health and safety of workers and others.
2. Officers of corporations and unincorporated bodies exercise due
diligence to ensure compliance.
3. Workers must make sure their acts do not adversely affect the health
and safety of persons at a workplace.

THE ORGANISATION'S WHS MANAGEMENT SYSTEM (WHSMS)
• A workplace health and safety management system (WHSMS) can be
thought of as a particular, organisational wide approach, instituted by a
person conducting a business or undertaking (PCBU), in order to
minimise the risk of injury and illness arising from activities related to
their business.

FINANCIAL AND HR REQUIREMENTS
• In order for a WHS system to function effectively as an integrated
working whole, it must be supported by effective management of both
financial and human resources. It is a manager’s role to ensure that

MEASURING EVALUATING THE WHSMS
• A WHSMS needs to be evaluated and determined to:
• Judge effectiveness of decision making processes used
• Serve as the basis for maintaining compliance
